C the Council of the City of Petaluma called to who stated that the meeting was for the purpose of the washing down or crumbling of the T Streets, in the rear of the property of Farrel_ ROLL CALL: resents Councilmen De.iss, G'ervasoni, Ingerson, Myers, Penry, Woodson, and Mayor McFadden. City Attorney Brooks was asked,h s opinion of the duties or res.ponsib- ilites of the .City in the matter. He 'stated that the Superintendent of 8 S treets had reported the slide to him on Monday morning and that the Supt. of Streets - further reported that'he had been requested by Farrell Bros. to remove - the dirt which had fallen on their property as a result of the , slide. The Supt. of Streets also reported , that the removal of the said. earth has - been questioned.:by a property .owner. The City Attorney stated that in the time-in which `he had had to make an investigation of the matter, he had learned that while the alley appears on m ps as property of the ,•City of Petaluma, it has never been used as an, acAtual. roadway for vehicles, having only'been used occasionally as a footpath. H6 s,tated that he felt that the city was under no responsibility or obligation to do" anything with the property itself. He stated further that if the remov of the ground by the City -at this time, should weaken the wall and v taus fur "ther crumbling or sliding that there 'would then be the possibility of a responsibility on the part of' the City. Mayor McFadden asked if it would be possible for the City to enter into an agreement with Farrell Bros. to the effect that if the City would remove the dirt at this- time, that the City would be absolved frorm'all future liability. The Attorney stated that - such an agreement would be possible but' that it would not relieve the City of' responsibility of damage to the property of Mrs. H. H. Iiinor, in the event of future slides. Attorney Leroy Lounibos,, representing Farrell Bros. addressed the Council and stated, that although he had not had time to study the case thoroughly, it was his opin on 'tha't there was a strong probability of 1'irability on the part of the City for the damage caused by the said slide. After a discussion of the matter it was left in the hands of the City Attorney - he to confer with Attorney Lounibos and see what can be done in the matter within the;righ:ts of the City. 'In order to expedite the matter he was authorized_ to notify the 'Supt. of, Streets directly of what action to -take . ADJOURNMENT .1 On motion regularly made and carried the meeting adjourned. REPORTS OF STANDING COMMITTEES: The',Finance Committee submitted, its report, whereupon Resolution /4474• C.S. introduced by Councilman VVo.odson, seconded by Councilman Gervasonl, directing the Auditor to draw warrants (Nos. 1973 to 2082 inclusive) against the various City Funds in payment of claims allowed and. approved by the Finance adopted by 6 affirmative votes, 1. absentee.. PETITIONS AND COMMUNICATIONS: ommunicationsfrom Mrs. Isabel S. Minor and Attorney John Lounibas, representing Farrell Bros., regarding the recent slide in the rear of the property of Farrell-Bros. read, filed, and referred to the City Attorney. Copy of a letter written by City Attorney Brooks in repl to the communication of Mrs. Isabel S. Minor, read and filed, Notice of an Intercounty Highway Conference to be held in Ukiah on March 13th, read and filed. Communication from the Division- Highways regarding the con- tinuation of the widening of Main Street, the amount of funds. available for the work, etc. read and filed. NEW BUS_ INESS: The matter o.f the,purchase of a clock for the office of Police Judges Ti?Lardis was. brought up by Councilman Dei;ss, and referred to the Buildings and Grounds Committee with power to act. UN_FINISH_ED BUSINESS: Washington St. ridge Tenderts cabin: Councilman Penry, Chairman of the Street Committee., recommended that the matter of constructing a.cabin for the tender of the Washington St. Bridge be dropped for the'present -. Recommendation accepted. ,Zon ng, AAap Councilm dyers reported that the. zoning maps will b,e completed and ready for presentation to the Council at its next regular meeting. Continuation of wor.lc of widening .Main St. to North 'City Limits: A 'discussion was had of the a:dVis6abi of resurning the i ork � of� widening Main Street at this time to the Korth. :. -gity Limits, -and it was agreed that this should be started.at onct Mayor McFadden reviewed the estimates of the cost. ,of the work ,as submitted by City Engineer Gonzalez entire amount to "'the TTorth City Limits, totaling about "$16,700.00. The drainage of Bridge St. as'a WPA project also was discussed and the City Engineer was instructed to present 'plans for, this part of'the work at the next regular meeting of the Council. The suggestion of Councilman Woodson that the property owners along the 'line of the improvement. be at, of the contemplated commencement of the =work was referred to the City Engineer, Mayor IS 6Vadd'en brought up the question of the appointment of a foreman for the work and it was decided to leave this matter in the _ ii hands of'the City Engineer. .City Engineer Gonzalez explained the plan for the modification of the wall to be built in the Coulson property,, and the reduction of the cost of said wall from °$,100.0..00 to $500.00, said sum of $, 500.00 being ample to construct a wa'll,of sufficient strength. This matter was left.entirely to the City Engineer. The matter of e;stablish:ng a suitable wage scale for the project was left to the -City Engineer and Street Committee. The City Engineer was instructed to proaeedas rapidly, as possible with the work, under the supervision of the Street Committee. '.The Clerk was directed to officially notify the Pacific C7as & Elec. `C:o. of the. commencement of the work,. Prgjec't Statement No. 3 was reviewed, Resolution #4475 C.S. introduced by Councilman Woodson, seconded by Councilman Gervasoni, directing that Project Statement No. 3, providing for the widening of Main St, from the North side o,f IV,ashington St. to the northern boundary of the City, and other constructive work specified in said project statement #3, .b.e submitted to the Director of Public Works; and further authorizing the TJR-yor•to sign and affix the official seal. of the City to, any contract,, agreement or memorandum of agreement betvieen the City and the Department• of Public Works relating to or t.o be made pursuant to said Project'Statement #3, adopted by 6 affirm- ative votes, 1 absentee.
