HomeMy WebLinkAboutResolution 2007-161 N.C.S. 09/10/2007 Resolution No. 2007-161 N.C.S. of the City of Petaluma, California AUTHORIZING DEVELOPMENT OF A COMMUNITY GARDEN AT LA TERCERA PARK AND USE OF SPECIFIED CITY LABOR AND MATERIALS AND DIRECTING STAFF TO DEVELOP AND EXECUTE AN APPROPRIATE USE AGREEMENT WITH PETALUMA BOUNTY ANI)/OR COMMUNITY VOLUNTEERS WHEREAS, Petaluma BOUNTY proposes the creation of a community garden at La Tercera Park in partnership with members of La Tercera neighborhood, the City of Petaluma, and community volunteers; and, WHEREAS, after a series of neighborhood and planning meetings, a location for the development of the garden within the site has been identified; and, WHEREAS, many of the neighbors of La Tercera park are in favor of the proposal and the positive aspects of developing a garden which adds to the quality of life, and could result in reduced expenditures for vandalism repairs and park clean up; and, WHEREAS, the Recreation, Music, and Parks Commission after considering the proposal on June 20 and on August 15, 2007 unanimously approved the proposal and recommends that the City Council approve the project. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma: 1. Approves the proposal of Petaluma BOUNTY for the development of a community garden at La Tercera Park in the approximate size and configuration shown on the diagram in Exhibit A attached hereto and incorporated herein by reference, in cooperation with members of the La Tercera neighborhood and community volunteers, except that no minimum period of use is approved or guaranteed by City; and, Resolution No. 2007-161 N.C.S. Page 1 2. Authorizes City staff to provide acurb-cut and driveway for access to the garden from Acapulco Court, place fence posts or bollards along the garden frontage along Acapulco Court as deemed necessary by City and reconfigure the existing irrigation system, all in the approximate amount. of $1400 for materials and 8 hours, more or less or labor by City personnel; and, 3. Directs City staff to develop and authorizes the City Manager to execute an appropriate use agreement with Petaluma BOUNTY and/or Community Volunteers, subject to the approval of the City Manager, City Attorney, Risk Manager and Director of Parks & Recreation.
