TO: Honorable Mayor and Members of the City Council through City Manager FROM: Dan St. John, F.ASCE — Director, Public Works & Utilities Jeff Stutsman, P.E. — Senior Civil Engineer, Public Works & Utilities SUBJECT: Resolution Accepting Completion of Coastside Concrete and Construction Inc., Contract for the Deer Creek Improvements Project RECOMMENDATION It is recommended that the City Council approve the Resolution Accepting the Completion of Coastside Concrete and Construction Inc. Contract for the Deer Creek Improvement Project. BACKGROUND In 2012, the Petaluma Neighborhood Association (PNA) filed an appeal to the City Council with respect to the approvals for the Friedman's-anchored Deer Creek Village Shopping Center. PNA raised concerns that the developer did not adequately address the traffic impacts and pedestrian safety around the development. The PNA withdrew its appeal in exchange for additional traffic mitigations and charitable contributions to organizations that serve the Petaluma community. Mitigation measures that were suggested included pedestrian improvements to make the project more accessible to the community. Prior to construction, the traffic calming measures were discussed with a representative of the PNA to ensure consistency with the intent of the settlement agreement. The project plans were reviewed and approved by the PNA. The mitigations consist of traffic calming measures that include the construction of three new curb ramps and the installation of a marked crosswalk with rectangular rapid flashing beacons on Professional Drive at Rushmore Avenue, the installation of two radar feedback signs on Rainier Avenue and installing new continental style crosswalk markings at Rainier Avenue at Maria Drive crosswalks. The proposed action meets Council Goal: "Plan for and implement priority capital projects as funding permits." DISCUSSION The bid was awarded to Coastside Concrete and Construction Inc. for the Deer Creek Improvements Project. Construction occurred from January 15 through January 31, 2018. The final construction contract is $86,482.25. All overruns and underruns of estimated unit quantities added up to a total contract overage of $6,697.25 based on the quantities that were actually used. There are no disputed claims and the project was completed satisfactorily without any significant incidents. FINANCIAL IMPACTS Council approved a project budget of $95,000, which was funded by developer contributions and Street Maintenance funds (2411). Location Map 0) Attachment 1 RESOLUTION ACCEPTING COMPLETION OF COASTSIDE CONCRETE AND CONSTRUCTION INC., CONTRACT FOR THE DEER CREEK IMPROVEMENT PROJECT WHEREAS, in accordance with Section 68 of Article X of the City of Petaluma Charter, Section 20162 of the California Public Contract Code and other applicable law, the City of Petaluma solicited bids for the Petaluma Complete Streets project ("Project"); and WHEREAS, bids for the Project were opened on April 27, 2017, in accordance with California Public Contract Code Section 4104.5 and other applicable law; and WHEREAS, the apparent low bid for the Project was the bid of Coastside Concrete Inc. in the amount of $79,785.50; and WHEREAS, by Resolution No. 2017-100 adopted July 3, 2017, the City Council of the City of Petaluma found the bid of $79,785.50 for the Project to be the lowest responsive bid and awarded the Project to Coastside Concrete Inc. in the amount of 79,785.50 conditioned on Coastside Concrete Inc. timely executing the Project contract and submitting all required documents, and authorized and directed the City Manager to sign the Project contract on behalf of the City; and WHEREAS, there were no change orders affecting the Project amount; and WHEREAS, the final construction contract amount as amended including all change orders, overruns, and underruns is $86,482.25 and is within the approved project budget; and WHEREAS, City staff have inspected the Project and determined that it has been completed in accordance with the contract requirements subject to the Contractor's continuing warranty and other obligations pursuant to the contract; and WHEREAS, based on the foregoing, staff recommends acceptance of the Project on behalf of the City. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as follows: 1. The contract entitled Deer Creek Improvements, Project No. C1610721 with a final construction contract amount of $86,482.25 is accepted as complete subject to the Contractor's continuing warranty and other obligations pursuant to the contract. 2. The City Clerk/Recording Secretary is hereby authorized and directed to file a Notice of Completion concerning the Project with the Sonoma County Clerk's Office within ten (10) days of the date of this Resolution. 3.
