HomeMy WebLinkAboutResolutions 2011-045 N.C.S. 03/21/2011Resolution No. 2011 -045 N.C.S. of the City of Petaluma, California DENYING APPEAL OF ORGANS `R' US REQUESTING WAIVER OF SPECIAL EVENTS PERMIT REQUIREMENT FOR ATHLETIC EVENT PURSUANT TO PETALUMA MUNICIPAL CODE CHAPTER 13.32. WHEREAS, Organs `R' Us, a 501 (c)(3) organization, has contacted the Petaluma Police Department regarding a walking and running relay race Organs `R' Us intends to sponsor, called The Relay, which would include two race segments that take place within the City of Petaluma on May 1, 2001; and, WHEREAS, during a similar event sponsored by Organs `R' Us in 2010, a runner proceeding westbound in the travel lane on `D' Street at 10:17 p.m. was hit and injured by a motor vehicle, resulting in significant injuries; and, WHEREAS, during the 2010 event, a second collision occurred on Manor Road, near Adobe Lane, involving a support vehicle; and, WHEREAS, Organs `R' Us has provided a list of 223 teams which have entered the 2011 event, each team is required to have two support vehicles, and additional race officials and race vehicles will also participate; and, WHEREAS, following the 2010 event, Petaluma Police personnel consulted with the California Highway Patrol, and were informed by the Highway Patrol that multiple complaints were received regarding participants in The Relay and support vehicles impeding traffic along the race route; and, WHEREAS, the City of Petaluma Police Department has informed Organs `R' Us that Special Event Permit is required before any race segments may proceed in the City, pursuant to Petaluma Municipal Code Chapter 13.32, including but not limited to Sections 13.32.030.13; and, WHEREAS, Organs `R' Us has presented a Notice of Appeal to the City Council requesting a waiver of the requirement for a Special Event Permit; and, Resolution No. 2011-045 N.C.S. Page 1 WHEREAS, the City of Petaluma Police Department recommend that a Special Event Permit be required, in order for Police personnel to review and require adequate safety and logistical measures and to ensure that the event will not impede or obstruct pedestrians and motorists in the City. NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL HEREBY denies the appeal of Organs `R' Us and confirms that a Special Events Permit is required for the athletic event known as The Relay prior to any use of City streets or facilities for The Relay. BE IT FARTHER RESOLVED that the Petaluma Police Department shall determine whether or not the Special Event Permit shall be approved, and if approved, shall require any permit to contain sufficient conditions and measures to comply with the standards set forth in Petaluma Municipal Code Chapter 13.32.
