Summary Statement: Ghilotti Brothers, Inc. completed Phase I of the Petaluma Downtown

The Project consisted of installation of historic streetlights, cut outs for street trees, sewer upgrades, a water
main on Kentucky and laterals for future fire sprinkler connections. Work also included street resurfacing
on Petaluma Boulevard and Western, reconfiguration of the corners, bulb outs at B Street and Petaluma
Boulevard and the installation of flashing crosswalks at Putnam Plaza and at 24 Hour Club. In addition,
the PCDC authorized additional streetlights and electrical outlets in tree wells on Petaluma Boulevard as
well as implemented material and scope of work changes requested by the Water Resources &
Conservation Department.
Due to construction in the historic downtown, many unforeseen conditions were encountered during
construction of the water main, which contributed to the increase in costs, and extension of the construction
time.
Recommended PCDC Action/SuLmested Motion:
Adopt a resolution accepting the completion of Petaluma Downtown Improvements Phase 1, Project No.
C200603 and file a Notice of Completion with Sonoma County Recorder. The Finance Department will
release the 10% retention to the contractor 45 days after the recordation of the Notice of Completion.

DISCUSSION AND ACTION ADOPTING A RESOLUTION ACCEPTING COMPLETION OF THE
GHILOTTI BROTHERS, INC. CONSTRUCTION PETALUMA DOWNTOWN IMPROVEMENTS
PHASE I CONTRACT, PROJECT NO. 3300-54151-C200603
1. EXECUTIVE SUMMARY:
Ghilotti Brothers, Inc. completed Phase I of the Petaluma Downtown Improvements Phase I for a final
cost of $2,421,407.
The Project consisted of installation of historic streetlights, cut outs for street trees, sewer upgrades, a
water main on Kentucky and laterals for future fire sprinkler connections. Work also included street
resurfacing on Petaluma Boulevard and Western, reconfiguration of the corners, bulb outs at B Street

2. BACKGROUND:
Petaluma has a long history and tradition as a working river town. Its Victorian iron -front buildings
have seen the transition from an agricultural center to boutique destination. The CBD Streetscape
Master Plan enhances the distinct historic character of the downtown by highlighting and promoting
historic design elements such as streetlights and street furnishings. This project implements these
improvements.
Additionally, the Fire Department and Water Resources & Conservation Department expressed interest
in improving the water infrastructure in the area to enhance fire protective services for buildings
adjacent to these streets for the historic downtown. The City building codes require new buildings be
constructed with sprinkler systems for fire suppression. However, there are many older buildings,
particularly in the downtown area, that do not have sprinkler systems. The need for these buildings to
be protected from fire by sprinkler systems was made apparent by the recent fire that destroyed the
Buona Sera Restaurant and several other businesses downtown. To further protect these buildings from
the potential damages associated with a fire, the buildings are now required to be retrofitted with
sprinkler systems, which requires water lines be installed in the project area. By constructing the water
line on Kentucky Street as part of this project, the building owners now have a water line to connect to
when they retrofit their buildings with sprinklers. The new water lines will also provide a better
distribution main grid to serve downtown redevelopment in the Central Petaluma Specific Plan area.
During the course of construction, the scope of work was modified for scheduling reasons and to insure
economic viability. The duration of the work of the Downtown Improvements Phase I project on
Kentucky took longer than anticipated due to the interference of previously unknown underground
utilities. This extension meant that there would have been construction on both Petaluma Boulevard and
Water Street between Washington and Western at the same time. For this reason, the water main on
Petaluma Boulevard was deleted. Other items of work were also added and deleted to accommodate the
construction schedule of other City projects.
The contractor has completed the work for a final construction cost of $2,421,407. The 10% retention
payment is due and payable 45 days after the City Clerk records the Notice of Completion.
The contractor, Ghilotti Brothers, Inc.(GBI), in their final payment request, is seeking approximately
$300,000 in excess of payments authorized by staff. GBI's correspondence suggests they are preparing
to submit claims totaling this amount. Staff is working with the PCDC attorney's who have advised that
the matters be separated, with the potential claims brought to PCDC at a future date, if necessary.
3. ALTERNATIVES:
Accept the completion of the project.
4. FINANCIAL IMPACTS:
The FY 02-03 through FY 04-05 PCDC Budget appropriated $8,818,000 for the Petaluma Downtown
Improvements Project, including the work in this package plus purchasing streetlights, trees and street
furniture, work in the Streetscape Package, all work in Phase II, the Wayfinding Signage project, as well
as all design, construction management, administration and general overhead for all phases. Subsequent
enhancements requested by the Fire Department and Water Resources required waterlines to support
downtown sprinklers and minor water line and sewer line repairs within the project area. These fire,
water and sewer service enhancements,' funded by the Department of Water Resources and
Conservation, cost $781,587.

5. CONCLUSION:
Following the acceptance of the project, the City Clerk will file a notice of completion with Sonoma
County Recorder and the Finance Department will release the 10% retention to the contractor 45 days
after the recordation of the notice of completion.
6. OUTCOMES OR PERFORMANCE MEASUREMENTS THAT WILL IDENTIFY SUCCESS OR COMPLETION:
Completion of the Petaluma Downtown Improvements Phase I project C200603.
7. RECOMMENDATION:
Adopt the resolution approving the completion of the Petaluma Downtown Improvements Phase I,
Project # C200603 and authorize the release of the 10% retention to the contractor 45 days aftef the
recordation of the Notice of Completion.

ACCEPTING COMPLETION OF THE GHILOTTI BROTHERS, INC. CONSTRUCTION
PETALUMA DOWNTOWN IMPROVEMENTS PHASE I CONTRACT,
PROJECT NO. 3300-54151-C200603
WHEREAS, the Petaluma Community Development Commission (PCDC) awarded the contract for the
Petaluma Downtown Improvements Phase I, to Ghilotti Brothers, Inc. on August 25, 2003; and
WHEREAS, Ghilotti Brothers, Inc. has completed all the work at a total value of $2,421,407 to the satisfaction
of the Director of Economic Development and Redevelopment and the Redevelopment inspection team;
NOW, THEREFORE, BE IT RESOLVED by the Petaluma Community Development Commission that the
City Clerk/Recording Secretary is hereby authorized to sign the Notice of Completion.
BE IT FURTHER RESOLVED that the Finance Department is hereby authorized to release the ten (10%) to
Ghilotti Brothers, Inc. forty five (45) days after the recordation of the Notice of Completion provided that all
stop notices have been released.
