24 City Attorney Danly recommended, under Section 54954.2(b) (2) of the Ralph M. Brown Act, that

27 CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION: Significant exposure to litigation
28 pursuant to Paragraph (2) of subdivision (3) of Section 54956.0; One potential case.

30 He noted that there was a need to take action tonight regarding some of the extensive
31 information the City had received related to the Safeway Fuel Center appeal hearing and that
32 information came to the City's attention after this past Thursday, which is the last time the
33 agenda was updated. He explained that a 2/3rds vote of the Council was necessary to add the
34 item.

City Attorney Danly recommended that with respect to Item 6.13 on the current agenda, a
motion be made to continue the item, without opening the PUBLIC HEARING, to the Monday,
October 15, 2018 Regular City Council/PCDSA Meeting to give staff the opportunity to review the
information recently received and be ready with a recommendation on that date. He
explained that since the item will come off tonight's agenda, the public may comment on
the item during GENERAL PUBLIC COMMENT, but their testimony will not go into the record.
Motion: Continue Item 6.13: Resolution Denying the Appeal and Upholding the Planning
Commission's Approval of Site Plan and Architectural Review for the Safeway Fuel Center Project
to the Monday, October 15, 2018 Regular City Council/PCDSA Meeting.
