oLQ July 18, 1955 7-.3b P.M. City Hall - Petaluma, Calif. Regular meeting of the Council of'the City Of Petaluma called to order by Mayor Schoeningh. ROLL ' CALL : Present: Councilmen Adams, Bigelow King, .w, Brown, Gustafson Norwood and Mayor Schoeningh. Absent: None. INVOCATIOR: Invocation was given by Reverend William Ruhl, Grace Evangeli- cal and Reformed Church. APPROVAL OF MINUTES: Minutes from the meeting of July 11, 1955, were approved as recorded. PUBLIC HEARINGS: Rezone Southeast Side of "B" St. - 10th to Laurel time -_ J t hearing protests on the I i is being the ' and place se proposed rezoning of the side of "B" Street from 10th to LaUrel from an R-2 Zone to an R-3 Zone, Mayor Schoeningh invited anyone in the audience who wished to speak on the subject, either - pro or con, to do so at this . 'Dime Dr. Charles Bascom of:913 B Street, asked if the City Clerk had in her possession a copy of a letter which had been written to the Planning Commission by Mr. M. M. Rosenbloom, and requested that the letter be read. City Clerk Gladys Wallin then read the letter submitted by Mr. Rosenbloom dated May 21, 1955, protesting the proposed B Street rezoning, and a letter of explanation thereon received from the Planning Commission and dated July 15, 1955, was submitted and filed. Mr. Charles Corbin., who resides at 100 - 10th Street, objected _ to the rezoning, stating that he felt it would detract from this area which had been for so long a time residential; and, he believed ,,the 'things proposed to be done in the.rezoned area could very well be'done in the zones near by which are not residential. Mrs. Corbin stated that thev were also opposed to the rezoning because of the fact that - there was so much vacant land which would be rezoned,, making it possible for non-residential things to go into 'the area, thereby _changing . the neighborhood greatly. Miss Edna Flohr, speaking - for her Mother, owner of property at 22 - 10th Street, stated that she objected to the rezoning for the 'same, reasons as Mrs. Corbin had stated. Councilmen Adams and Brown stated that they were in favor of rejecting the rezoning as the Planning Commission had done. Council- man Brovm stated that this would not.keep Dr. Ritter from building his proposed laboratory as he understood there would be plenty of land available for these, when the new hospital was built. Councilman Bigelow, Council rewesentative on the Planning Commission, explained that the Commission had denied this application because of the great opposition to rezoning the property 11 FR_3 11 ; whereupon, Res. #152.2 N.C.S- introduced by Councilman Bigelow, seconded by Councilman Drown, entitled, "RESOLUTION RESJECTING THE PROPOSED AMENDI= TO ZONING ORDINANCE NO. 340 N.C,.S. TO REZONE THE SOUTHEAST SIDE OF 11 STREET FROM TE�TTH STREET TO LAUREL AVENUE FROM AN llii, ZONE OR DISTRICT TO AN 11 R-3 11 ZONE OR DISTRICT. was adopted by 7 affirmative votes. PETITIONS & COMMUNICATIONS: Copy of letter dated July 11, 1955,_from Mr.,G. S I tonitsch of Stonitsch & Arvold., protesting the Cedar' Park'Rezoning, submitted and filed; letter of�explahation thereon from Planning Commission dated July 15, 1955, read and filed. With the approval of the Council, the Mayor instructed the City.Clerk to put this copy of Mr. Stonitsch's letter on " file. The letter had been previously read at the meeting of July 11" 1955. REPORTS OF CITY OFFICIALS: City Manager Claims apprbved.for payment by . the City Manager were submitted, whereupon, Res. #1523 N.C.S. introduced by Councilman Adams, seconded by Councilman Gustafson, approving claims and bills (Nos. 1I.2 to'224 inclusive) was adopted by 7 affirmative votes. Director of Public Works - Drivewav at 5avmond & Oli 'and Gustafson had checked this site with him and felt that it would cost t t I he City less than 9100.00 to tear out the.curb and re-build the curb and part of the sidewalk, so that Mr. S,ou hwick could then build the driveway from property line.in. Councilmen? Brown and GU were both in favor of . ahead with this'work. Re Sunnv Slope &- "I", St. Sewer ReT)rt o_of'Direztor of PUblic Works dated July 18,, 1955 ' stating _'that, after investigating the matter, it was learned- that this line had been laid across an abandoned . septic . tank which had caved -IIn and allowed the line to settle; and, since the obstruction has been 'removed., it's quite possible that this will last for several years without having to be replaced, submitted and filed. Direc o f Public Works Re Sewer - 7 Grand View Avenue Letter from Director of Public Works dated July 15, 1955, recomznendin,a_ reconstruction of a disposal system, in 'that area and that ,steps be taken to acaui.re a 50 fl,00t right of way for Grand View Avenue, instead of the 40 foot that now exists. Also, that _ -.. -be f inanced by cash donations from the property owners or the formation of a small sanitation district. Oscar Schindler, 7 Grand View Avenue, appeared before the Council to clarify the problem involved, stating that the sewer line throuF-h the back yards of several property owners in this area which caused.quite a problem; this being a , privately owned sever line, all repairs had to be borne by the property owners Mr. Baird stated that he had talked with two of the property owners ;.n _ the area and that they were in favor of forming a small Sanitation district. The Director of Public Works was directed to have a consulta- tion i) ith all of the 7 property owners affectived by this situation, not with the - view of the City paying for any of this as it is a p'll"Lvately owned line, but merely to help them over the engineering prob.em involved. City t ©rnev.de e -July 18, 1955, giving his opinion that it would be perfectly in order for the City to pay for the cost, of this proposed project out of the 1953 Sewage Worka Enlargement.: Construction Fund, read and filed° Report of Director of Public Works dated July 14, 1955, . reconEnending that a sewer be constructed from Lindberg Lane to McDowell Village on the northeasterly side of McDowell Road and that this be done in conjunction with the improvement of McDowell Road, submitted and filed; plans and specifications thereon, submitted and filed. Report of the' Citv Manager dated July 14, 19.55,. submitting the budget estimate for 1955 -56 for Civil Defense,. submitted and filed. To a question asked by Councilman King regarding the Civil Defense budget, City Manager Ed Frank and Mayor Schoeningh explained that the City was merely a spending agent for these funds. Colonel Wiley O ?Mohundro, Assistant Director of Civil Defense in Petaluma, pointed out the reason for the increase in this year's budget stating that the major reason was the Civil Defense job here 'a =.a�rrig i n.crea.sed considerably in the past year, with Petaluma being r1. e of the retuge points for dispersees from the Bay Area in case of attack. Councilman King also inquired about the $1,000.00 to be contra buted� to� C evil Defense by the City; whereupon, Colonel OlIvlonundro explaihe`d that the City of Santa Rosa matches .Civil Defense funds from the County, dollar for dollar, while - Petaluma ha I sp: nt nothing in the past. Ff REZONING FROM "M" ZONE OR - DISTRICT TO '"R -1" T1 R2.TT AND "R-3 ZONES OR DISTRICTS NORTH OF BRIDGE STREET." adopted by the following vote: Ayes- Councilmen Bigelow gelow '9 - , Brown., Gustafson., King and Norwood. Noes: Mayor SOhoeningh. Councilman Norwood refused to vote on the forgoing 6rdinance; therefore, the City Clerk was obligated to record this as an affirm- ative vote. Mr. George Pet ' erson, 508 Broadway, addressed the Council requesting that something be done about the noisy booster near his home. He stated that this matter had been pending for quite some time and he would appreciate some 'action being taken, as soon as possible. Mr. Frank informed Mr. Peterson that an engineer California liVaterService Company' had investigated the cause of this .noise and what could b& done about it, and the Council was now awaiting their answer on the survey.
