6 APPROVING THE DEVELOPMENT PLAN FOR PETALUMA ECUMENICAL
2 PROJECTS LOCATED AT 167 EDITH STREET, APN 0.77-057-033

to WHEREAS, by Ordinance No. 2076 N.C.S., Assessor's Parcel Number 077-057-033 was
I 1 rezoned to Planned Unit District (PUD); and
12
13 WHEREAS, by action taken on July 14, 1998, the Planning Commission recommended
I4 adoption of the unit development plan in said Planned Unit District;
15
i6 NOW, THEREFORE, SE [T RESOLVED that the unit development plan on file in the
17 Planning Department office is hereby approved pursuant to Section 19A-.504 of Zoning
18 Ordinance No. 1072 N.C.S., as amended; and

20 BE IT FURTHER RESOLVEll THAT the City council hereby adopts the findings of the
21 Planning Commission as its findings as stated hereinafter:

23 1. Said plan clearly results in a more desirable use of land and a better physical
za environmental than would be possible under any single zoning district or combination of
25 zoning districts.

27 2. The PUD is proposed on property which has a suitable relationship to one (1) or more
28 thoroughfares (Edith Street and East Washington. Street); and that said thoroughfares are
29 adequate to carry any additional traffic generated by the development.

3. The plan for the proposed development, as conditioned, presents a unified and organized
2 arrangement of buildings and service facilities which are appropriate in relation to
3 adjacent or nearby properties and that adequate landscaping and/or screening will be
4 included to ensure compatibility.

6 4. The, natural and scenic quality of this urban site are protected, with adequate available
7 public and private spaces designated on the Unit Development Plan, considering the
8 specialized nature of the use.

l0 5. The development of the subject property, in the manner proposed by the applicant, will
11 not be detrimental Co the public welfare, will be in the best interests of the City and will
I2 be in keeping with the general intent and spirit of the zoning regulations of the City of
13 Petaluma and with the Petaluma General Plan because the project provides housing
t4 consistent with the City's housing objectives and goals, and the project will be located on
I5 a site near services and a bus route.

t7 6. The development of the subject property, in the manner proposed by the applicant and
18 conditionally approved, shall continue fo provide affordable housing for low and very
19 low income elderly persons as required in the Addendum to the_ Grant Deed.

2t FURTHER RESOLVED THAT the City Council hereby approves the development plan,
22 subject to the mitigation measures and conditions hereinafter set out as follows:
23
24 Mitigation Measures:
25 1. Grading, drainage and improvement plans shall include measures. to mitigate soil erosion as
26 established in Title 17 of the Petaluma Municipal Code.
27
28 2. Construction activities shall comply with applicable Zoning Ordinance and Municipal Code
29 Performance Standards (noise, dust, odor, etc.).

1 3. Watering of the site to reduce airborne dust levels shall be implemented if dust generated
2 during the grading process threatens to travel off=site due to wind currents.

4 4. All motor-powered equipment shall be properly equipped with systems to reduce emissions
5 and shall be shut down if not in use. Haul tracks carrying dirt on or off-site shall be covered
6 with tarps.

8 5. The plans submitted for Building Permits shall include a new miniinum 15 inch storm drain
9 extending from the project boundary to the existing storm drain in Madison Street. The
t o storm drain shall be installed prior to certificate of occupancy.

12 6. If applicable, Fossil Filters, orthe equivalent, shall be installed at all storm drain inlets in
13 parking and circulation areas. Filters shall be maintained per manufacturer's instructions.
14 Conflmtation of filter maintenance and replacement shall be submitted to the Planning
i 5 Department on an annual basis. As an alternative, street runoff should be conveyed through
16 vegetated swales or retained in small detention basin or swales which serve to filter and
I ~ absorb sediment and chemical constituents in urban runoff prior to entering a storm drain.

f9 7. If applicable, permanent signs shall be installed at all drop inlets to the public stomr drain
20 system which prohibit the deposit of hazardous materials into the system and notify the
21 public that the. drain flows to the river. Said signs shall be installed prior to issuance of a
22 Certificate of Occupancy.

24 8. Construction hours shall be limited to the hours of 7:00 a.m. to 5:00 p.m., Monday through
25 Friday; 8:00 a.m. to x:00 p.m. on Saturday; none on Sunday and holidays recognized by the
26 City of Petaluma:

1 9. The vehicles and/or equipment used for the project shall be required to comply with all
2 vehicle codes and City Performance Standards pertaining to noise, as applicable, including
3 the use of mufflers to reduce the noise from the construction equipment. Equipment shall be
4 turned off when not in use.

6 10. The site plan, landscape plan and building elevations are subject to the review and
7 approval of the Site Plan and Architectural Review Committee (SPARC) prior to
8 issuance of a building permit. The plans, once approved by SPARC, shall become the
9 PUD development plan Sor the project site.

1 I l 1. The project shall be subject to the City's Special Development Pees as specified for traffic
12 mitigation.

14 12. The project shall be subject. to the City's Special Development Fees for public services as
15 specified in adopted legislation.

17 li. The project developer shall be required to pay for water -and sewer connections as
18 established in the City's Special Development Fee handout.

20 14. In the event that archaeologica]/historical remains are encountered during grading, work
21 shall be halted temporarily and a qualified archaeologist shall be consulted to evaluate the
22 artifacts and to recommend further action. The identified Native American community shall
2~ also be notified and consulted in the event any archaeological remains are identified. If
24 human remains are found, the County Coroner shall be notified immediately.

26 15. Prior to issuance of a demolition permit, the project sponsor shall publicly notice the
27 availability of materials for salvage by any interested parties.

I Conditions of Approval:
2 From the Planning Department:
3 1. The project sponsor shall execute a binding agreement with the City of Petaluma insuring
4 that the occupancy of the 23 units shall beheld in perpetuity for low and very-low income
5 persons 62 years of age or older prior to issuance of a building. permit.

7 2. All improvements and grading shall comply with the Sonoma County Water Agency's
8 Design Criteria.

l0 3. Within five (5) days of the date of City Council approval of the General Plan amendment
I I and rezone, the applicant shall submit to the Planning Department a check in the amount
tz of $35.00 made out to the Sonoma County Clerk for the Notice of Determination filing
13 fee.

i 5 From the Engineering Department:
16 4. At the time of building permit submittal, the applicant shall provide a detailed grading
17 plan, dimensioned site plan and utility plan completed by a civil engineer to the
I8 Engineering Department.

20 5. Remove and replace existing curb and gutter across parcel frontage and install city
21 standard sidewalk along parcel frontage.
23 From the Building Division:
24 6. Grading must be certified when completed to indicate compliance with approved plans
25 and will be required for occupancy.

27 7. Certify pad elevations before building slab on grade is poured.

8. Soils with expansion index greater tha? 20 requires special design foundation per
2 Uniform Building Code 1803.2.

4 9. Mixed occupancy separation, as described in Chapter 3 of the 1994 UBC, must be
5 followed.

7 10. All roofing shall be "B" rated or better per Ordinance No. 1744/1988.

9 11. Show site drainage and grading topography.

13 13. Responsible party to sign plans.

19 l6. Plans must show compliance to ] 994 UBC, UPC, UMC, and ] 993 NEC. Plans must also
20 show compliance to current Title 24 Energy Conservation and/or Disabled Access
21 Requirements.
23 17. Provide structural calculations for all non-conventional design items..

25 18. Demolition permit required to remove any structure.

1 From the Fire Marshal:
2 19. Provide one fire extinguisher. 2AlOBC type, for each 3,000 square feet of Floor space,
3 and/or a maximum travel distance of 75 feet.

5 20. Post address at or near main entry door -minimum of four (4) inch letters on contrasting
6 background.

8 21. Address locator required to be posted at or near the driveway entrance. Reflectorized
9 numbers are acceptable. Location and design to be approved by the Fire Marshal's office.

I I 22. Provide KNOX box for Fire Department access on the building. Application for the box
12 can be obtained. from the Fire Marshal's office. Qox location shall be approved by the
13 Fire Marshal.

15 23. "I"he buildings shall be protected by an automatic fire extinguishing system as required by
16 the Uniform Building Code.

I8 24. Provide to the Fire Marshal's office, a minimum of two (2) sets of fire sprinkler plans and
t9 calculations for approval and issuance of permit prior to installation of system.

21 25. Provide a fire alarm system for all residential buildings 3 or more stories in height or
22 containing l6 or more dwelling units in accordance with the Uniform Pire Codc.

2a 26. Provide smoke detectors in all sleeping rooms and common hallways. Detectors shall be
25 provided hardwired with battery backup. Electrical circuits supplying detectors shall be
26 separate dedicated lines with no other devices on the circuits.

28 27. Permit required from the Firc Marshal's office for alarm system alteration prior to
29 commencement of work on the system; two sets of plans are required to be submitted for
30 review and approval.

2 28. Provide electrical conduit from post indicator valve to alarm panel location for tamper
3 switch as underground improvements are being installed.

5 29. Contractor shall provide the Pire Marshal's office with two (2) sets of plans for the
6 underground fire service main for permit approvah prior to commencement of work.

8 30. A two-inch clearance shall be provided around fire sprinkler lateral and riser at
9 foundation and floor slab.
