Special me.eRting of the, Council of the City of Petaluma called to order, by Mayor Woodson, ROLL CALLt ,resent: Councilmen Deiss, Gervasoni, Penry, Peters, and Mayor 'Woodson. Absent: Councilmen Ingerson and Myers. READING IF :THE CALL: The er read the Mayor's call for meeting and the certificate of mailing attached to said -call. Re - change order - Creamery Intdree.ptor. Revised plans and specifications for. creamery interceptor line and detail, submitted by Harry_ N. Jenks,, were reported filed on August 1,. Mr., Fred Ellsworth,, Mr. Curl Mau of the California Water Service Company., Mr. Herbert Brainerd_.Resident Engineer, Municipal Sewage Disposal Project.,, and Mr. Earl I. Stewart, Resident - Engineer Inspector"°for 'the Public Works Administration were presen.tat the meeting. Mr. Karl Brooks, City Attorney, explained the neEd for the change order- the creamery interceptor line -.there being a difference of opinion as to whether the plans and ;specifications referred to the milk products plant or all of the buildings.of the milk products plants Mr. Soda,` the Contractor, claiming.that the plans only required him to C onnect to. the one building, :shown on the plans., Mr. Brainerd, Mr. Stewart,. and.' Xr. Jenks, claiming that the. .plans ._and s'pec'ificat ons referred to all of the buildings of the milk products plants. C ity Attorney Brooks further explained the difference in cost under the revised plans and specifications and stated that after a conference with Mr. Brainerd, Mr..Stowart, Mr..: Jenks and Mr. Soda at which all of the costs were reviewed,, he, would recommend to the City that the matter be •compromise"d_..b.y.,each party, agreeing to bear. 50% of the difference between th_e: cost of the- jobs,, that. La to say, that the City pay one: =half of the additional expense: and that Mr. Soda do the work for one- half o.f the difference of the amount for which he .considered it should be done. Under that settlement the. p,roposed. change order would amount to a. net sum of 'x$1496.480 He further stated that he had recommended the compromise and settlement to Mr. Soda who had agreed to accept it a nd to Mr'. Brainerd who had agreed that such a compromise would be advi,seable. Mr, Brooks further stated that Mr. Soda- had exhibited to'him his estimates in figuring the 'job originally and that for the item of connectl"ng; drains for the milk products plant he had only allowed $150.00 indicating that he had not included any of the additional buildings in his e s t:imat °e . Mr. Brainerd stated to the Council that he is' �of the same opinion as`the City Attorney and that the revi- sed.plan is the most logical way to take care of the problem. M r. Stewart addre,s;sed the Council and stated that he was not` su that the' PWA would approve the compromise but that he would lay all of the facts before them and do what he..could to facilitate approval from the PWA,. City Engineer Gonzalez also expressed himself,.as beli,eving that the corApromis and change order was the best way to handle'the matter,. INTRODUCTI,ON OF ORDINANCES: Or' inance No. 4,94 C...S, introduced by Councilman P:enry, seconded by Councilman Peters, entitled,.. "An ordinanc?e of the City of Petaluma,- providing for and authorizing certain changes in ;Unit "C" of the Municipal Sewage Disposal Pro ject,, for a net additional cost of $1496.48;" accepting the agreement of A. Soda & Son, the Contractor for said Unit "C" for the cha -nges. in said work for the said net additional; directing the City Attorney to- submit said, changes t.o the Vedor;al Emergency Administration of Public Works for th,e approval and inclusion in the grant for the pro,jec.t; providing for the payment of all costs of said changes out of the' 1957 Sewer Cnnstruction.Fund; wasread, approved by the City Attorney, :and M C Res X4868 C.S. . in.troducedby Councilman Penry, seconded by Councilman Peters, autho.rizing the public. -ion . of said ,ordinance, adopted by 5 affirm a -tIve vot6a,, 2 absentees.
