HomeMy WebLinkAboutResolution 98-011 01/05/1998 Resolution No. ss-~1 NC.S. 1 of the City of Petaluma, California 3 4 SELECTING MONTGOMERY UNITED WATER FOR CONTRACT 5 NEGOTIATIONS FOR THE WASTEWATER TREATMENT 6 FACILITIES PROJECT 7 8 9 WHEREAS, the City of Petaluma issued a Request For Proposals (RFP) to five pre- 10 qualified companies for the wastewater treatment facilities project on July 18, 1996; 11 12 WHEREAS, in response to the RFP the City received proposals from Montgomery 13 United Water (MUW) and US FilterBOS (USF) on January 21, 1997; 14 15 WHEREAS, MUW and USF orally presented their proposals to the Petaluma City 16 Council on September 8, 1997; 17 18 WHEREAS, the Petaluma City Council considered City Staff's evaluation of the 19 proposals presented in a Staff Report dated September 8, 1997 and orally presented to the 20 Council on September 22, 1997; 21 22 WHEREAS, the Petaluma City Council considered the Citizens' Wastewater Advisory 23 Committee's evaluation of the proposals presented in memorandums dated July 2, 1997, 24 September 22, 1997, and December 3, 1997 and orally presented to the Council on 25 September 22, 1997; 26 27 WHEREAS, the Petaluma City Council considered the proposals on September 29, 28 1997, at a Joint Study Session on December 8, 1997, and at a regulu~ Council meeting on 29 December I5, 1997; 30 c:AcirycounV1998\resoA010598.doc Page 1 Of 3 Res. N.QS. 1 WHEREAS, the City will be conducting an evaluation of the privatization project in 2 accordance with the Local Government Privatization Act of 1985; 3 4 WHEREAS, the Petaluma City Council determined the proposal submitted by MUW to 5 be more detailed and responsive; 6 7 WHEREAS, the Petahima City Council determined the long financial history of United 8 Water Resources, the parent company for MUW, to be more beneficial; 9 10 WHEREAS, the Petaluma City Council determined the qualifications and experience of 1 I MUW's staff to be more beneficial; 12 13 WHEREAS, the Petaluma City Council determined that MUW represented thesuperior 14 choice for other reasons in addition to those stated above; 15 16 NOW THEREFORE BE IT RESOLVED by the Petaluma City Council that 17 Montgomery United Water is selected for the purpose of conducting contract negotiations 18 for the wastewater treatment facilities project; 19 20 BE IT FURTHER RESOLVED by the Petaluma City Council that contract termsto be 21 negotiated with Montgomery United Water shall include, among others, the following: 22 23 1. MUW shall lower its price to beat or meet the price proposed by USF or 24 provide thorough and defensiblejustification for the price difference. 25 2. MUW shall provide liners for the equalization and biolac basins if they are at 26 any time required by the California Regional Water Quality Control Board at 27 no additional cost to the City. 28 3. MU W's treatment system shall meet the performance criteria specified in the 29 REP, and in particular the requirements specified for compliance with Title c:~cuyamnv 99Akcso~o los9s.doc Reso. 98-ll NCS Page 2 of 3 1 22, permit requirements for discharge of treated effluent, and the requirements 2 of the envirolunentaP impact report. 3 4. If the proposed plans for mitigating raw sewage and biosolids odors arenot 4 effective, MUW shall implement contingent plans at no additional cost to the 5 City. 6 5. If the proposed plans for maintenance of the equalization basins and control of 7 vectors and odor are not effective, MUW shall implement contingent plans at 8 no additional cost to the City. 9 6. MUW shall propose and implement a plan to prevent material from entering ] 0 the water reclamation and irrigation systems that my cause damage to 1 I downstream irrigation facilities such as pumps, piping, pipe appurtenances 12 and sprinkler equipment. 13 14 BF IT FURTHER RESOLVED by the Petaluma City Council that should conhact 15 negotiations with Montgomery United Water not reach a successful conclusion for any 16 reason, that the City may, at its own discretion, enter into contract negotiations with US 17 Filter/EOS for the wastewater treatment facilities project or prtrsue an alternate strategy 18 for procurement of a new wastewater treatment facility. Under the power and authority conferred upon this Council by the Charter of said City.
