AN ORDINANCE PROVIDING FOR THE RECONSTRUCTION OF,
UPHAM STREET BETWEEN WESTERN . AND ENGLISH
STREET, A,.-PORTION, OF COS. OF WHICH SHALL BE
PAID BY THE PETALUMA CO- OPERATIVE CREAMERY PUR-
SUANT TOz CONTRACT; APPROVING THE PLANS AND
SPECTFICATI.ONS OF SAID WORK; PROVIDING THAT THE
CITY'S SHARE OF THE COST SHALL BE PAID FROM THE
GE NERAL FUND; AND DETERMINING. THAT

PE 'IT :ORDAINED BY THE COUNCIL OF. THE CITY OF PETALUMA AS FOLLOWS:
Section 1. L- That' the .City of .Petaluma cause Upham Street
to be reconstructed between: Western Avenue and English Street with
materials, to the grade and in the manner set .forth and described
In those certain plans and specifications for said project, entitled:
(1) "Upham Street Reconstruction Western Ave. to English St. — Unit
No. 1 ", and (2) "'Upham Street reconstruction Western Ave. to English
St. - Unit No.. 2 filed with the City Clerk on October 1 1955.
Section.2.. That all of said work shall be done and com-
pleted :by contracts awarded to the lowest responsible bidder or
bidders after advertising' same in -the manner, form and for the
period•requred'by the City Charter,
Section 3. That pursuant to Section 1770 of the Labor
Code,.the City Council has ascertained that the general prevailing
rate of wages for -the work to :be done hereunder as forth in the
following schedule :

Laborers
All- classifications omitted herein to be paid not less
than 2.175 per hour. Eight hours shall constitute'a
working day. All workmen shall be paid time- and -one-
half for over- time,.and double time on holidays.
Section 4e That Unit. No. 1 of said pro be commenced
as soon as possible after compliance with the provisions of the City
Charter respecting awarding of contract after advertising for bids.
That Unit No. 2 of said work be commenced after the winger rains and
in the spring of 1956 as determined by the City Engi neer,, and after
the awarding of contract for said work by the City Council after
advertising for bids in the manner, form and for he period required
by the City Charter.
Section 5. That this City enter into a contract covering
the completion of all of the work authorized by this ordinance with
.the Petaluma Co- operative Creamery, the owner of the property adjoin-
ing said street on the southwesterly side thereof,, which.contract
shall provide that said Petaluma Co- operative Creamery shall pay to
the City one -half ( 2) of-the cost of all of said work, but not to..,
exceed the sum of four thousand two hundred fifty dollars ($4,250.00),
That such payment shall be due.and payable to the City upon the
acceptance and approval of the City Council of the completion of all
of said work, and " that the Cityt s share of said costs shall be paid from
the General Fund.
Section 6. This ordinance is required for the immediate
preservation of the public peace, health and safety of the City of
Petaluma for the reason that the work provided for under Unit No. 1
thereof should be commenced as promptly as possible in order that
the same shall not be delayed by reason of early rains, and in order
to eliminate traffic hazards now existing at the site of said pro -
posed work. For.said reasons this ordinance shall go into effect
immediately upon passage by unanimous vote of the.members of the
Council present at the time of its adoption.
