BACKGROUND Petaluma has a long history and tradition as a working river town. Its Victorian iron -front buildings have seen the transition from an agricultural center to boutique destination. The redevelopment of Water Street enhanced the district's historic character while promoting new uses of the street to stimulate the local economy. The Water Street and Turning Basin improvements at the corner of Water and Western Streets were completed in 2006 by "Phase II — At Grade Site Improvements Project" as part of the Downtown Redevelopment Agency's "Petaluma River Access and Enhancement Plan". The program consisted of streetscape features including street and sidewalk resurfacing with brick, cobble and concrete overlays; landscaping; and site furnishings to enhance the pedestrian environment in the historic downtown. Twelve years later, a number of factors point to the need to replace some of the granite cobblestones with an architectural concrete surface. The improvement will help refuse management mitigate ADA concerns, address potential trip and fall injuries, and better guard against rats. DISCUSSION The two types of cobblestones on Water Street are the large cobblestones set in concrete between the tracks and the smaller stones set in sand in a circular pattern in intersection areas. Over the years, some of the smaller cobblestones which have a vertical dimension of one foot, have settled due to vehicle movement (garbage trucks etc.) and loss of sand from underneath during storm events, to the river, and from vermin tunneling. In addition, numerous public complaints from pedestrians have been received noting the uneven character of the cobblestone areas. Areas of Water Street were cited in a recent disability lawsuit. This project will address these issues while improving the ability to roll refuse bins into and out of enclosures for servicing and cleaning. The existing cobblestone circle at the ends of Water and Western Streets, adjacent to the existing deck walk, would be removed and replaced with colored and textured concrete to attempt to preserve the existing architectural character of the area. To prevent the pavement sub -base from being eroded into the river, a concrete cut-off wall will be constructed along the SMART trestle boundary. During design development, adjacent manholes and sewer lines were investigated and it was determined that an existing brick manhole and vitrified clay sewer pipes require upgrading. Several six feet wide defined accessible pathways will also be constructed of colored and textured concrete to connect the footbridge and the wooden deck walk, and to cross the cobblestones at other points along Water Street. Currently, the City of Petaluma has an active contract with Coastside Concrete for the Downtown ADA Improvements Project that involves similar work activity for other ADA improvements in the general area of downtown. The contractor has provided a change order proposal to amend the existing construction contract in accordance with City and industry standards, included as Attachment 2. To approve the change order, the existing contract requires the Council to increase the contract contingency per the Petaluma Municipal Code, but in this case, such an increase could be done without increasing the overall CIP budget. It is recommended that the Council approve the subject project as part of the existing Downtown ADA Improvement project and authorize an increase in the construction contract contingency by $100,000 to allow the proposed change order to proceed. FINANCIAL IMPACTS The proposed action has no fiscal impact on the existing CIP or operating budgets. The current CIP has sufficient funds included to pay for the recommended change order. This action will allow the work to proceed and the budget to be adjusted without any increase in appropriations. The minor utility repairs associated with the project will be accounted for in appropriate sewer operations and maintenance accounts. ATTACHMENTS 1. Project Plan and Location Map 2 Attachment 1 RESOLUTION APPROVING A CHANGE ORDER TO CONSTRUCT THE WATER STREET COBBLESTONES IMPROVEMENT PROJECT AS PART OF THE DOWNTOWN ADA IMPROVEMENT PROJECT AND AUTHORIZING AN INCREASE IN THE CONTRACT CONTINGENCY FOR THE DOWNTOWN ADA IMPROVEMENT PROJECT BUDGET WHEREAS, it has become necessary to upgrade certain pavement improvements constructed under the Petaluma River Access and Enhancement Plan in the mid -2000's; and WHEREAS, the subject project scope fits within the scope of the existing CIP Project No. C16501602, Downtown ADA Improvements; and WHEREAS, the construction contract for the Downtown ADA Improvements Project was awarded to Coastside Concrete and Construction Inc. by City Council action on February 22, 2016 and is ongoing; and WHEREAS, a proposal of $90,920 was received from Coastside Concrete and Construction Inc. to complete the work as a change order to the contract as attached as Exhibit A; and WHEREAS, it has been determined that the Contractor's proposal is based on their current competitively bid contract item prices and are reasonable for completing this rehabilitation work, and furthermore the work is related in scope and proximity to the originally bid work; and WHEREAS, there are sufficient funds in the Downtown ADA Improvements CIP account to fund the project scope and proposed change order, including any additional cost of project management and design services; and WHEREAS, the Project is categorically exempt pursuant to California Environmental Quality Act ("CEQA") and Title 14, the California Code of Regulations ("CEQA Guidelines"), Section 15302, because the project consists of replacement or reconstruction of existing utility systems and/or facilities involving negligible expansion of capacity. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby: 1. Authorizes the proposed project scope refinement as presented for the CIP project Downtown ADA Improvements -C16501602, for the Water Street Cobblestones Improvement Project. 2. Approves an increase in the construction contract contingency for the contract from $25,000 to $125,000 for completion of the proposed change order. 3 CONTRACT NO. Upon execution by representatives authorized to bind the parties, this Change Order will become a part of the contract. The consideration specified in this Change Order (whether an adjustment of the contract price, an adjustment of time, and/or other consideration) is the full and sole compensation owed to the contractor as a result of the changes and issues described in this Change Order. Such consideration includes, but is not limited to, any and all direct and indirect costs incurred by the contractor as a result of the changes and issues described in this Change Order for any labor, equipment, materials, overhead (additional, extended, field and home office), profit, or time adjustments. By signing this Change Order the contractor waives and releases the owner from any and.all claims for additional compensation concerning any of the changes and issues specified in this Change Order. NOTE: This Change Order is not effective until approved by the Director. To follow is the description of work to be performed, estimate of quantities and prices to be paid, segregated between additional work at contract price, agreed price and force account. Unless otherwise stated, rates for rental of equipment cover only such time as equipment is actually used and no allowance will be made for idle time. Change requested by City of Petaluma. SCOPE OF WORK: This Change order provides for the labor, equipment, and materials for the following work: 1. Remove and replace 2,426 SF of brick pathway and cobbles on Water Street with stamped concrete, 8 inches thick. 2. Remove and replace two (2) ADA curb ramps at the intersection of Washington Street and Water Street. 3. Excavate and backfill under the grade beam of handrail with concrete. 4. Remove and replace 200 SF of concrete, 8 inches thick, adjacent to the railroad tracks and footbridge abutment. The cost of performing the above concrete work will be $60,920. This change order will also provide for the labor, equipment, and materials for the following work: 5. Remove and replace existing brick lined sanitary sewer manhole with new 60" sanitary sewer manhole per City Standards. 6. Remove and replace 25 LF of 6" VCP sanitary sewer with a new 8" PVC (SDR 26). (Existing 6" VCP encased in concrete.) 7. Remove and replace 35 LF of existing 10" VCP sanitary sewer ine with new 10" PVC (SDR 26). Reconnect existing lateral. The cost of performing the above sewer work will be $30,000. The total cost of the Water Street Rehabilitation work will be $90,920.
