SUBJECT: Resolution Authorizing Award of Contract for the Sewer Main Replacement FY
18/19 Project to Pat Nelson Construction, Inc.
It is recommended that the City Council approve a Resolution Authorizing Award of Contract
for the Sewer Main Replacement FY 18/19 Project to Pat Nelson Construction, Inc.
To maintain and improve the condition of the City's water and wastewater systems, the City
replaces or rehabilitates deteriorating water and sanitary sewer lines annually. A five-year
priority list of water and sewer line replacements has been created. These projects are cross-
referenced with the City's street maintenance program, development projects, and proposed
PG&E work to endeavor to assure that new or nearly new pavement will not be impacted.
The Sewer Main Replacement FY 18/19 Project, CIP # C66401822, includes: 1) the replacement
of the sewer main and manholes located in the backyards of homes along Coronado Drive and
Cortez Drive between McNeil Drive and McGregor Avenue; 2) sewer main replacement along
McGregor Avenue, Kresky Way, and Reynolds Drive, which will be completed by open trench
construction; and 3) rerouting the sewer main in the right of way on Kresky Way, eliminating a
portion of sewer main running through the backyards of homes on Reynolds Drive and Adrienne
Drive as shown in Attachment 3. In backyards, where possible, sewer main replacement will be
accomplished through the less disruptive method of pipe bursting the existing mains. This project
replaces pipes that are over 60 years old, improves service, reduces maintenance costs, inflow
and infiltration, and the risk of sanitary sewer overflows. The project location is shown in
Attachment 2.
The proposed action supports the City of Petaluma's Goal 8-G-4 as outlined in the General Plan:
Wastewater — Manage the wastewater collection and treatment system to address 100 percent
capture and treatment of the City's wastewater in an economically and ecologically sound
manner.
The project was designed, and contract documents compiled, in-house by City staff. A Notice
Inviting Bids was advertised on July 19, 2018, and on August 16, 2018, two (2) bids were
received as follows:

The lowest responsible and responsive bidder, Pat Nelson Construction Inc. has performed
similar sewer projects throughout the Bay Area. Staff verified that Pat Nelson Construction Inc
possess a valid Class A California Contractor's License, number 601031, which qualifies Pat
Nelson Construction Inc. to perform the work.
There was a clerical error on the bid documents for Pat Nelson Construction Inc. that occurred
on the bid schedule. For one of the items, an incorrect number was written, such that the total
price did not equal the unit price multiplied by the item quantity. However, it was found to be a
misplacement of a decimal point and since it did not provide any advantage over the other
bidder, the City exercised its right to waive this irregularity and finds Pat Nelson Construction
Inc. to be the lowest responsible bidder.
Construction is scheduled to begin in October 2018 and to be completed by January 2019.
Construction management and inspection services will be conducted by City staff with assistance
by an outside consultant for geotechnical and material testing services.
The Sewer Main Replacement FY 18/19 Project will be performed under the same CIP project
number as the Sewer Main Replacement Project FY 17/18, Project Number C66401822. The
approved FY 18/19 CIP budget is $2,724,000, consisting of the remaining budget for the Sewer
Main Replacement FY 17/18 of $1,152,094 and $1,571,906 to be used for the Sewer Main
Replacement FY 18/19 project.

WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code,
California Public Contract Code Section 20162 and other applicable law, City staff prepared
construction bid documents and solicited bids for the Project; and
WHEREAS, the project was bid on July 19, 2018, and two (2) bids were received and
opened on August 16, 2018 in accordance with applicable law; and
WHEREAS, the lowest responsible bid for the Project was submitted by Pat Nelson
Construction Inc., from Petaluma, CA for $1,230,500; and
WHEREAS, staff has verified that Pat Nelson Construction Inc., possesses a valid
California Contractor's License, Class A, number 601031 that qualifies Pat Nelson Construction
Inc. to perform the Project; and
WHEREAS, the Project is categorically exempt pursuant to California Environmental
Quality Act ("CEQA") and Title 14, the California Code of Regulations ("CEQA Guidelines"),
Section 15301 and 15302, because the project consists of replacement and reconstruction of
existing sewer mains of similar size and function.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Petaluma hereby:
1. In accordance with the City of Petaluma Charter and Municipal Code, California Public
Contract Code Section 20162 and other applicable law, waives any and all non-
conformance in the bid of Pat Nelson Construction Inc. for the Sewer Main Replacement
FY 18/19, Project No. 066401931, finds the bid of $1,230,500 to be the lowest,
responsive bid and further finds that Pat Nelson Construction Inc. is the lowest
responsible bidder, and establishes a contract contingency of $199,906.
3. Awards the contract for the Sewer Main Replacement FY 18/19, Project No. C66401931
to Pat Nelson Construction Inc., in the amount of $1,230,500, the amount of the lowest
responsive bid, conditioned on Pat Nelson Construction Inc.'s timely executing the
project contract and submitting all required documents, including but not limited to,
executed bonds, certificates of insurance, and endorsements, in accordance with the
project bid documents.
4. Directs staff to issue a notice of award to Pat Nelson Construction Inc.
5. Authorizes and directs the City Manager to execute the project contract on behalf of the
City of Petaluma upon timely submission by Pat Nelson Construction Inc., of the signed
project contract and all other required document, including but not limited to, executed
bonds, certificates of insurance, and endorsements, in accordance with the project bid
documents.
