SUBJECT: Public Hearing on Setting Citywide Maximum Refuse and Recycling Rates and
Adoption of a Resolution Setting Maximum Refuse and Recycling Rates that May
Be Imposed by Recology Sonoma Marin as Franchisee under the City's Franchise
Agreement for Collection of Solid Waste, Recyclable Materials and Yard
Trimmings.
RECOMMENDATION
It is recommended that the City Council receive the proposed Maximum Refuse and Recycling
Rates, and conduct a Public Hearing on setting of the Maximum Rates. Following the conclusion
of the Public Hearing, it is recommended that the City Council adopt the attached Resolution
Setting Maximum Refuse and Recycling Rates that May Be Imposed by Recology Sonoma
Marin as Franchisee under the City's Franchise Agreement for Collection of Solid Waste,
Recyclable Materials and Yard Trimmings.
BACKGROUND
On December 18, 2017, the City Council adopted Ordinance number 2636 N.C.S. and
conditionally approved the transfer of the Franchise Agreement for Solid Waste, Recyclable
Materials and Yard Trimming Services from Petaluma Refuse and Recycling, Inc. (PR&R) to
Recology Sonoma Marin (Recology). The Franchise Agreement requires Recology to provide
services in a professional manner; and comply with the terms of the Franchise Agreement and
the City's operational expectations. The fees charged by Recology are currently the same as
charged by PR&R since July 2017. The proposed action, following the public hearing, would
increase refuse rates by approximately 4.22% on July 1, 2018.
The existing maximum rates for refuse and recycling, including the method of annual
adjustments due to inflationary forces, were approved on February 6, 2013 by Ordinance number
2448 N.C.S., as part of the Franchise Agreement between the City and PR&R. Section 9.2.1 of
the Franchise Agreement requires the contractor to bill all customers at rates not to exceed City -
Approved Maximum Service Rates. As per Section 10 of the Franchise Agreement, every July
the City -Approved Maximum Service Rates shall be adjusted by the Refuse Rate Index (RRI).
The RRI, which is based on the change in the indices or costs from each calendar year, is
composed of the weighted percentage change for all RRI listed component costs, including those
for Disposal, Organic Waste Processing, Fuel, Labor, and Other Operating Expenses. The
Franchise Agreement was amendment by Council on December 18, 2017 to add a Trash Capture
Component to the franchise fees that may be collected by the franchisee in return for the refuse
and recycling services provided to Petaluma residents and business owners. For example, the
RRI adjustment for the maximum refuse and recycle rates Recology may impose beginning on
July 1, 2018 would be based on the percentage change of the RRI components from December
31, 2016 to December 31, 2017 and includes the first year of the trash capture costs. The
amendment allows Recology to recover changes in trash capture costs in future RRI adjustments.
Recology must notify the City by March 1 of the changes in the rates to allow review and
verification before becoming effective on July 1 each year. Most of the proposed rates for FY
18/19 are included in Attachment 2. The remaining fees for less frequently used services can be

A Public Notice for the proposed new Maximum Refuse and Recycling Rates that Recology may
charge under the Franchise, and a public hearing on the rates, included as Attachment 2, was sent
to property owners and utility customers on March 21, 2018. As of April 30, 2018, three (3)
written protests had been received. A full accounting of all the written protests shall be presented
at the May 7, 2018 Public Hearing.
DISCUSSION
Public noticing of the proposed rates was mailed 45 days or more prior to the public hearing
scheduled on May 7, 2018 in accordance with Proposition 218 requirements for a protest voting
procedure. All customers were invited to review the details of the new proposed maximum rates
and annual maximum rate adjustment on line at the City's website and to lodge a protest vote on
or before the conclusion of the public hearing with the City Clerk. The Council may approve the
proposed maximum rates unless it receives protest votes from a majority of the properties
receiving solid waste services under the franchise
Maximum refuse and recycling rates are adjusted annually based on the RRI comprised of the
weighted percentage change for the following: Trash Capture Costs, Disposal Fees, Organic
Waste Processing Fees, and annual changes for the Consumer Price indices related expenses for:
labor, fuel, vehicle replacement, vehicle maintenance, and all other items. The calculation of the
RRI is defined by the Franchise Agreement and Amendments and has generally ranged from 3 to
3.5% for the past 4 years. Except for the RRI adjustments, rates for refuse and recycling services
are capped until June 30, 2020. Recology may request a Detailed Rate Review every three years
beginning on November 1, 2019. If Detailed Rate Reviews fail to justify a rate change, the rates
will not be increased except as allowed by the RRI method for the duration of the franchise
agreement, until 2028.
Cost of compliance with the Trash Capture Program as required by the State Phase II MS4
(municipal separate storm sewer systems) permit is a property -related cost of providing refuse
services for the community as documented in the aforementioned Ordinance 2636 N.C.S.
Therefore, such costs are eligible for recovery through the refuse and recycling fee structure
including increased costs addressed by the annual refuse rate adjustment process outlined in the
Franchise Agreement. The Franchise Assignment Agreement and the related Franchise

Agreement Amendment incorporated the trash capture costs into the maximum rate structure and
included changes to the annual RRI adjustment process. Adding Trash Capture Program costs to
maximum refuse rates will have a small impact on overall rates. The estimated trash capture
costs of $278,991 are detailed in Attachment 3. Beginning on July 1, Petaluma residents with a
20 -gallon container, currently paying $9.75 per month for the service, could see up to a 1.95 %
increase of 19 cents per month on their rates, related to the Trash Capture fee. Other users could
see up to the same percentage increase in their rates. The overall RRI analysis for 2018,
including the new maximum trash capture costs, is projected to be 4.22%. The RRI calculation
for 2018 is included as Attachment 4. Attachment 2 includes a comparison of City refuse rates
with averages in this and neighboring counties.
The proposed maximum refuse and recycling rates will support continued protection of public
health and the environment, through the efficient removal of trash, recycling, and compost, and
will provide funding to eliminate trash from entering Petaluma's waterways through the storm
drains, while meeting the State of California Small Municipal Separate Storm Sewer System
(MS4) Program requirements. It is recommended that the Council approve the proposed
maximum rate resolution for implementation in July 2018. Recology will be responsible for
notifying customers of any changes in customer rates up to the maximum rates set by the City
Council.
FINANCIAL IMPACTS
As proposed, the City would receive proceeds from Trash Capture Costs of up to $178,991
during FY 18/19. In addition, City franchise fees overall are anticipated to increase by 4.2%.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA
ADOPTING MAXIMUM REFUSE AND RECYCLING RATES
FOR FISCAL YEARS 2019 THROUGH 2024 PURSUANT TO THE FRANCHISE
AGREEMENT BETWEEN THE CITY OF PETALUMA AND RECOLOGY SONOMA
MARIN FOR SOLID WASTE, RECYCLABLE MATERIALS AND YARD
TRIMMMINGS SERVICES
WHEREAS, Section 8.16.040 of Title 8 of the Petaluma Municipal Code (PMC)
provides that the City Council may provide for the collection and disposal of garbage and
rubbish in and from the city by its own officers and employees, or by an official garbage
collector pursuant to a contract therefore, or by or for the person accumulating the garbage or
rubbish in the city, pursuant to a permit granted by the Council; and
WHEREAS, the City of Petaluma has, pursuant to Ordinance no. 2636 N.C.S. adopted
December 18, 2017 assigned the City's Franchise Agreement for Solid Waste, Recyclable
Materials and Yard Trimmings Services ("Franchise Agreement") to Recology Sonoma Marin
for the collection of solid waste, recycling, and compost materials; and
WHEREAS, in adopting Ordinance 2636 N.C.S. the City Council determined that trash
capture costs under the City's MS4 permit program to be a property related cost of providing
refuse services in the City that is properly recovered through refuse and recycling rates; and
WHEREAS, in accordance with Section 9.2.1 of the Franchise Agreement, the City shall
establish the maximum rates and fees that the franchisee may charges customers for collection
services pursuant to the franchise; and
WHEREAS, in accordance with Section 10.2 of the Franchise Agreement, the franchisee
shall receive annual adjustments to the City -Approved maximum service rates through RRI
adjustments; and
WHEREAS, the City retained R3 Consultants to develop and review a revised Refuse
Rate Index calculation to assist in setting maximum Refuse and Recycling Rates that include the
Trash Capture Fee; and
WHEREAS, notice of a public hearing on the proposed revised maximum Refuse and
Recycling Rates and change in the RRI was mailed to Recology Sonoma Marin customers and
record owners of properties that would be impacted by the proposed increases on March 21,
2018, 45 days or more before the requisite public hearing in accordance with Proposition 218
requirements; and

WHEREAS, pursuant to Proposition 218, the City has duly noticed and held a public
hearing on the proposed maximum rate increases May 7, 2018 with respect to the maximum rates
for fiscal years 2019 through 2024; and
WHEREAS, at the public hearing on the proposed maximum rate increases on May 7,
2018, the City Council received testimony and considered all evidence ("the Record") presented
regarding the proposed maximum rate increase, including all protests received, and canvassed
and tabulated the protests received prior to the close of the public hearing; and
WHEREAS, the trash capture program cost estimates and RRI calculation resulting from
the R3 consultants rate review are contained in Attachments 3 and 4 to the staff report
accompanying this resolution which are hereby made a part of this resolution; and
WHEREAS, after due consideration, the City Council finds based on Attachments 3 and
4 and the Record that:
(1) The proposed maximum rates as set forth in Exhibit A to this resolution which is made a part
hereof and the RRI as presented in Attachment 4 are necessary to achieve full recovery of the
costs of providing solid waste services to residents and businesses in Petaluma;
(2) The proposed maximum rates and RRI as presented herein will not generate revenue in
excess of the cost of providing solid waste services;
(3) The proposed maximum rates and RRI as presented herein will not be used for purposes
other than providing solid waste services;
(4) The proposed maximum rates and RRI , to the extent the City's solid waste franchisee may
impose them on any parcel or person as an incident of property ownership shall not exceed
the proportional cost of the service attributable to the parcel or person;
(5) Proper notice of the proposed maximum rates and RRI was given to record owners of
properties that could be impacted by the proposed maximum rate increases and to recipients
of City solid waste services, as prescribed by law; and
WHEREAS, a majority protest was not received before the close of the public hearing,
as confirmed by the City Clerk's announcement of the canvass of protests received which totaled
three (3) protest votes received for the same number of parcels out of a total of 20,708 parcels
served; and
WHEREAS, the proposed maximum rates and RRI are not a "tax" as defined in Section
1, paragraph (e) of Article XIII C of the California Constitution ("Proposition 26") because such
rates are imposed for a specific benefit conferred or privilege granted directly to the payor that is
not provided to those not charged, and which does not exceed the reasonable cost to the local
government of providing the service or product; and/or such fees and charges are imposed for a
specific government service or product provided directly to the payor that is not provided to

those not charged, and which does not exceed the reasonable cost to the local government of
providing the service or product; and/or such fees and charges are imposed for the reasonable
regulatory costs to a local government for issuing licenses and permits, performing
investigations, inspections and audits, enforcing agricultural marketing orders and the
administrative enforcement and adjudication thereof, and/or such fees and charges are imposed
as a condition of property development; and
WHEREAS, adoption of the maximum rates and RRI pursuant to this resolution involves the
establishment, modification, restructuring or approval of rates and charges, as identified Exhibit
A and Attachments 3 and 4, and therefore, adoption of this resolution setting maximum refuse
and recycling rates and RRI is not a project under the California Environmental Quality Act
pursuant to California Public Resources Code Section 21080(b)(8)(D) and 14 Cal. Code Regs.
Section 15273;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Petaluma as
follows:
1. The above recitals are hereby declared to be true and correct and incorporated herein as
findings of the City Council.
2. Having considered the foregoing and good cause appearing therefore, the City Council
hereby approves of the maximum rates as set forth in Exhibit A for the collection,
processing, and disposal of solid waste, recycling, and composting materials for
commercial, multifamily, and single family customers, that Recology Sonoma Marin, the
City of Petaluma franchisee may charge for solid waste services for within the City of
Petaluma for fiscal years 2019 through 2024 and for supplemental services pursuant to
the franchise agreement between the City and Recology Sonoma Marin.
3. Having considered the foregoing and good cause appearing therefore, the City Council
hereby approves of the estimated trash capture costs set forth in Attachment 3 and the
RRI as set forth in Attachment 4 for adjusting the maximum rates set forth in Exhibit A
concerning the maximum rates that Recology Sonoma Marin, the City of Petaluma
franchisee may charge for solid waste services within the City of Petaluma for fiscal
years 2019 through 2024 and for supplemental services pursuant to the franchise
agreement between the City and Recology Sonoma Marin.
4. If any section, subsection, sentence, clause, phrase or word of this resolution is for
any reason held to be unconstitutional, unlawful or otherwise invalid by a court of
competent jurisdiction or preempted by state or federal legislation, such decision
or legislation shall not affect the validity of the remaining portions of this
resolution. The City Council hereby declares that it would have passed and
adopted this resolution and each and all provisions thereof irrespective of the fact
that any one or more of said provisions be declared unconstitutional, unlawful or
otherwise invalid.

NOTICE OF INTENT to Increase Maximum Allowable Charges for Solid Waste Services
' in the City of Petaluma for 2018 and Notice of Public Hearing
The City Council of the City of Petaluma hereby gives public notice of its intent to increase the maximum allowable rates for customers
within the City of Petaluma for the collection, processing, and disposal of landfilled waste, recyclable, and organic materials. Subject to
the maximum allowable rates set by the City, the City's exclusive refuse and recycling franchisee, Recology, may charge rates to
Petaluma customers to cover the cost of operating franchise programs effectively in accordance with all State and Local Regulations. The
City sets limits to the maximum allowable charge that Recology can charge customers within the City's service area for the garbage,
recycling, and organics collection services that they provide under an exclusive franchise agreement with the City. Recology sets the
actual rates for their collection services and can charge up to the maximum allowable rate established by the City Council. The charged
rate can be can be lower than the maximum allowable rate, depending on the cost of providing collection service to the City of Petaluma;
however, it cannot be any higher. As the operating costs increase, the maximum allowable rates also increase to assure that revenues for
these services can cover the costs of operation at the standards of services defined in the franchise agreement. The process for annual
maximum rate adjustments using a refuse rate index is addressed below and defined in detail in the franchise agreement. A partial rate

The City Council will consider these maximum rate increases at a public hearing on May 7, 2018 at 7:00 p.m. at:

If approved, these maximum rate increases will be effective on July 11 of each year from 2018 to 2023. Any interested person may
present verbal or written input to the City Council regarding the proposed action to approve maximum rate increases. See the bottom of
the reverse side of this notice for details on how to submit a formal response or protest. If written protests are presented regarding a
majority of properties receiving City refuse and recycling services prior to the close of the public hearing, the City Council will not
increase the maximum rates, as a matter of law.
Solid Waste Collection, Processing and Disposal Monthly Maximum Service Rates
Please note that the current Collection Rates set under the City's refuse and recycling franchise, for both Residential and Commercial
customers, will remain in effect until June 30th, 2018. Complete rate sheets and a detailed listing of the new maximum proposed monthly
base rates, including all rates for multi -family residential and commercial customers for each year and all supplemental services can be

Single-Familv Residential
Table 1 shows the proposed maximum monthly rates for single-family residential customers for each year by cart size.
The base monthly rates include the following solid waste services:
■ Weekly pick-up of Garbage, Recyclables, and Organic Material.
■ Residential Recycling program (blue cart) for items such as clean glass, clean metal cans, clean aluminum, clean cartons, clean
paper and cardboard, small scrap metal, and clean plastics.
■ Residential Organics program (green cart) for items such as meat, cheese, fruits and vegetables, and food soiled paper
products, such as pizza boxes, paper drink cups, paper plates, and paper napkins.

Commercial and Multi-Familv Residential
The Table 2 shows the proposed maximum monthly rates for commercial and multi -family residential customers for 2018 by container
size for once weekly collection of landfilled, recyclable, and compostable materials. The base rates for these services are determined not
only by the type of service, but also the service frequency.

Petaluma Maximum Collection Rates
The City of Petaluma customers pay much less than customers in most of the surrounding Counties. With the exception of the 90-96
Gallon Commercial Collection Cart, Petaluma Commercial customers also pay a lower rate than the surrounding counties. Within our
home county of Sonoma, Petaluma customers, both residential and commercial pay some of the lowest rates, while receiving similar
levels of collection service.

How Maximum Rates Are Calculated
The City annually adjusts maximum Waste, Recycling, and Organic Collection rates that the City's refuse and recycling franchisee can
charge to Residential and Commercial Businesses using a Refuse Rate Index (RRI) method, as described in the Franchise Agreement, it is
the sum of percentage changes of all eight RRI indices defined in the franchise agreement. The eight operating costs categories, each
with an index, are: Labor, Fuel, Vehicle Replacement, Maintenance, Disposal Fee, Organic Processing Fee, Trash Capture Fee, and All
Other. Indices are based on US Department of Labor or other standardized inflation indices, changes in actual operating cost for a
specific category, or increases in the rates charged to Recology by the landfill and recycling companies that take the waste materials. A
trash capture fee of approximately $179,000 was included in the 2018 RRI adjustment. Each index is weighted by the categories
percentage of the overall operating cost. The calculated percent change for all eight indices are added together and the total percentage
change is used to calculate the maximum waste, recycling, and organic collection rates for the next year. It should be noted that
Recology's financial records are reviewed annually and are considered when determining potential increases to the customer's maximum
collection service rates. In accordance with Section 53756 of the Government Code, the City will adjust the maximum refuse and
recycling rates automatically each year using the RRI method effective each July 151 for a 5 -year period starting July 1, 2018.
What Does This Mean Moving Forward?
Although it is difficult to determine the exact cost of operating, collection, disposing and recycling the City's waste in future years, it is
anticipated that rates will continue to increase with inflation. Additionally, there are newly enacted state laws that focus on recycling,
organic diversion, climate change, and greenhouse gas reduction that are increasing the cost of refuse and recycling operations. It is the
City's intention to keep Petaluma customer's rates low while ensuring Recology is receiving appropriate compensation to operate safely,

submitted in writing and must:
a) Identify the affected property or properties, such as by address, Assessor's Parcel Number, or customer account number;
