RECOMMENDATION It is recommended that the City Council approve the Resolution Authorizing the Award of Contract for the Pavement Restoration 17/18 Project to American Asphalt Repair and Resurfacing Company, Inc. BACKGROUND The Street SaverTM pavement management system is used to evaluate road conditions in the City and prioritize maintenance and rehabilitation priorities under a regional MTC program. Priority streets are cross-referenced with the City's other street maintenance projects, City's pavement crack sealing program, development projects, and proposed PG&E and outside utility work to assure that new or nearly new pavement will not be impacted by other planned projects. Streets proposed for rehabilitation are clustered to improve efficiency for the Contractor and provide the most cost effective pricing. The proposed action meets Council Goal: "Plan for and implement priority capital projects as funding permits." DISCUSSION This project will utilize high volume slurry seal, asphalt dig outs, and pavement overlay methods. To reduce contract costs, many of the pavement cracks were sealed by City crews under its preventative maintenance program. The Americans with Disabilities Act (ADA) requires that local governments ensure that persons with disabilities have access to the pedestrian routes in the public right-of-way. Under ADA law, when a street, roadway, or highway is altered, compliant curb ramps are required where pedestrian walkways intersect with the altered street. A roadway alteration in this project includes overlays. For that reason, 23 new curb ramps will be installed within the project limits. The project is partially funded by Senate Bill 1, which is known as the Road Repair and Accountability (RMRA) Act of 2017, to address basic road maintenance, rehabilitation, and critical safety needs on both the state highway and local streets and road system. On October 2, 2017, Resolution 2017-156 N.C.S. approved the proposed project list for RMRA and revised the project budget. High Volume Slurry Seal treatment is a maintenance measure to extend the life of a street by sealing and protecting the road surface, improving drainage and road friction. Seal coat type applications are typically used on roads in reasonably good condition. This work will be funded by approximately $200,000 from the existing CIP project 1651602, entitled Downtown ADA Improvements. The remainder of the project is funded from CIP C1610823, entitled Pavement Restoration. McDowell Blvd S. High Volume Slurry Seal 2 The construction plans and specifications were prepared by engineering staff and a Notice Inviting Bids was advertised on January 18, 2018. Four (4) bids were received as follows: Name of Bidder Base Bid American Asphalt and Concrete, Inc. $ 1,032,097.07 Intermountain Slurry Seal $ 1,075,235.50 Team Ghilotti Inc. $ 1,097,928.93 Coastside Concrete $ 1,103,248.47 The lowest responsible and responsive bidder, American Asphalt Repair and Resurfacing Company, Inc., has performed similar projects throughout the Bay Area and possesses a valid Class A California Contractor's License, #439591, which allows American Asphalt Repair and Resurfacing Company, Inc. to perform the work. It is recommended that Council adopt the resolution awarding the contract to American Asphalt Repair and Resurfacing Company, Inc., the lowest and responsive bidder, in the amount of $1,032,097.07 Construction is scheduled to begin in May 2018 and to be completed by September 2018. Construction management and inspection services will be conducted by City staff with assistance by an outside consultant for material testing. FINANCIAL IMPACTS The project is funded from the Pavement Restoration 17/18 Project (C16101823) with a current budget of $1,091,124 and the Downtown ADA Improvement Project (C16501602) with a current budget of $200,000. WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, City staff prepared construction bid documents and solicited bids for the Project; and WHEREAS, the project was bid on January 18, 2018, and four (4) bids were received and opened on February 8, 2018 in accordance with applicable law; and WHEREAS, the lowest responsible bid for the Project was submitted by American Asphalt Repair and Resurfacing Company, Inc. from Hayward, CA for $1,032,097.07; and WHEREAS, staff has determined that American Asphalt Repair and Resurfacing Company, Inc., bid satisfies the bidding requirements for the Project; and WHEREAS, American Asphalt Repair and Resurfacing Company, Inc., possesses a valid California Contractor's License, Class A, #439591 that allows American Asphalt Repair and Resurfacing Company, Inc. to perform the work for the Project; and WHEREAS, the Project is categorically exempt pursuant to California Environmental Quality Act ("CEQA") and Title 14, the California Code of Regulations ("CEQA Guidelines"), Section 15301, because the project consists of repair and maintenance to an existing public street. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby: 1. Approve the revised project budget for the Pavement Restoration 17/18 Project. 2. In accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, waives any and all non- conformance in the bid of American Asphalt Repair and Resurfacing Company, Inc. for the Pavement Restoration 17/18, Project No. C16101823, finds the bid of $1,032,097.07 to be the lowest, responsive bid and further finds that American Asphalt Repair and Resurfacing Company, Inc., is the lowest responsible bidder. 3. Awards the contract for the Pavement Restoration 17/18, Project No. C16101823 to American Asphalt Repair and Resurfacing Company, Inc., in the amount of $1,032,097.07, the amount of the lowest responsive bid, conditioned on American Asphalt Repair and Resurfacing Company, Inc., timely executing the project contract and submitting all required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 6. Directs staff to issue a notice of award American Asphalt Repair and Resurfacing Company, Inc. 7. Authorizes and directs the City Manager to execute the project contract on behalf of the City of Petaluma upon timely submission by American Asphalt Repair and Resurfacing Company, Inc., of the signed project contract and all other required document, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 8.
