CONFERENCE IT LEGAL CSEL - ANTICIPATED LITIGATION: Significant exposure to litigation
pursuant to paragraph (2) of subdivision (d) of Section 54956.9: 1 potential case. The existing facts and
circumstances based on which the City Council on the advice of the City Attorney has concluded
there is significant exposure to litigation against the City consist of: public comments made by legal
counsel for Safeway at the June 26, 2018 Planning Commission meeting pursuant to Section
54956.9(e) (4); correspondence to the City from Safeway legal counsel dated December 1 and 2, 2018,
demand to cure or correct correspondence submitted to the City by Safeway legal counsel dated
January 2, 2019, and the draft petition for writ of mandate Safeway legal counsel forwarded to the City
Attorney on March 1, 2109, pursuant to Section 54956.9(e) (3). The correspondence from Safeway legal
counsel, including the cure or correct correspondence and draft petition, is available for public
inspection in the Office of the City Clerk in accordance with Section 54957.5.

Prior to adjournment into Closed Session, the public may speak up to three minutes on items to be
addressed in Closed Session.

GENERAL PUBLIC COMMENT
During General Public Comment, the public is invited to make comments on items of public interest that are
within the City Council's subject matter jurisdiction and that are not listed on the current agenda. Public
comments are limited to three minutes per person. Depending on the number of persons wishing to address
the Council, time will be allocated in equal shares totaling no more than twenty minutes. Please fill out a
speaker card (available at the rear of the Council Chambers) and submit it to the City Clerk. Speaker cards
for General Public Comment will not be accepted after the meeting begins. The Mayor will call on individuals
whose names appear on the speaker cards. If more than three persons wish to address Council on the some
topic, they are encouraged to select a spokesperson. Please be ready to step forward to the microphone
as soon as the previous speaker has concluded his/her comments. (Cal. Gov't. Code §54954.3(a), Petaluma
City Council Rules, Policies and Procedures, Ill(A)).

A. Resolution Declaring Weeds Growing Upon Parcels of Public and Private Property,
Referred to and Described in this Resolution, Constitute and are a Public
Nuisance Requiring Abatement, and Setting Public Hearings at Which Objections

B. Recommendation for City Council to Approve a Resolution Authorizing the
Submission of an Application for the Low Carbon Transit Operations Program and
the Execution of the Certifications and Assurances and Authorized Agent Forms
