April 15, 1946.
Regular meeting of the Council of the City of Petaluma called
to order by Mayor Woodson.
ROLL CALL:
resent: Councilmen Brown, Deiss, King, Myers, Penry, Seidell,
and Mayor Woodson.
READING OF THE JOURNAL:
The minutes of t e last regular meeting of April 1, 1946, were
read and approved as recorded.
REPORTS, .OF OFFICERS:
The of the Librarian for the month of March, 1946,
was read and placed on f ile .-
The Clerk reported the filing of Affidavits of Publication of
Ordinances Nos. 604 and 605 C.S., Official.Notice of Sale, City of
Petaluma Municipal Improvement Bonds of 1945; and Notice to Bidders
re purchase of a mechanical street roller.
REPORTS OF STANDING COMMIT`T'EES:

Tne Finan Ce Committee submitted its report, whereupon
Resolution #5799 C.S.
introduced by Councilman King - seconded by Councilman Seidell, directing
the Auditor to draw warrants Nos. 2394 to 2525 inclusive) against the
various,.C'ity Funds in payment of claims allowed and approved by the
Finance Committee, adopted by 7 affirmative votes.
PETI TIONS_ AND CONjIUNICATIONS :
Preliminary Opinion -amity of Pet. Mun. Impv. Bonds 1945:
Preliminary opinion of Orrick, Dahl :quist, Neff, Brown & Herrington,
bonding attorneys, stating that in their opinion the record of the
ro'ceedings taken by the City of Petaluma relative to the issue of
420. ;000.00 City of Petaluma Municipal Improvement Bonds of 1945,
whow 16WPul authority for said issue under the laws of the State of
California and that said bonds, when executed, sold, and delivered,
will be valid and legally binding obligations of said City of Petaluma,
read and placed on file.
First Baptist Church - protest against granting liquor license
to Selma Boltz:
Letter from Rev. Fred R. Brock, Jr. Pastor of the First Baptist
Church, enclosing a petition signed by 51 members and friends of the
First.Baptist Church of Petaluma in protest against the granting of a
license, renewal or transfer of a license to Selma Boltz to open up
an "off _sale "liquor establishment at 108 Kentucky Street, read and filed.
_._ -The question of the City's proceedure in protesting the granting
of - liquor licenses was raised by Councilman King and the City Attorney
explained the proceedure in such matters, stating that anyone may protest
to the, State Board of Equalization against the granting of any license
but that t'he final decision rests with the-State Board of Equalization.
Library Furnace:
Communication from Mr. Lewis Cromwell, Chairman of the Building
Committee of the Board of Public Library Trustees, stating that the
plans for the new furnace for the library have been approved by the
Library Board and requesting the City Council to also approve the plans
and- call for bids for said improvement, read, filed, and referred. to the
City Attorney for t he,preparation of the necessary papers calling for bids.
Summer Recreation Program:
Request from -the Petaluma Youth Council for a contribution of
$500. to be matched by a similar amount from the Rosenberg Foundation,
to enable the Council to conduct a summer recreation program, read,
filed, and referred to the City Attorney to prepare an ordinance of
appropriation.

Communication from the Roblar Farm Bureau Center opposing
the installation of parking meters in Petaluma, read and filed.
Letters from G. N. Cook, Division of Highways; from Mayor
Woodson to Mr. Sandeiin of the Division of Highways; and from
Clyde Edmondson of the Redwood Empire Association, regarding
the proposed truck route thru Petaluma, .read and filed.
ADOPTION ' OF ORDINANCES:
Ordinance No. 604 C.S. introduced by Councilman Penry,
seconded by Councilman Deiss, entitled, 'AN ORDINANCE OF THE
CITY OF PETALUMA, PROVIDING FOR THE PURCHASE OF A MECHANICAL
STREET ROLLER ,.AND ACCESSORIES THEREFOR FOR THE STREET DEPART-
MENT; ADOPTING THE SPECIFICATIONS FOR SAID MECHANICAL STREET
ROLLER RECOMMENDED BY. THE SUPERINTENDENT OF STREETS; AND
AUTHORIZING THE PURCHASE OF SAID ROLLER FROM THE LOWEST RESPONS-
IBLE BIDDER'', came up regularly and was adopted by 7 affirmative
votes.
Ordinance No. 605 C.S. introduced by Councilman Penry,
seconded by Councilman Dess, entitled, by ORDINANCE OF THE
CI`T'Y OF PE'TALUMA AMENDING, RECLASSIFYING -AND ALTERING THE
COMMERCIAL AND RESIDENTIAL ZONES OF THE CITY BY RECLASSIFYING
AND REZONING CERTAIN PROPERTY FRONTING ON MAGNOLIA, AVENUE
NEAR MAIN STREET FROM, RES.I DEN TIAL TO C ONa,TERC IAL PROPERTY,, AND
FROM r A, .RESIDEN TIAL TO A C OMMERC IAL ZONE, " came up regularly
and was adopted by 7 affirmative votes.
NEW BUSINESS:
Opening of bids street roller;
This being the time set for opening bids for -a mechanical
street roller for the Street Department, the Clerk reported
having received two bids and proceeded to open and read said
bids, one from Edward-R. Bacon Company for the slam of $172,0.00,
and the other from Bicker - Williams 'Co. for the sum of 01883.00.
. . The bids were considered by the Street Committee, who
recommended the acceptance of the low' bid of Edward R. Bacon
Company, whereupon

.introduced by Councilman Penny, seconded by Councilman Seidell,
accepting the offer of Edward R. Bacon Co., adopted by 7
affirmative votes. ,
Transfer of funds: -
Resolution, #5801 C.S.
introduced by Brown, seconded:by Councilman King,
transferring the balance, of $60.02 remaining: in the° Hospitality
House , Contribution Fund to ,the General Fund, adopted by 7 affirm
- altive votes.
Resolution #5802 C.S.
introduced by Councilman King, seconded by Councilman Brown,
closing out the Civilian Defense Fund by transferring the, balance
Of $385.64 from said Civilian Defense Fund to the General Fund,,
adopted by 7 affirmative votes. ,
Victory-Heights Subdivision:.
The- request of C A. Miller that the City Council approve th_ e
lot design of Victory Heights Subdivision was referred to the
City Planning Commission for recommendation following the suggest-
ion of the City Attorney who questioned whether or not the large
area in, the center 'of the subdivision is provided with -an adequate
means of egress and ingress.
Request that City call election for Freeholders:
Mr. C.- W. Carpenter, Chairman of the ,Charter Committee of
the Breakfast Forum, addressed the Council stating that for several
weeks his Committee has been discussing the starting of work
necessary to provide the City of Petaluma with a .new* Charter
and that it is the unanimous opinion of the group that the present
City Charter is out of date. ,.
He stated that they wished the City Council to take the
necessary steps to place the matter of electing freeholders on
the ballot of the June County election, thui3 eliminating the

necessity of the Committee circulating initiative petitions,
verifying signatures of petitioners, etc.
The matter was discussed and taken under consideration.
Oak Hill Cemetery:
City Attorney Karl Brooks reported that he had ' been
continuing his study of the status of the Oak Hill Cemetery;
'that as far as he could learn there had never, been any specific
dedication of the property to the City by any individual; that
it was known as a public cemetery as far back as 1868; that it
was determined,to discontinue its future use as a public cemetery
in 1879 when-the Council adopted an ordinance prohibiting the
future use of said area as a - cemetery, except for those who had.
actually purchased burial lots therein; that in 1900 the Council
passed two ordinances that provided for the removal of bodies
within six months and then, extended -the privilege two months;
that* -in order to clear the title to the property. it is quite
probable that some showing will have to be made of what disposition
has been made of the bodies therein; that up to the present time
he . had been unable to find any records pertaining to the plot
of the cemetery.
He further stated that a thorough search of the old
records now storeddin the American Trust Co. would involve a
great `deal. of work and asked if the Council wished to proceed
With this matter.
It_. was the expression of Councilman King and ' Councilman
Seidell'that every effort should be made by•the City to clear the
title to this property.
r. Madison.Square:
Mr. Geo. C. Goheen presented the final map of the re-
z; subdivision of Block 34,-.'known as Madison Square and asked the
City Council to approve the same. The matter was referred to
the - Ci.ty Attorney and to the Auditor and City Engineer whose
signatures are required on the map, after which the-City Council
will'act`on the request of Mr. Goheen.
City Attorney Karl Brooks reported.that he had been,
studying the application to the State of California for financial
aid'for plans and specifications on the City's post -war projects
and that it required considerable data from the architect before
the same could be filed.- He also stated-that it may be necessary
to submit to the State in connection with the application a sketch
showing ,the surrounding area and adjacent streets, which would
necessitate the selection of the site for the buildings before
the application could be filed..
Mr. Bradley Spencer of the M. H. Rbodez Co. gave a
:demonstration of The Perfection Parking Meter, and outlined the
contract which his company could offer the City. No action taken.
'ADJOURNMENT
ere being no further, business to come before the meeting,
the meeting.was adjourned to Monday, April 22nd, 1946, at 7 :30 P.M.
