ORDINANCE NO. 378 N.C.S.

AN ORDINANCE PROVIDING FOR THE SALE OF
PROPERTY KNOWN AS THE OLD McKINLEY SCHOOL
AT THE CORNER OF WASHINGTON AND VALLEJO
STREETS TO THE HIGHEST BIDDER SATISFACTORY
TO THE CITY COUNCIL; AND PROVIDING THAT
THE PROCEEDS FROM THE SALE OF SAID PROPERTY
SHALL BE DEPOSITED IN THE GENERAL FUND.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS:
Section 1. That the City of Petaluma shall sell
for a: price offered by the highest bidder, if satisfactory to the
Council, the property. Down as the old McKinley School, located
at the corner of Washington and Vallejo Streets, and particularly
described as follows, to wit:
"All that certain real property situate, lying and
being in the City of Petaluma, County of Sonoma, State
of California, bounded and described as follows;
Parcel One
Beginning at the most westerly corner of Wash -
ington and Vallejo Streets in East Petaluma and running
thence northwesterly on Vallejo Street 190 feet, thence
southwesterly and at right angles to Vallejo Street
189 feet to the corner of Learyts lot, thence south-
easterly on Leary's line 190 feet to Washington Street;
thence northeasterly along Washington Street 189 feet
to place of beginning, being the same piece of land
designated as Lot Five (5) in Block 31 on Harmon's Map
of East Petaluma recorded in Book 7 of Deeds, of Sonoma
County Records, and also the same piece of land desig-
nated as Lot 5 in Block 33 of Eliason!.s-- 1ilap. of the City
of Petaluma and on Bowers I41ap of Sonoma County.

cribed upon Harmon's IMap of East Petaluma, as recorded
in Book 7 of Deeds of Sonoma County Records?

. Section 2 . That the City Clerk be and she is hereby
authorized and directed to cause a notice to be published once
in the official newspaper of the City, inviting offers for the
purchase of said property, referred to in Section 1 hereof, for
a price to be specified in sealed bids, payable in cash upon
issuance of title insurance, the said title insurance to be
paid for by the successful bidder, such bids to be sealed and
filed in the office of the City Clerk at a time and place,
specified in said notice, when the said bids shall be opened
and read at the meeting of the City Council. Said notice shall
specify that bids may be presented directly by prospective
purchaser's or by or through licensed real estate brokers. If
submitted by or through a real estate broker, the bid shall
specify the amount to be paid by the City as a commission for
procuring such bid, and no commission will be-paid by the City
unless the successful bid specifies the amount of such commis-
sion. Said notice shall also require each bidder to accompany
his bid with a certified check in an amount equal to five per
cent (5 %) of the amount of the bid, to be forfeited to the
City upon failure of the bidder to complete the purchase of
said property specified in said bid. Said notice shall pro-
vide that the Council may reject any and all bids and waive any
informalities.
Section 3 . That the proceeds from the sale of said
property authorized hereunder shall be deposited in the General
Fund for such municipal purposes as the Council shall determine.
Ordered posted this 17th day of January, 1955.

I `hereby certify that the within ordinance was posted in one
public ,place in the City of Petaluma, to-wit: In front of the
City Hall on the 1Sth day of January, 1955.
I ,hereby certify that the whole number of members of the
Council of the City of Petaluma is seven, and that the foregoing
ordinance was passed by the Council at its meeting of the 24th day
of January, 1955, by the following vote, to -wit:
AYES: * Councilmen Adams, Bigelow, Brown, Gustafson, Norwood,
Schwobeda, and Mayor Schoeningh.
NOES: None.
