RECOMMENDATION It is recommended that the City Council adopt the attached Resolution Authorizing Award of Contract for the Public Works and Utilities Department Field Office Roof Overlay and Replacement Project to MCM Roofing Company, Inc. BACKGROUND The existing roof on the Public Works and Utilities Department Field Office has failed and needs to be replaced. The building was constructed in 2005 with a thermoplastic polyolefin (TPO) single -ply membrane roof manufactured by Stevens Roofing Systems. The roof started leaking in 2012 and staff pursued a warranty repair only to learn months later that the original manufacturer had sold to the Dow Chemical Company. The City pursued warranty repair with Dow and also contracted independently for limited roof repairs and overlays to keep rain water from entering the building. A complete roof replacement is needed as contractors have indicated continued patching is no longer possible with complete material failure. Staff will make a final warranty claim to Dow at the conclusion of this project requesting reimbursement for the new roof installation. DISCUSSION The exisitng thermoplastic polyolefin (TPO) roof will be removed and replaced with 60 -mil TPO single -ply membrane. A walkway pad will be installed from the roof access hatch to the HVAC equipment to protect the TPO membrane. This project will reduce the ongoing repair and maintenance costs and eliminate leaks during winter rains. A Notice Inviting Bids was issued on June 21, 2018. The base bid included the removal and replacement of the TPO sections of roof. An additive alternative was included in case favorable bids allowed sufficient funding to extend the TPO to the top of the building wall and replace the two-piece counter flashing at the building perimeter. Extending the area of TPO installation will ensure that areas of water penetration on the roof are sealed. The lowest responsible bidder, MCM Roofing Company Inc., has not performed work for the City of Petaluma, but has performed similar public works projects. MCM Roofing Company Inc., possesses the necessary California Contractor's License, Class C-39, number 938303, which expires on September 30, 2019, to perform the work. It is recommended that the Council award the base -bid contract only to MCM Roofing Company, Inc. for $85,362.00. Construction would be scheduled to begin September 2018 and be completed in about one month. The contract documents require completion within twenty (20) working days. The project is categorically exempt from the California Environmental Quality Act because it performs maintenance and minor upgrades to an existing facility project. Proceeding at this time is necessary and will not affect the viability of the warranty claim with Dow. The proposed action meets Council Goal: "Plan and Deliver Capital Improvements." FINANCIAL IMPACTS The project is included in the FY 18/19 CIP Budget as C11201912 with an approved project budget of $115,000 and funded by Water Capital. Resolution Attachment 1 RESOLUTION AUTHORIZING AWARD OF CONTRACT FOR THE PUBLIC WORKS AND UTILITIES DEPARTMENT FIELD OFFICE ROOF OVERLAY AND REPLACEMENT PROJECT TO MCM ROOFING COMPANY, INC. WHEREAS, City staff prepared construction bid documents and advertised for construction of this Project; and WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, City staff solicited bids for the Project; and WHEREAS, the project was bid on June 21, 2018, and six (6) bids were received and opened on July 12, 2018, in accordance with applicable law; and WHEREAS, the lowest responsive bid for the Project was submitted by MCM Roofing Company Inc., from McClellan, CA for $85,362; and WHEREAS, staff has determined that the Contractor's bid satisfies the bidding requirements for the Project; and WHEREAS, staff has verified that Contractor possesses a valid California Contractor's License, Class C-39, number 938303 that is appropriate for the work to be performed for the Project; and WHEREAS, the Project is categorically exempt pursuant to California Environmental Quality Act ("CEQA") and Title 14, the California Code of Regulations ("CEQA Guidelines"), Section 15301, because the project consists of the operation, repair, maintenance or minor alteration of existing public structures involving negligible or no expansion of use beyond that previously existing. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby: 1. In accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, waives any and all non- conformance in the bid of MCM Roofing Company Inc., for the Public Works and Utilities Department Field Office Roof Overlay and Replacement Project, finds the bid of $85,362.00 to be the lowest, responsive bid and further finds that MCM Roofing Company Inc., is the lowest responsible bidder. 0 2. Awards the contract for the Public Works and Utilities Department Field Office Roof Overlay and Replacement Project No. C 11201912 to MCM Roofing Company, Inc. in the amount of $85,352.00, the amount of the lowest responsive bid, conditioned on MCM Roofing Company Inc.'s timely executing the project contract and submitting all required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 3. Authorizes a construction contract contingency of $8,500. 4. Authorizes and directs the City Manager to execute the project contract documents on behalf of the City. 5
