AN ORDINANCE APPROVING AN-
NEXATION OF UNINHABITED
TERRITORY KNOWN AS "NOVAK
ANNEXATION NO. 3" TO THE
CITY OF PETALUMA, CALIFOR-
NIA.
BE IT ORDAINED BY THE COUN-
CIL OF THE CITY OF PETALUMA
AS FOLLOWS:
Section 1. That the City Council
hereby finds that on the 25th day
of May, 1955, The Sonoma County
Abstract Bureau, a corporation, filed
with the City Council .their petition
requesting annexation of the territory
herein described to be included in
the City of Petaluma and that said
corporation mentioned above are, and
is now, the owner of all said prop-
erty, and all thereof is and was un-
inhabited.
Section 2. That prior to filing said
petition for annexation, the Boundary
Commission of the County of Sonoma;
California, approved said petition with
r:spect to the definiteness and cer-
t dnty of the proposed boundaries
shown in said description and the
map thereof submitted to said Com-
i_::ssion:
Section 3. On June 6, 1955, the City
Council adopted Resolution No. 1497
N. C. S. entitled, "Resolution Pro.
posing Annexation of Property to be
known as `Novak Annexation No.
3' ", wherein it resolved that it was
proposed that the property hereinafter
described be annexed to the City
of Petaluma that the City Clerk cause
a copy of said resolution to be pub-
lished in the Petaluma Argus- Courier,
a newspaper of general circulation,
published in this City, at least twice,
but not oftener than once a week, and
also cause a copy of said resolution
to be published in the Press Demo-
crat, a newspaper published outside
of the City, but in the County of So-
noma, and that said publication shall'
be completed at least twenty (20)
days prior to the date set for hearing
said petition.
Section 4. That. said Sonoma Coun.
ty Abstract Bureau, a corporation, has
filed with the City Council their
agreement and consent that said ter-
ritory to be °annexed may be taxed
its proportionate share to pay any in-
debtedness or liability of the City of
Petaluma contracted prior to or exist -
ing at the time of annexation.
Section '5. That the City Clerk of the
City of Petaluma caused a written
notice of said property annexation to
be mailed to each person to whom
land within the territory proposed to
be annexed is. assessed, in the last
equalized County assessment roll
available on the date the proceedings
were initiated, at the address shown
on said assessment roll or as known
to said clerk, and to any. person who
has filed his name and. address and
the designation of the lands in which
he has any interest, whether legal
or equitable, with said clerk.
Section 6. That at the time and
place set for hearing protests, namely,
on the 5th day of July, 1955, at the
hour of 7:30 o'clock p. m. in the Coun-
cil Chambers in the new City Hall,
Petaluma, California, said hearing was
held, and no protests to said annex-
ation were filed and no person ap-
peared at said hall to protest annex-
ation.
Section 7. That all of the provisions
of the Annexation of the Uninhabited
Territory Act of 1939 have been com-
plied with, and the Council hereby
approves the annexation to the City
of the property referred to and de-
scribed in said petition and known
as, "Novak Annexation No. 3 ", to the
City of Petaluma, which said pro-
posed annexation to the City, pursuant
to said procedure and in this. ordi
nance, is situated in the County of
Sonoma, State of California, and the
boundaries thereof are described as
follows, to wit:
PARCEL ONE:
Being a portion of, Lots 214 and
218 of Row's Survey of the Petaluma
Rancho as recorded in' Book 21 'of
Maps, page 1,•. Sonoma County .Rec-
ords, and being._more: particularly. de -.
scribed_ as follows:
Begining at - the point of intersec-
tion of the Southeasterly line :of East
Washington ':Street with the South-
westerly line 5f- McDowell Road (some-
times referred'to as McDowell Lane),
said point bears North 54' 31' 30"
West 455139 feet --from the most North-
erly corner .of, McDowell Village Sub-
division No. 1' - as recorded in Book
66 of Maps, pages 25 and 26, Sonoma
County . Records; thence from said
point of beginning and along the
Southwesterly line of McDowell Road
North 54° 31' 30" West 1138.88 feet;
thence' leaving said line and- crossing
said road and along the Southeasterly
line of. the land of the California
Water Service Company as recorded
in Book 201 of Official Records, page
195, Sonoma County Records, North
35°' 23' 20" East 1688.69 feet to the di-
vision line between Lots 218 and 225
of said Petaluma Rancho; thence
South 54° 37' 10" East along said di-
vision line and along the lands con -
veyed to James F. Jerome and wife
by Deed recorded September 6, 1947
in Book 757 of Official Records, page
37, Sonoma County Records, a distance
of 1085.11 feet to the Northwesterly
line of East Washington Street;
thence along said line South 35° 36'
West 1610.48 feet to the Northeasterly
line of McDowell Road; thence along
said line South 54° 31' 30" East 60.00
feet to the Southeasterly line of East
Washington Street; thence along said
line South 35' 36' West 80.00 feet to
the point of beginning, containing
42.18 acres.
PARCEL TWO:
Being a portion of Lot 213 of Rowe's
Survey of the Petaluma Rancho as re-
ferred to above in Parcel I and being
more particularly described as fol-

Beginning at the point of begin -
ning of the above described Parcel I;
thence South 54° 31' 30" East along
McDowell Road 120.00 feet; thence
leaving said Road South 36' 08' 30"
West 120.00 feet; thence North 54°
'1' 30" West 120:00 feet to East Wash-
ington Street;; thence along East
Washington Street .North 36° 08' 30"
East 120.00 feet to the point of begin-
ning, containing 0.33 acres.
Section 8. That upon the effective
rlat of this ordinance the City Clerk
shall immediately prepare, under seal,
a certified copy of this ordinance,
giving thA date of its passage, and
transmit it to the Secretary of State.
Section 9. That upon the effective
riate of this ordinance or immediately
thereafter the City Clerk shall, pur-
suant to Chapter 8 of Title 5, Division
2, Part 1 of the Government Code,
file a certified copy of this ordinance
and a map or plat describing the
boundaries of said annexation ordered
berein with the County Assessor of
Sonoma County, and with the State
Bo of „Equalization.
ge6tion 10. That, pursuant to the re-
rnirements of Article 3, Chapter 1,
Division 1 of Title 4 -of the Govern -
-ent. Code, the City- shall file with
the Recorder of Sonoma County, one
affidavit stating that all requirements
rf law nertainin,g to the annexation
proceedings herein have been com-
pleted, such affidavit to be accom-
nanied by a certified copy of the
1, 6und?ry description as set forth in
this ordinance and by a map delin-
eating the boundaries of said annexed
property.

Council of the City of Petaluma is seven, and that the fore-
going ordinance was passed by the Council at its meeting of the
11th day of July, 1955, by the following vote, to'Irit:
