AN ORDINANCE AMENDING THE
BUSINESS LICENSE ORDINANCE
NO. 373 N. C. S.
BE IT ORDAINED BY THE COUN-
CIL OF THE CITY OF PETALUMA
AS FOLLOWS:
Section 1. That Section 4.3 of the
Business License Ordinance No. 373
N. C. S. be and the same is hereby
amended to read as.follows:
"Section 4.3 AVERAGE NUMBER
OF EMPLOYEES. In determining the
number of employees for the pur-
pose of fixing the license due under
this Ordinance, the employer shall
take the number of employees earn-
ing wages during pay periods ending
nearest the 15th nay of each month
as shown by Form 'DE3 of the State
of California Department of Employ-
ment, or other form which may here-
after be adopted for reporting pay
ments due under the Unemployment
Insurance Act, together with the em-
ployer himself or employers them-
selves, for each month of the pre-
vious calender year, adding the ,same,
and dividing by twelve; if the em-
ployer has been in business less than
one year, he may use the average
number of employees as shown by
said form for the last quarter; if the
employer has not previously engaged
in business, he may estimate the av-
erage number of employees who will
be employed by him during the re-
mainder of the calendar year."
Section 2. That Section 8.1 of said
Business License Ordinance No. 373
N. C. S. be and the same is hereby,
amended to read as follows:
"Section 8.1 EXEMPT LICENSES.
No license payable hereunder shall
be payable by:
(a) Any charitable• institution, or-
ganization or association, organized
for charitable purposes and selling
merchandise or services or conduct-
ing or staging for charitable purposes
only, any concert, exhibition, lecture
or entertainment within the City of
Petaluma where no admission is
charged or A =here the receipts from
adiission charged are used exclusive-
ly for charitable or benevolent pur-
poses and no 'part thereof is used
for the purpose of private gain of
any individual.
(b) Any organization conducting or
staging any concert; exhibition, lec-
ture or entertainment, where the
procee m
ds from admissions charged
are used for the furtherance of edu-
cation, art or nn;sic within the City
of Petaluma and where no part of
the profits der ? -ved therefrom is used
for the purpose of. private gain of
any individual.
(c) No license for street vending,
entertaining or house-to-house selling
shall be payable by any blind per-
son or indigent person who by real
son of the infirmities of age, loss of
limb or other disabling cause is un-
able to obtain livelihood by other
means than such street vending or
entertaining or house -to -house sell-
ing. The - exemption .granted hereun-
der shall not exceed two (2) days in
any one month, and shall only be
granted after the Chief of Police has
satisfied himself that the applicant
for such exemption has qualified
therefor.
(d) Any person, firm or corporation
whose total net income for the pre-
ceding year, and whose estimated net
income for the ensuing year shall be
less than $500.00, provided such per-
son, firm or corporation can produce
proof satisfactory to the Tax Collec-
tor that said net income for said
preceding year was less than $500.00
and said estimated net income for
said ensuing year will be less than
$500.00:"
Section 3. That Section 12.3 of the
Business License Ordinance No. 373
N. C. S. be and the same is hereby
amended to.•read'as follows:

LISTED,IN, THIS SECTION AND'ANY
PROFESSIONAL OR SEMI PROFES-
SIONAL PERSONS NOT OTHER-
WISE MENTIONED IN THIS ORDI-
NANCE. An annual license tax in the
-sum, of $30:00 shall be paid, in ad-
vance "for each person, or in - case of
a firm $30.00, in advance, for -each
practicing member of, the profession,
engaged in the following professions
and vocations in the City of Peta-
auma, plus $4.00 for each employee
employed by such person or firm:
Architect, attorney, advertising
counsel, bacteriologist, chemist, chir-
opodist, chiropractor, civil engineer,
electrical engineer, mining engineer,
construction engineer, structural en-
gineer; consulting engineer; mechan-
ical engineer hydraulic engineer, den-
tilt., draftsman, drugless practitioner,
electrologist, engraver, geologist, land-
scape architect, masseur, mortician,
occulist, optician, optometrist, osteo-
path, physician, surgeon, surveyor,
taxidermist, veterinarian, X -ray lab-
oratory and any profession or semi -
prcfession not otherwise classified
under this Ordinance."
Section 4. That Section 12.4.14 of
the Business License Ordinance No.
373 N. C. S. be and the same is here-
by amended to read as follows:
"Section 12.4.14 CHRISTMAS TREE
AND IIREWORKS VENDORS. $20.00
per nnonth per person."
Section 5. That Section 12.4.21 of
the Business License Ordinance No.
373 N. C. S. be and the same is here-
by amended to read as follows:
"Section 12:4.21 JUNK COLLEC-
TORS AND DEALERS. For persons
having no fixed place of business
within the City, $50:00 per year for
first vehicle, plus $30.00 per year
for each additional vehicle.
For persons having a fixed place
of bvsiness in the City, $25.00 per
vN ^r '..or first vehicle and $10.00 per
for each additional vehicle."
"; 6. That Section 1.2.4.34 of
said Business License Ordinance No.

by amended to read as follows:
12.4.34 VENDING MA-
CHINES (this tax does not apply to
any person operating a vending ma-
chin^ or machines as an incident of
any business licensed under this or-
dinance.)
$1..00 per year for each machine
requiring one cent (1c) to operate,
$2.00 per year for each machine
requiring five cents (5c) to operate,
$4.00 per year for each machine
requiring ten cents (10c) to - operate.
$6.00 per year for each machine
requiring more than ten cents (100
to operate."
Section 7. That Section 12,5.7 of
said Business License Ordinance No.
373 N: C. S. be and the same is here-
by amended to read as follows:
"Section 1.2.5.7 CARNIVAL. $100.00
for the first day, and $75.00 for each
succeeding day thereafter."
Section 8. That this amendment to
said Business License Ordinance No._
373 N. C. S. shall go into effect on the
Ist'clay of January, 1956.
