City Hall - Petaluma, Calif Regular meeting of the Council 'of the City of Petaluma called to. order' bY Mayor Schoeningh., ROLL CALL: Present: Councilmen Adams., Bigelow, Brown, Gustafson, Norwood, Schwobeda and Mayor Schoeningh. Absent: None. 1 INVOCATION: Ihvo was given by Father James Kiely Catholic Church, APPROVAL OF MINUTES: Minutes from the meetings of May 6, and May 9, 1955, were approved as recorded. PETITTO & C01MMUNICATIONS: Copy of application for transfer of Alcoholic Beverage License filed by Bend with the Dept. of Alcoholic Beverage Control and approved by.Chief of Police Del Maestro,, submitted and filed. Letter of resignation from the Planning Commission dated April 27, 1.955, signed by Harold B. Seiler, read and filed. Mayor Schoeningh remarked that Mr. Seiler had been a very valuable member of the Planning Commission and had devoted consider - able 'time to it. Ci ty Attorney Karl Brooks was directed to prepare a*resolution accepting the resignation of Mr., Seiler. REPORTS OF CITY OFFICIALS: City Manager Claims approved for payment by the City Manager were submitted; whereupon, Res. #1488 N.C.S. introduced by Councilman Schwobeda,.seconded by Councilman Adams, approving claims and bills (Nos. 3795 to 3997 Inclusive) was adopted by 7 affirmative votes. City Planning Comm.. The City Attorney stated that the next step in this procedure would be forthe Council to study and consider this plan to determine whether or not they wished to adopt it. It was therefore referred to the City Council for study and to the City Attorney for an opinA:on as to the entire procedure to be followed. -Resolution adopting Master Plan of Land Use for City of Petaluma, submitted and filed. ,Cedar Grove Park Rezoning Denied Copy of resolution denying rezoning of Cedar Grove.Park, sub- mitte'd and filed; letter of explanation thereon dated May 6., 1955, read and filed.,. Karl -Brooks stated that he believed, but was not certain at this time, , that it would be in order for the Council to have a hearing on this,,matter.. He was directed to give his written interpretation at t.h0l.., meeting of Monday, May 23, 1955, so the Council would be able to act in accordance with the law.. In answer to a question put to the Council by Mr. Ben Woodworth, the Mayor stated that the time for the hearing could very well be set at the adjourned meeting next Monday. Mr. Brooks was directed to meet with the committee as an advisor in case a resolution on the subject should be necessary. This - bei - ) gt e time . and place set for thecanvassing of votes on the 1955 Northwest Annexation special election City Clerk Gladys R. Wallin announced that there were a total of 22 votes,, 17 affirmative and 5 negative, and no absentee ballots.. The question arose, during the canvassing of votes, as to whether or not two tally sheets should have been submitted. City Attornei ' 7 Karl Brooks gave his opinion that the one tally sheet which had been submitted would be sufficient; however, he did recommend that the matter be held over until next Monday's adjourned meeting, stating that if the ordinance and resolution on the annexation were passed now and i was determined that two tally sheets were legally necessary, then said ordinance and 'resoluti'o resolution would become invalid. Mayor Schoen then asked if h1r. Bro-oks, objected 'to the Council's passing tte resolution and ordinance at this 'time. City Attorney Brooks answered that he had no to this; whereupon, Res, 71491 N.C.S,, introduced by Councilman Brown, seconded by Councilman Norwood, entitled, "RESOLUTION DECLARING CANVASS OF RETURNS AND RESULT OF SPECIAL ELECTION CALLED FOR THE PURPOSE OF SUBMITTING THE QUESTION OF ANNEXATION TO THE ELECTORS RESIDING 1 IN THE TERRITORY M' AS THE "19555 NNORTHATEST ANNIaATION was ddopted by 7 affirmative votes; and Ord. #393 N.C.S. introduced by Councilman Norwood, seconded by Councilman Brown,, entitled, I "AN ORDINANCE APPROVING ANNEXATION OF INHABITED TERRITORY KNOI-W4 AS THE ' NORTH ANNMXkTION" TO T'IT' CITY OF PETALUN1A, COUNTY OF SONOMA, STATE OF CALIFORNIA." was ordered published by 7 affirmative votes.. At this time, Councilman Norwood asked if there was any way of eliminating such situations as the one which had come about this evening regarding the number of tally sheets which should have been submitted. �:D The Citv stated that these situations seemed to arise after any election, although Inspector in each precinct was always furnished with specific instruction's, on the proper procedure 'to be followed. hits. 1! added that this was probably due to the fact that there were always some people serving who had n(. had ,(previous experience. I I 1 165 May 16, 1965 Mayor Schoeningh stated that it had been rumored that members of the audience had not been given sufficient opportunity to be heard at a particular meeting recently. He explained that his reason for feeling that these parties should not be allowed to speak more than 3 or 4 times was because he believed any further talk on the subject would have degenerated into an argument between the Council and members of the audience, which would have been entirely out of order in the Council room. Councilman Schwobeda suggested that this same point had come up.enough times that he felt A standard procedure on the matter would be in order. He suggested forming a policy, whereby members of the audience would be limited to speak only a certain number of times, and that they be informed accordingly before starting to speak.* ADJQURNMEN ThOr&being no.further business to come before the meeting, the meeting was adjourned to Monday, May 23, 1955, 8:00 P.M.
