ROLL CALL: Present: Councilmen Deiss, Minogue; Myers, Seidell, Shoemaker, and -Mayor Woodson. Absent: Councilman King. READING OF CALL: e °C erk read the Notice of Special Meeting of the City Council; the consent -of the members of the Council to the holding of said meeting; and the Affidavit of rya ling of Notices of .said special meeting. Recommendation of Health "Officer that proceedings for construction of sewers and - sewage disposal in Cherry Valley area be commenced immediately. Letter from Dr. " John J. Mohrman, City Health Officer, stating that after due investigation he has determined that the sewage disposal system by means of cesspools and septic tanks now in use in the Cherry Valley area is inadequate, unsanitary, and a menace to the health of-­the residents of that area, and recommending immediate commencement of proceedings for the con- struction of sewers and sewage works as a necessary health measure;: and filed. Plans' &' spec. for "Cherry Valley" .Sewer Dist, filed 9/27/48. The City Clerk reported the filing on September 27, 1948, of plans and specifications for.the Cherry Valley Sewer District, whereupon Resolution #204 N..C.S. introduced by Councilman Shoemaker,-seconded by Councilman Deiss, entitled, "Resolution adopting plans and specifications for sewer system improvement." adopted by 6 affirmative votes, 1 absentee. Easements for sewer system filed with City Clerk: Five easements covering rights way for system over properties referred to and described in the plans and specifications were reported filed with the City Clerk; also it was reported by City Attorney Brooks that an Agreement has been executed by L. ,Solari and wife with the City of Petaluma granting an easement and right -of -way across their property; agreeing to construct a sewer line across thdrproperty according to the plans and specificat- ions adopted by the City; and the further agreement that the City of Petaluma will pay the sum of $200. to said L. Solari and wife upon the completion of the work and execution of the grant, whereupon Resolution -#205 N.C.S. introduced by Councilman Myers; seconded by Councilman Minogue, entitled, t ° Resolution accepting Grants of Easements and authorizing Agreement between Lorenzo Solari and Mary, Solari, his wife, and the City of Petaluma pertaining to the Cherry Valley Sewer District."_, adopted by 6 affirmative votes, 1 absentee. Waiving. proceedings under Special Assess. Limitation & Majority Protest ikct : The City Attorney stated that because of t e Certificate furnished by the Health Officer that this work is7necessary improvement for sewage purposes under the improvement act of 1911 it is not necessary to comply with the Special Assessment Investigation Limitation and Majority Protest Act of 1931, whereupon W. 2 . 5"2 Resolution J206 N.C.S. introduc,ed.by Councilman Shoemaker, seconded by Councilman. Deiss, entit led, "Resolution finding construction of Cherry Valley Sewer to b.e a necessary health measure and waiving proceedirigs'under the Special Assessment Investiga- tion,, Limitation and Majority.Protes Act." adopted by 6 affirmative votes, 1 absentee. Resolutioh of I-ntention-tO commence proceedings: ,Resolution #207 N.C-*S* introduced by Councilman Myers, seconded by Councilman Minogue entitled., 1 AResolution of Intention to commence proceedings under the Improvement.Ac.t of 1911 to.construct Sewag6_Disposal Facilities, create a special assessment district and charge the cost thereof against property within said district in the area described in plans and specifications for Cher* Valley Sewer District file with the City Clerk, City.of Petaluma, and to issue bonds under the imprQvement bond 'act of 1915.1! adopted by 6 affirmative.votes, 1 absentee.
