Adjourned meeting of the Council of the City of Petaluma
called to order by Mayor McFadden.,
ROLL CALL
Present: Councilmen- Delss, Gervasoni., Jones, McNear,
Penry, Woodson, and Mayor McFadden.
Mayor McFadden addressed the meeting asking that the
hearing be conducted in an,orderly and quiet manner. He then
called on Attorney Howell to present.his case, who outlined the
history of the garbage ordinance and pursuant contracts;
reviewed the petitions and affidavits as already filed; and
presented an amended complaint which he: read and which was
ordered filed.. Attorney Howell then called his witnesses ;,
i.. e..,,Mr. E. Heyen, Mre Joseph Steiner, Mr. Tony Focha,
Mr. Percy V. Fuller, and Mr. Jack' Bone, who were duly sworn
and testified before the Council,, cross examined by
Attorney Lounibos, who represented, Mr. A. Figoni.
Four .or five additional witnesses of -t he complainant ,not
being present, Mr. Howell stated that he would rely on their
affidavit's in support of the. ' facts recited. therein.
The prosecution rested its case and Attorney Lounibos
presented his facts, and' his wi:tness;es to -wit; Mr.
Charles Meyers, City Garbage Inspector; Mr. E: ,Ricci, Manager .
of the Biltmore Conservation .C.ompany; and Mr... James Sturla,
co'- partner of A. Fi :goni, which witnesses were cross - examined
by At'torn.ey Howell.

After the closing arguments were presented by both Attorneys
the matter was taken under advisement, the Mayor Stating that
a. decision would be given at the next regular meeting of the
