1 RESOLUTION AUTHORIZING THE CITY MANAGER TO WAIVE BUILDING PERMIT FEES FOR
2 THE REPAIR OF RESIDENTIAL, COMMERCIAL AND INDUSTRIAL BUILDINGS WHICH WERE
3 DAMAGED DUE TO THE SEVERE WINTER STORMS AND FLOODING BEGINNING
4 FEBRUARY 2, 1998 AND CONTINUING
5
6 WHEREAS, starting on February 2, 1998 sever winter storms caused flooding of the Petaluma River and
7 creeks in the City, and;
8
9 WHEREAS, on February 2, 1998, the City Manager, pursuant to section 2.32.060 of the Petaluma Municipal
0 Code, declared a state of local emergency and activated the Emergency Operations Center, and;

2 WHEREAS, on February 4, 1998, a state of emergencywas proclaimed by the Governor for Sonoma and
3 othercounties, and;

5 y~~IIEREAS; on February 9, 1998, the President declared Sonoma and other counties disaster areas (FEMA-
6 1203-DR) and therefore eligible for disaster relief under the Robert Stafford Disaster Relief and Emergency
7 Assistance Act, P.L. 93-288, as amended, and;
8
9 WHEREAS, the President has authorized the Federal Emergency Management Agency (FEMA) to provide
0 aid to damaged residents, property owners and business owners in grants or low-interest loans, and;

2 WHEREAS, certain homes and businesses were damaged by the flood waters from the severe winter storms
3 starting February 2nd and continuing and;
4
5 WHEREAS, in the process of repairing the damages to the building structure, property owners are required to
6 obtain certain building permits to insure that the repair work is completed to applicable building code
7 standards, and;
8
9 NOW, THEREFORE, BE IT RESOLVED, that any applicable plan check, building permit or other fees
0 typically charged by the City for permits to repair damages to building structures caused by the severe winter
1 storms and flooding disaster, designated as FEMA-1203-DR from February 2, 1998 and continuing, are
2 authoiized to be waived by the City Manager, or designee. This waiver shal] be applicable for the period
3 covered by the Federal disaster declaration.
