Regular meeting of the Council of the City of Petaluma called to order by Nfdyor,.Woodson., ROLL CALL; Present: Councilmen Mayor Woodson,. Absent: Councilman READING OF JOURNAL.: Deiss, King, Minogue, Myers, Shoemaker, and Seidell. The minutes of the'last regular meeting,.of January 3rd, 1949, were read and approved as recorded. PETITIONS, COM. & PUBLIC HEARINGS: Annual report of the examination the books of the City of Petaluma by Knowlton & Barr, C.P._A. was submitted and filed. Mayor Woodson urged that each member of the Council review the report. Applications of Mrs. F. B. Ternes and - C. W. Gregg for permits to connect property at D and Sunnyslope Ave. with the city sewer system, read and filed, whereupon Resolutions #273 and-274 N.C.S. introduced by Councilman King, seconded by Councilman Deiss, granting said applications providing the work be done in accordance with the Uniform Plumbing,Code, 1947-edition, and that vitrified clay pipe With asphaltic joints ' or cast, iron-pipe with'hot lead joints be used in said installations, adopted by 6 affirmative votes, 1 absentee. Announcement of the First California Institute on Street and Highway problems, to be held at the University of California, Jan. 31, Feb: 1 and 2, read and filed. It was the opinion of the Council that the Director of Public Works should attend said conference. Request that City acgmire'.McKinley School for Recreational Center. Petition containing 291'signatures was submitted by the McKinley Parent and Teachers Assn. It asked that the City of Petaluma acquire the property at the corner of East Washington and vallejo Sts.,now occupied by McKinley'School, for a community recreational center. T -he matter° was taken under consideration by - the Counccil, many of whom expressed themselves as in favor of the plan. Applications of S. S. Peck and Otto K. Meyer for building permits were referred to the Planning Commission for recommendation. Letter from Carl R. Wallin requesting that the Council withhold action on his application for a building permit for Weller Hopkins apartment until he has had an opportunity discuss the matter of maximum area for each unit with the Planning Commission read and filed. Re­Livestock` Ord: Communication from Councilman Leigh S. Shoemaker, Chairman of the Cohimitt,ee appointed to consider the petitions recently filed regard- ing , the regulation of livestock, stating that the ordinance to be submitted for introduction is the result of considerable research on the part of the committee, City Attorney,-and representative citizens;_ that the ordinance incorporates the best ideas of ordinances of other cities and the State Code; that consideration has been given to °the fact that Petaluma is built around the poultry,industry; that the ordinance has been written as simply as possible, and that the CO=ittoe feels that the ordinance will be fair and equitable to the eatest number of persons. Read and filed. Said proposed ordinance was offered for introduction by Councilman 'Shoemaker, seconded.by Councilman -Deiss, and withdrawn for revisionx at the suggestion of Councilman Shoemaker, after a lengthy protest was voiced by Attorney LeRoy Lounibos on behalf of a group of citizens, who stated that the ordinance' would result in the. o actual elimination of all ,poultry and livestock from the City of'Petaluma; would place an arbitrary authority in the hands of the Health Officer and Chief of Police, and would deprive people who depend upon cows•an d chickens for 9 4 j their economy to dispose "of same. .Councilman. Shoemaker pointed out that there is very definite need for regulatio n suggested that after the measure has been that it be included in propositions to be city election in June. REPORTS OF CITY MGR: Claims approved by the City Manager were submitted, whereupon Resolution #275.N.C.S. introduced by Councilman Deiss, seconded by ',Q,ouncilman `Shoemaker, approv said claims (Nos. 1956 to 2012 inclusive), adopted by 6 affirmative votes, 1 absentee. Assignment of Personnel under dates of 4 and 11 Jan. 1949, read and filed. REPORTS OF CITY OFFICIALS : Monthly reports'of the Auditor and the Librarian, read and. filed. Re - Deedir,&, of Kenilworth Park to 4th Dist. Fair: Opinion of. the Ci ty Attorney regarding the power of the City of Petaluma to .convey valid legal 'title to Kenilworth Park, read and filed. He ruled that said question would have to.be submitted to the'electors of the City and receive a two - thirds majority.vote before such'action could be taken. Magnolia Ave. drainage problem: Th.e.City Attorney reported having received word f rom the County Surveyor to the effect that the County had done everything .possible to assist stirs. Potter in the drainage,problem on Magnolia "Avenue and cannot further assi her. .Letter.from J. A. Thayer, Recreation Director, on the subject of °City Sponsored Rev - Producing Programs, together with a Financial report on'the.Ghost Basketball Game held Jaz.. 12, 194.9 showing a' n,et profit to the General Fund of $175.12', read and filed. Recommendations from City Planning Com: Recommendations .f "rom the City 'Planiling Corrimission on the following applications for building permits, readnand filed: Petaluma City High School Dist.; K. Colin; Carl R. 'Ivallin; (Weller- Hopkins Co, Owner. ) James A.MeFarland (Peter Drees, Owner.) whereupon Resolutions #276,; 277; and 278 N.C. 'S. granting said applications in accordance with the recornnendations of the Planning Commission, adopted by 6 affirmative votes', 1 absentee. Action on the application. of Carl R. 'Wallin was held in abeyance. ADOPTION OF ORDINANCES: Assessment & tax collection by county: : Ord. 76 N.C.`S." introduced by Councilman Shoemaker, seconded by Councilman Seidell, entitled: �. AN ORDINANCE TO PROVIDE FOR THE ASSESSN TT OF PROPERTY FOR THE IvMf ICI - TAXES OF THE CITY OF PETALUMA, AND FOR THE EQUALIZATION AND CORRECTION OF SUCH. ASSESSMENT BY CERTAIN COUINTTY OF 5ONbMAA OFFICERS, FOR T --HE COLLECTION ANT .D ElTFORCE- +1 T OF THE PAYMENT OF SUCH TAXES; INCLUDING' .DELI�I UENT TA)ES, 'BY SUCH. City Mgr. to employ Sanitary Engineers: Ord. 77 N.C.S. introduced by Councilman Minogue, seconded by Councilman Deiss, entitled: "AN. ORDINANCE AUTHORIZING THE CITY MANAGER TO EMPLOY SANITARY ENGINEERS FOR THE PURPOSE OF INVESTIGATING THE PROBLEM OF INCREASING THE 'SEWAGE DISPOSAL FACILITIES OF PETALUMA ACID FILING REPORTS AND RECOIMNDATIONS WITH THE CITY COUNCIL." came up regularly and was adopted by 5 affirmative votes, 1 negative vote, and 1 absentee. CONSIDERATION OF UNFINISHED BUSINES'S : . The request of the City Attorney for an increase in salary was discussed briefly and action thereon deferred until the meeting of Jan. 20. The matter of adopting rules of order for the Council was brought up by Councilmaninogue who stated that he believed the Council should give serious thought to reviewing the rules proposed by the City Manager.
