REPORT OF OFFICERS r The City Clerk presented. the affidavit of the 'Petaluma daily Courier for the publ.iCati.on of " Notice of the time and place of hearing of appeal ini matter of the work and improvement of Walnut, Street. " 1 NEW BUSINESS. In the matter of the appeal from th,e 'assesment by th.e superintendent of Streets for the improv-iment of Walnut Street from the Northerly line of Prospect Street to the Southerly line of Galland Street, Me,ssers Haskell & Cromwell. appeared for the appellants, Ute app &llarts argued that there is a strip of land ten feet in width along.th westerly side of alnut, which iz a port -ion of the street, and which strip has not been improved in any manner by the c,ontractor. Appellants introducted in evidence their title deeds of their respective, lots which are sought to be assessed to pay for the improvements. The deed of Elba r". Smith was read showing ghat property 1 *. is a portion of lot number 458 according to the offical map of Petaluma, made by Jas.. T. Stratton.. U.S. Leputy Surveyor General for the State of California, fronting 53 feet on the westerly side of Walnut Street. The deed of F.A:Cromwe:ll was read showing that his property is a portion_-.of I-ot,- 54.9,.acc.arding to Stratton's official map of 41' Petaluma, and also a portion of lot 1 in Block 5 of Che rry Iii 11 audition according to a. map there.of made by °N.V.Smyth on file in the office of the County Recorder of '.Sonoma. County, fronting '50 ft on the westerly line of Walnut Street, e -nd wattend ng back 130 feet along the Southwesterly line of Kent ,Street. The deed of A:.M.Smith was read sh�ocring that his property is a portion of lot nmmb:er 550 according to. Stratton map of Petaluma fronting 50 ft on the Westerly line of Walnut Street, and extending back along the line of Dent Street 150 feet. The deed of Chas.J.Feliz was read shoving that his property is a portion of Lot 549 accor--ing to Stratton map of Petaluma, fronting fifty feet on the.Ne.ster.ly line of Walnut Street, an! extendin back 130 feet. Appe.11amts introducted in, evil.ance the assess-men - t and the digram of the lot <s and portions of lots assessed to pay for said improvements. Appellants contended that the diagram is incorrect in that it does not correctly show the dimensions of their lots as. shown by their title deeds, but `that the diagram shows their lots•to be ten feet deeper, in each instance than the ' lots really are, and that the diagram includes as portion-of each of t1 lots the tin foot strip which appellants contend is a port -ion of the street and should not have been included in the diagram as a portion of appellants lots Lippitt & Lippitt appeared for the Cont. ra.etors and asked that the Council deny the appeal, Claiming that the matter shoul�: be left to the Courts for decision., The Council took no. action at this time taking the matter under advisement. Street to the Nor' -th line of "I'Street be and the same is hereby revoked and .rescinded, under the power and authority conferred upon this Council By the Charter of said City. Be it resolved that Ordinance No 67 C.S. be and the same is hereby adopted. An Ordinance directing the purchase of a. moter equipped triple.combination pump, chemicel, and hose apparatus. Under the power conferred upon this Council by the Charter of said City. H. S. Goss'a.ge Seconded by W.C.Stradling. Mz°. 01eel'a'td, addressed the Council in reference to the a Broadway Street sewer stating that in his opcnion it was not necessary to put in a that a lamp hole would answer the purpose and be less expensive. but as the street cor•Y;ittee and the Ct;y­Engi,neer had r.ecomended that the contractor putt° in a manhole, the matter was discussed but no action at this t'i -nee was taken, ADJOURNMENT.
