ADAMS AN ORDINANCE APPROVING AN- NEXATION OF UNINHABITED TERRITORY KNOWN AS "BEN WOODWORTH ANNEXATION" TO THE CITY OF PETALUMA, CAL- IFORNIA. BE IT ORDAINED BY THE COUN- CIL OF THE CITY OF PETALUMA AS FOLLOWS: Section 1. That the City Council hereby finds that on the 18th day of October, 1955, Ben M. Woodworth, Elmer Krulevitch and Bernice Kru- levitch, his wife, and Alter Kru- levitch and Rose Krulevitch, his wife, filed with the City Council their petiticn requesting annexation of the territory herein described to be -in- cluded in the City of Petaluma and that said persons mentioned above were e and are now the owners of all o said property, and all thereof is and was uninhabited. Section 2. That prior to filing said petition for annexation, the Boun- dary Commission 'of the County of Sonoma, California, approved said petition with respect to the definite- ness and certainty of the proposed houndaries shown in said description ;and. the man thereof submitted to said Commission. Section 3. On November 7, 1955, the City Council adopted Resolution No. 1.579 N. C. S. entitled, " Resolution Proposing Annexation of Uninhabited Territory to the City of Petaluma to be Known as `Ben Woodworth An- nexation"', wherein it resolved that i was proposed that the property hereinafter described be annexed to the City of Petaluma; that the City Clerk cause a copy of said resolution to be published in the Petaluma Ar, ^us. Courier, a newspaper of gen- , ral circulation, published in this City, at least twice, but not oftener than once a week, and also cause a copy. of said resolution to be pub- in the Press Democrat, a news - p97)er published outside of the City, rut in the County of Sonoma, and that said publication shall be Com- nieted at least twenty (20) days prior r.., the date set for hearing said petition.. Suction 4. That said Ben M. Wood - wcrth, Elmer Krulevitch and Bernice Krulevitch, his wife, and Alter Kru- levitch and Rose Krulevitch, his wife, have filed with the City Council their agreement and consent that said ter- ritory to be annexed may be taxed its. propnrtionate share to pay any in- (lebtedness or liability of the City of Petaluma contracted prior to or ex- isting at the time of annexation. Section 5, That the City Clerk of the City of Petaluma caused. a writ- ten notice of said property annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed, in the last equalized County assessment roll available on the date the proceedings' were initiated', at the address shown on said assessment roll or as known to said clerk, and to any person who has filed his name and address and the designation of the lands in which he has any interest, whether legal or equitable, with said clerk. Section 6. That at the time and mace set for hearing protests, name- ly, on the 19th day of December, 1955, at the hour of 730 o'clock p. m. in the Council Chambers in the new City Hall, Petaluma, California, said hearing was held, and no pro- tests to said annexation were filed and no person appeared at said hear- ing to protest said annexation. Section 7. That all of the provisions of the Annexation of the Uninhabited Territory Act of 1939 have been com- plied with, and the Council hereby approves the annexation to the City of the. property referred. to and de- scribed in said petition and known as, "Ben Woodworth Annexation ", to the City 'of Petaluma, which said proposed annexation to the City, pur- suant to said,'_procedure and in this ordinance, is situated "in the County of Sonoma, State of California, and the_% thereof are described as follows, to wit: Lying in Section 28, Township 5 nortli, Range 7 west, .M' D.' B. and M., being a portion of Lots 2. and 3 and being more particulary de- scribed as follows: Beginning at` the intersection of _ the north line of the City of Peta- luma and the east line of the North- western Pacific Railroad from which point the intersection of the ,center line of Main Street and said north line of the City of Petaluma bears west 89' 35' 10" west 721.76 feet distant; thence from said ,point of `beginning and along the afore - mentioned east line of the North- western Pacific Railroad north 3° 54' 30" west 821.35 feet; thence south 61' 35' 30" east 136.74 feet to the most southerly corner of the L. L. Downing property referred to in deed recorded in Book 606 of Official Records at page 143, So- noma County Records; thence along the easterly line of said Downing property north 17° 48' east 396.51 feet to the most northerly corner of the Elmer and Bernice Krule- vitch property described in deed re- corded in Book 863 of Official Rec- ords at page 537, Sonoma County Records; thence along the north- erly line of E. and B. Krulevitch and Ben M. Woodworth south 89' 19' 40" east 1124.64 feet to the cen- ter of Petaluma Creek; thence along the center of Petaluma Creek south 3 10' 20" 141.24 feet; thence south i° 25' 20" west. 263.34 feet; thence south 26° 55' 20" west 603.24 feet; thence south 33' 01' 35" west 218.41 feet to the north line of the City of Petaluma: thence along said n "r *h lino north 89° 35' 10" west 903.54 feet to the noint of beginning and enntaini 30.05 acres. Section 8. That upon the effective eatp . of this orrlinance the City Clerk F'-all immediately prepare, under eal. a certified cony of this ordi- nance. giving the date of its passage. — transmit it to the Secretary of .State. 5ecti�r 9. That upon the effective gate of this ordinance or immediate - 1v thereafter the City Clerk shall, nnrsuant to Chapter 8 of Title 5. Division 2, Part 1 of the Government Curie, file a certified copy of this nrdin ^nee and a map or plat describ- ing the boundaries of said annexa- tien nrderPd herein with the County Assessor of Sonoma County. and with the State Board of Equalization. Section 10. That, pursuant to the reriiirements of Article 3, Chanter 1- Division 1 of Title 4 of the Gov- ernment Code, the City shall file with the.Recorler of Sonoma County. o re �ffiriavit stating that all require - irents of law pertaining to the an- nexation proceedings herein have been comnleted, such affidavit to be accompanied by a certified copy of the boundary description as set forth i this orlinance and by a man de- lineatinv the boundaries of said an- ncverl nroperty.
