5 THE CITY COUNCIL OF THE CITY OF PETALUMA UPHOLDS AN APPEAL
6 BY GARY BROAD OF AN APPROVAL BY THE SITE PLAN AND
7 ARCHITECTURAL REVIEW COMMITTEE (SPARC) OF SITE,
s ARCHITECTURAL, AND LANDSCAPE PLANS FORA 3,019 SQ. FT. SINGLE-
S STORY CUSTOM HOME ON A 2.74-ACRE PARCEL IN THE WESTRIDGE

15 WHEREAS, on Febniary 12, 1998, Michael Gann filed an application for Site Plan and
16 Architectural Review (SPARC) for asingle-family custom home in the Westridge Knolls
17 Subdivision, Lot 142, at 445 Black Oak Drive, APN 019-540-020; and
18
19 WHEREAS; a public notice for an administrative SPARC review was mailed to adjacent
20 property owners and residents on February 27, 1998; and
21
22 WHEREAS, the project was referred to the SPARC Committee on April 9, 1998, due to
23 neighborhood response to the notice; and
24
25 WHEREAS, SPARC continued the project to the meeting of June 11, 1998, for redesign
26 to address concerns including: l) obstruction of a view of a prominent hillside rock
27 outcropping; 2) the incompatibility of the massing of the residence with the hillside
2s setting; 3) potential for erosion and landslide impacts; aud, 4) incompatibility of proposed
29 landscaping with the native vegetation; and

3 WHEREAS, SPARC approved the revised site and architectural plans at the meeting of
a June l 1998, with conditions to: 1) relocate the residence 10 feet farther to the east,
5 providing a 40-foot setback from the western property line; 2) submit a landscape plan
6 for SPARC review and approval prior to Certificate of Occupancy and installed within
7 one-year of occupation; 3) relocate the turn-around to the eastern side of the driveway;
s and 4) revise the house plan to drop the finished floor elevation so that the finished floor
9 is no greater than two feet above the finished grade; and

I I WHEREAS, Planning staff received an appeal from Mr. Gary Broad of the SPARC
12 approval of the site and architectural plans for the proposed 3,019 sq. ft. single-story
13 custom home (with additional conditions of approval). In the appeal statement, the
i4 appellant noted his opposition to the SPARC approval based on: 1) planning staff could
15 not adequately describe the locations on the elevations that the story poles represented:
16 and 2) no grading plan was provided.

3 NOW THEREFORE, BE IT RESOLVCD that the City Council upholds Mr. Gary
4 Broad's appeal of the June Ll, 1998, SPARC approval ofthe site and architectural plans
5 for the proposed 3,019 sq. ft. single-story custom home in the Westridge Knolls
6 Subdivision; Lot 142, 445 Black Oak Drive, APN 019-540-020, and requires that the
7 house be moved down hill in a northerly direction to a mutually agreeable location to Mr.
8 Broad, the Westridge Knolls neighbors, the applicant, and planning staff. The subject
9 was to be brought back to the City Council if a resolution could not be reached within 30
I o days from the date of the City Council decision of July 20, 1998.
