HomeMy WebLinkAboutResolution 98-200 N.C.S. 09/22/1998 Resolution No. ss-2oo N.C.S. of the City of Petaluma, California 1 2 3 4 5 6 ASSURING COMPLIANCE WITH VARIOUS CONDITIONS AND 7 REQUIREMENTS OF THE CALIFORNIA TRANSPORTATION 8 COMMISSION FOR ALLOCATION OF TRANSIT CAPITAL 9 IMPROVEMENT FUNDS TO TAE PETALUMA TRANSIT MALL PROJECT 10 11 12 13 14 15 WHEREAS, the City of Petaluma will request the California Transportation Commission 16 (CTC) to approve an allocation of $75,000 in FY 98-99 Transit Capital Improvement (TCI) funds for 17 the Petaluma Transit Mall Project. 18 l9 NOW, THEREFORE, BE IT RESOVLED by the Petaluma City Council that it does certify 20 as follows: 21 22 a) In the opinion of the City of Petaluma's legal counsel, the City has the financial and 23 institutional ability to implement the Project, and it is empowered to let. a contract, to sue 24 or be sued by another entity or person; and 25 b) The Project receiving state TCI funding will be available to the general public and will 26 not benefit a private entity or individuals; and 27 c) The matching funds required for this allocation have been approved by the Petaluma City 28 Council and are included in the City's FY 98-99 budget, and upon allocation of funds by 29 the CTC, the City of Petaluma will have the authority to expend these funds; and 30 d) Should the Project under this grant application exceed the state funds available, the City 3 I of Petaluma will use other funds to backfill the cost increase to complete the Project; and 32 e) The City of Petaluma intends to comply with the Commission's Hazardous Waste 33 Identification and Clean-up Policy for Rail Right-of--Way and in this regard has been 34 investigated to determine the absence of hazardous wastes, and will take reasonable 98-200,.,,,_. acs, Page 1 of 2 1 steps to assure full due diligence, cleanup, damages or liability costs associated with any 2 hazardous wastes discovered on the Pro}ect site; and 3 f) The City of Petaluma will comply with the CTC's timely use of funds policies. 4 5 BE IT FURTHER RESOLVED that the Petaluma City Manager is hereby authorized to file any 6 necessary supporting documents under this resolution and to execute the Fund Transfer Agreement to 7 receive the TCI funds. 8 9 10 11 12 13 14 ' 15 reso 16 viai9a(t~~ Under the powez and authority conferred upon Etas Council by the Charter of said City.
