HomeMy WebLinkAboutStaff Report 3.E 12/03/2018DATE: December 3, 2018 TO: Honorable Mayor and Members of the City Council through City Manager FROM: Dan ` ASCE — Director, Public Works & Utilities Diane R `mirez — Project Manager, Public Works & Utilities SUBJECT: Resolution Accepting Completion of the Petaluma Community Center Concrete Floor Slab Moisture Vapor Control Contract RECOMMENDATION It is recommended that the City Council adopt the attached Resolution Accepting Completion of the Petaluma Community Center Concrete Floor Slab Moisture Vapor Control Contract for Community Center Interior Repairs, Project No. C16201304. BACKGROUND The Community Center Interior Repairs project, C16201304, is addressing deficient interior finishes after thirty years of facility operation. This project includes replacement of the vinyl tile flooring in Meeting Rooms A -D, and Craft Rooms 1 and 2. This work required removal of the existing floor tiles containing asbestos -containing glue, application of a concrete slab moisture barrier, and installation of new vinyl flooring; each step completed through contracts with separate specialty contractors. The proposed action meets Council Goal: "Plan for and implement priority capital projects as funding permits." DISCUSSION Initially the intended approach was to remove and replace the existing vinyl composition tiles with same materials. After consulting with three flooring contractors, potential asbestos and excessive concrete slab moisture levels were identified. An independent environmental services company confirmed asbestos in the floor tile glue and that the concrete slab moisture content exceeded levels appropriate for glued -in-place vinyl floor tile. Therefore, asbestos abatement and moisture reduction were added to the project in order to complete the vinyl flooring replacement. On August 6, 2018 the City Council adopted Resolution No. 2018-132 N.C.S. awarding the contract for the Petaluma Community Center Concrete Floor Slab Moisture Control to the lowest responsive bidder, JLS Environmental Services, Inc., for $32,439.00. The final construction contract cost of $35,041.00 includes one change order for $2,602.00 for removing the track mounted room partitions from Meeting Room A -D. This additional task was not in the original scope but was needed to prevent damage to the new flooring. The contractor performed satisfactorily, there are no disputed claims and the project was completed without any significant incidents. FINANCIAL IMPACTS CIP Project C16201304 is included in the FY 18/19 budget with a budget of $388,000, funded from Transient Occupancy Taxes. There are no budget adjustment requests at this time. After the abatement of existing floor tiles, application of moisture barrier, and installation of vinyl flooring $307,217 remains to make further repairs and improvements to the building's interior. Resolution 2 Attachment 1 RESOLUTION ACCEPTING COMPLETION OF THE PETALUMA COMMUNITY CENTER CONCRETE FLOOR SLAB MOISTURE VAPOR CONTROL CONTRACT FOR COMMUNITY CENTER INTERIOR REPAIRS, PROJECT NO. C16201304 WHEREAS, in accordance with Section 68 of Article X of the City of Petaluma Charter, Section 20162 of the California Public Contract Code and other applicable law, the City of Petaluma solicited bids for the Petaluma Community Center Concrete Floor Slab Moisture Vapor Control Contract ("Project"); and WHEREAS, bids for the Project were opened on June 28, 2018, in accordance with California Public Contract Code Section 4104.5 and other applicable law; and WHEREAS, the apparent low bid for the Project was the bid of JLS Environmental Services, Inc., in the amount of $32,439.00; and WHEREAS, by Resolution No. 2018-132 adopted August 6, 2018, the City Council of the City of Petaluma found the bid of $32,439.00 for the Project to be the lowest responsive bid and awarded the Project to JLS Environmental Services, Inc., in that amount; and WHEREAS, the following change orders affecting the Project amount have been approved: Change Order Number Description Amount CCO#1 Remove hanging room partitions $2,602.00 Total Change Orders: $2,602.00; and WHEREAS, the final contract amount as amended including all change orders is $35,041.00; and WHEREAS, City staff have inspected the Project and determined that it has been completed in substantial accordance with the contract requirements subject to the Contractor's continuing warranty and other obligations pursuant to the contract; and WHEREAS, based on the foregoing, it is recommended that Council accepts the Project on behalf of the City. 3 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as follows: The contract entitled Petaluma Community Center Concrete Floor Slab Moisture Vapor Control, Project No. C16201304 with a final construction contract amount of $35,041.00 is accepted as complete subject to the Contractor's continuing warranty and other obligations pursuant to the contract. 2. The City Clerk/Recording Secretary is hereby authorized and directed to file a Notice of Completion concerning the Project with the Sonoma County Clerk's Office within ten (10) days of the date of this Resolution. 3. Staff is hereby authorized and directed to release all undisputed retention not subject to pending change orders within sixty (60) days of the date of this Resolution and in accordance with the terms of the Project contract, the Petaluma City Charter, California Public Contract Code Section 7107, and applicable law. 0
