5 ADOPTING A NEGATIVE DECLARATION PURSUANT TO THE CALIFORNIA
6 ENVIRONMENTAL QUALITYACT (CEQA) TO ALLOW THE PETALUMA
7 SCHOOL DISTRICT ADMINISTRATIVE OFFICES
8 TO RELOCATE TO 204 DOUGLAS STREET,
9 A 3.06 ACRE PARCEL, APN 008-161-014 NO. 008-161-014

12 WHEREAS, the Planning Commission at its public hearing of June 9, 1998, considered
13 and recommended adoption of a Negative Declaration pursuant to the California
14 Environmental Quality Act (CEQA) in conjunction with the following applications:

16 1. Request a General Plan Amendment to redesignate a 3.06 parcel from Retail
17 Center to Mixed Use.
18 2. Request a 3.06 acre parcel be rezoned from Neighborhood -Commercial (GN) to
19 Administrative and Professional Office (C-O).

21 NOW THEREFORE BE IT RESOLVED that the Petaluma City Council hereby finds as
22 follows'

24 Findin¢s for a Negative Declaration of Environmental Impact:
25
26 1. An Initial Study was prepared, proper notice was provided in accordance with
27 CEQA and local guidelines for the approval of a Negative Declaration to allow a
28 General Plan Amendment and Rezoning request.
29 2. Based upon the Initial Study and any comments received, there is no substantial
30 evidence that the project would have a significant effect upon the environment.
31 3. A mitigation and monitoring program is not required as no impacts were found to
32 be potentially significant.

1 4. The project does not have the potential to affect wildlife resources as defined in
2 the Fish and Game code, either individually or cumulatively.
3 5. The project is not located on a site listed on any Hazardous Waste Site List
4 compiled by the State pursuant to Section 65962.5 of the Government Code.
5 6. The Planning Commission has reviewed the Negative Declaration and considered
6 any and all comments before making a decision on the project.
7 7. The record of proceedings of the decision on the project is available for public
8 review at the City of Petaluma, Planning Department, City Hall, 1 I English Street,
9 Petaluma, California.

13 The Planning Commission finds that there-is no evidence before the City that the proposed
14 project will have the potential for an adverse effect on wildlife resources or the habitat
15 upon which the wildlife depends. On the basis of substantial evidence, the presumption of
16 adverse effect is rebutted. A Certificate of Fee Exemption will be completed and filed with
17 the Notice of Determination for the project.
