HomeMy WebLinkAboutResolution 98-178 N.C.S. 08/17/1998 Resolution No. sa-~I7~ N.C.S. z of the Ciry of Petaluma, California a s 6 7 ADOPTING A MITIGATED NEGATIVE DECLARATION PURSUANT TO THE 8 CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) FOR THE PETALUMA 9 ECUMENICAL PROJECT (PEP) GENERAL PLAN LAND USE MAP AMENDMENT l0 AND REZONE FOR PROPERTY LOCATED AT 167 EDITH STREET, APN 007-057-033 ]1 I? 13 WHEREAS, the Plamiiug Commission at its public hearing of July 14, 1998, considered and 14 recommended adoption of a Mitigated Negative Declaration pursuant to the California 15 Enviroiuuental Quality Act (CEQA) for the PEP proposal. to amend the General Plan Land Use 16 Map to change the designation of a .83 acre site located at 167 Edith Street, APN 007-057-033, 17 from Urban Standard to Urban High and to change the zoning from R1-6, 500 to Planned Unit 18 District. 19 20 NOW, THEREFORE, BE IT RESOLVED that the Petaluma City 'Council hereby finds as zt follows: z2 23 Findings for Mitigated Negative Declaration 2q 25 1. An Initial Study has been prepared and proper notice provided in accordance with CEQA 26 and local Guidelines. 27 28 2. Based upon the Initial Study and any comments received, potential impacts could be 29 avoided or reduced to a level of insignificance by mitigation measures attached as 30 conditions of approval. There is no substantial evidence that the project, as conditioned 31 would have a significant effect on the enviranment. 32 Reeola4on xo. '98-178 -x.cs. Page 1 of 7 I 3. A monitoring program has been included to ensure compliance with the adopted 2 mitigation measures. 3 4 4. The project does not have the potential to affect wildlife resources as defined in the Fish 5 and Game code, either individually or cumulatively, and is exempt from the Fish and 6 Game filing fees because the project is not located near any of the resources and is 7 proposed on an infill site surrounded by urban development, with none of the resources 8 existing on the site. 9 I o 5. The project is not located on a site listed on any hazardous Waste Site List compiled by I 1 the State pursuant to Section 65962.5 of the Government Code. 12 13 6. The Ciiy Council reviewed the Initial Study/Negative Declaration and considered the t4 comments before making a decision on the project. 15 16 7. The record of proceedings of the decision on the project is available for public review at 17 the City of Petahuna Planning Department, City Hall, 11 English Street, Petaluma, CA. is t9 BE IT FURTHER RESOLVEll that the Petaluma City Council, in reference to the potential 20 impacts identified in the hiitia] Study, hereby adopts the Mitigated Negative Declaration 21 including the following mitigation measures to be attached as conditions of approval for the PEP 32 General Plan Land Use .Map amendment, rezone and Planned Unit Development Plan as 23 recommended by the Planning Commission, 24 25 EARTH 26 27 Mitigations: 28 1. Grading, drainage and improvements plans shall include measures to mitigate soil erosion 29 as established in Title 17 of the Petaluma Municipal Code. 30 Reso. 98-.178 NCS Page 2 of 7 2 I Monitoring: 2 1. The Petaluma Building and Engineering Departments shall insure that the grading, drainage 3 and erosion control plans conform to the City of Petaluma's Erosion Control Ordinance 4 prior to issuance of a building permit. 5 AIR 6 7 Mitigations: s 1. Construction activities shall comply with applicable Zoning Ordinance and Municipal Code 9 Performance Standards (noise, dust, odor, etc.). 10 2. Watering of the site to reduce airborne dust levels shall be implemented if dust generated during the grading process threatens to travel off-site due to wind currents. 3. All motor-powered equipment shall be properly equipped with systems to reduce emissions and shall be shut down if not in use, Haul trucks carrying dirt on or off-site shall be covered with tarps. Monitoring: l., 2. & 3. The contractor shall be responsible for insuring that proper measures to prevent dust emissions, including watering as necessary during construction, are implemented. This responsibility shall include holidays and weekends when work may not be in progress. The City will conduct periodic inspections of the site to ensure compliance with the mitigation measures. HYDROLOGY AND WATER QUALITY Mitigations; I 1. The plans submitted for Building Permits shall include a new minimum I S inch storm drain i2 extending from the project boundary to the existing storm drain in Madison Street. The i 3 storm drain shall be installed prior to certificate of occupancy. 3 Reso. 98-178 NCS Page 3 of 7 1 2. If applicable, Fossil Filters, or the equivalent, shill be installed at all storm drain inlets in 2 parking and circulation areas. Filters shall be maintained per manufacturer's instructions. 3 Confirmatiat of filter maintenance and replacement shall be submitted to the Planning 4 Department on an annual basis. As an alternative, street runoff should be conveyed through 5 vegetated swales or retained in small detention basin or swales which serve to filter and 6 absorb sediment and chemical constituents in urban runoff prior to entering a stone drain. 8 3. If applicable, permanent signs shall be installed at all drop inlets to the public storm drain 9 system which prohibit the deposit of hazardous materials into the system and notify the 0 public that the drain flows to the river. ]1 12 Monitoring: t3 l., 2. & 3. If applicable, plans submitted for building permit shall show the locations of all drop to inlets to the storm drain system including the locations of all Fossil Filters, or the i 5 equivalent, and including permanent signs which prohibit the deposit of hazardous materials t 6 into the system and notifies the public that the drain flows to the river. t7 I8 NOISE t9 20 Mitigations: 21 L Construction hours shall be limited to the hoiu's of, 7:00 a.m. to 5:00 p.m., Monday through Z2 Friday; 8:00 a.m. to 5:00 p.m. on Saturday; noneon Sunday and holidays recognized by the 23 City of Petaluma. ~q 25 2. The vehicles and/or egrupment used for the project shall be required to comply with all 26 vehicle codes and City Performance Standards pertaining to noise, as applicable, including 27 the use of mufflers to reduce the noise from the construction equipment. The project developer shall be responsible to pay the City's Special Development Fees as 22 specified for traffic mitigation prior to issuance of a Certificate of Occupancy. za PUBLIC SERVICES/RECREATION 25 26 Mitigations: Z7 1. The project developer shall be responsible to pay the City's Special Development Fees as 3 specified for public services prior to issuance of a Certificate of Occupancy. d 5 UTILITIES 6 7 Mitigations: 8 1. The project developer shall be required to pay .for water and sewer connections as 9 established in the City's Special Development Fee handout. 10 II Monitoring: 12 1. Timing of payment of required Special Development Fees for water and sewer 13 connections shall be as specified in the current Special Development Fees booklet. 14 15 CULTURAL RESOURCES tb 17 Mitigations/Monitoring: IS 19 1. In the event that archaeological/historical remains are encountered during grading, work 20 shall be halted temporarily and a qualified archaeologist shall be consulted to evaluate the 21 artifacts and to recommend further action. The identified Native American community shall 22 also be notified and consulted in the event any archaeological remains are identified.
