REPORTS OF OFFICERS.: Opin on of ty Attorney Karl Brooks re the right of the City to contribute general funds for the construction of a building in Kenilworth Park, read and filed. Opinion of..City Attorney Karl -re: Appropriation of money for tennis court in Oak Hill Park., read and filed. Revised estimate of the,. cost of improving North Fair Street, totaling ,.$1465.40 was read and placed on file. PETITIONS AND COMMUNICATIONS: w . j Resignation of . A. Burton as Poundman and Janitor of the City of Petaluma, said resignation to be effective Larch 1, 1940, read and failed. Application of Arthur F. Robotham for position of Poundman, of Albert O.. Smith for position of ,Poundman. and Janitor, of Vernon True for position of Janitor or Poundman, of Peter Mastrup for position of 'Poundman and Janitor, of L. G. Brewer for position of Janitor, and of Bryon A. Rynders for position of Poundmaster and Janitor ,. read. and placed on file. `.Communication from Race Kent, President of Petaluma Theatre Guild urging that the City contribute funds for the construction of an auditorium at Kenilworth Park, read and filed. NEW BUSINESSs Resolution #5099 C.S. introduced by Councilman Gervasoni, seconded by Councilman Berger, dire ,cti the Auditor and to make transfers from the various funds to the General Funds: for gasoline used during the period from July 13, 1939 to January 15, 1940 by the various departments of the City and previously paid for from the General Fund, adopted by 6 affirmative votes, 1 abisentee. Appointment of Poundman and Janitor. Resolution # 10:0 C.S. introduced by Councilman De -iss second d by Councilman Peters, accepting'the resignation of Frank A: `Burton as Poundmaster and UL.-- tor, effective March 1,, 1940, and appointing Arthur F. Robotham to perform the duties of Poundmaster in addition to his duties as Rodent Exterrninator, at a salary of x,'150.00 per month, commencing Parch 1,,. and appointing Lawrence Brewer, Janitor of the City Library to perform the :duties of Janitor of 'the City Hall,, at a total salary of $110.00 per month, $85.00 to be. paid from the Library Fund and $25..0.0 from, the General Fund, adopted by 6 affirmative votes, 1 absentee. Re request of Purity Stores for - repeal of Handbill ordinance:::; City Attorney .Karl, Brooks reported t;he request of Purity Stores for repeal of the handbill ordinance., basing the request on the recent decision of the'Uni.ted States Supreme'Court that such handbill ordinances are invalid. Mr. Harry Benton addressed the Council on the subject, outli ng the history and reasons.for the adoption of said ordinance and urging that s aid ordinance be in -effect. The. matter was discussed and no action taken. Re - : North Fair Street Improvemont- The estimate of cost for improvement of N. Fair Street was reviewed by the Council and b"ased on 'said e:S' it was determined that the deposit to be paid by the pr . operty owners b U..50 per lineal foot. In this connection' City Attor'ney'Karl Brooks read a form .of agreement which he 'had prepared - f or � the signature. of the property 'owners' along said street, z and - asked that the Cbuncil decide on a date by which time the .deposits for said, improvement '. must be in the hands of the Clerk.
