INC.. FOR FIXED ROUTE SERVICE 6 7 8 WHEREAS, the City of Petaluma wishes to provide transportation services to those residents 9 of the City who would use an alternate mode of transportation such as our fixed route bus system; and 10 11 WHEREAS, the City of Petaluma's transit system is a means of reducing traffic congestion, 12 vehicle emissions, energy consumption, and noise levels; and 13 14 WHEREAS, Laidlaw Transit Services, Inc., is performing very well within its existing contract 15 and is able and willing to continue such services. 16 17 NOW, THEREFORE, BE IT RESOLVED, that the Mayor or City Manager is authorized to 18 enter into aone-year extension agreement with Laidlaw Transit Services, Inc., for the period July 1, 19 1998 through June 30, 1999, as described in Exhibit "A." 20 21 22 23 24 25 reso 26 5/13/98 (fmk) Under the power and authority conferred upon this Council by the Charter of said City. AMENDMENT TO AGREEMENT Amendment No. 4 This Amendment No. 4 to the previous Agreement dated July 1, 1989, is made and entered into this~~day of 1998, by and between the City of Petaluma, California, hereinafter referred to as "City" and Laidlaw Transit Services, Inc., the successor to DAVE Transportation Services, Inc., hereinafter referred to as "Contractor." WITNESSETH WHEREAS, Cite and Contractor entered in?o an Agreemer.? or Jo.ly 1, 1989; for the management and operation of the City's transportation program; and WHEREAS, City and Contractor have amended said Agreement through the execution of Amendment Nos. 1, 2, and 3; and WHEREAS, City and Contractor desire to further amend the July 1, 1989 Agreement. NOW, THEREFORE, in consideration of the foregoing recitals and covenants, it is agreed that the Agreement between the City and Contractor, as amended, is further amended as follows: 1. ARTICLE 1, "Contract Term," is amended to read: The term of this Agreement shad be fiom July 1, 1998 through June 30, 1999. 2. ARTICLE 24, "Price Formula," subparagraph. (a), is amended to read: (a) Payment. of a fixed hourly rate of $35.15 per vehicle service hour during the period July 1, 1998 through June 30, 1999, which reflects no change from the price for the period July 1, .1997 through June 30, 1998. 3.
