ORDINANCE DECLARING THE FOR- MATION OF • PARKING •DISTRICT NO. 1955 -1 OF THE CITY OF PETA- LUMA AS AMENDED, DESCRIB- ING THE PROPERTIES TO BE ACQUIRED, THE WORK TO BE DONE, THE DISTRICT AS ITS BOUNDARIES HAVE BEEN ARIENDED, CONFIRMING THE OP- TIONS HERETOFORE OBTAINED FOR THE PURCHASE OF THE L,'YNDS TO BE ACQUIRED AND PROVIDING THAT 'THE ORDI- NANCE -SHALL TAKE EFFECT IMMEDIATELY AS AN EMER- GENCY MEASURE. BE IT ORDAINED by the City Coun- cil of the City of Petaluma as fol- lows: Section 1. The City Council of the City of Petaluma hereby finds the following facts to be true: A. The City Council of the City of Petaluma did upon the 4th day, of April, 1955, pass its Resolution of In- tention No. 1467 N. C. S. of intention to establish a parking district under T.he provisions of the Parking Dis- trict Law of 1951 of the State of Cal - ifernia which said Resolution of In- tention was entitled, "Resolution of Intention to Establish A Parking Dis- trict under the Provisions of the Parking District Law of 1951 in the �_ity of Petaluma, County of Sonoma, State of California". Said ' Resolution of Intention described the land neces- sary and convenient to be taken, the al; strict to be benefited by the im- provement, the act of the Legislature of the State of California under which the improvement was to be made, determined the contribution of the City of Petaluma toward the cost of said work and improvement, fixed the time and place for hearing of pro- tests, ordered the publication and mailing of..notice thereof.. Said Reso- lution of - .Intention. No. 1467 N. C.. S.; - is-hereby referred to for all particu- lars - concerning the improvement therein resolved to be made. B. The Citv Council of the City of I Petaluma did on the 9th day of May, 1955, overrule any and all pro- tests against said Resolution of In- tention No. 1467 N. C. S. and the formation of the parking district therein described and intended to be formed. C. The City Council of the City of Petaluma did on the 28th day of October, 1955 pass its Resolution No. 1575 N. C. S. making changes and modifications in the acquisitions or improvements to be made and in the boundaries of the district in said Parking District No. 1955 -1 of the City of Petaluma. D. There -were no protests or ob- icctions made on the 23t.h day ,of October, 1955 against modifications in the hecuisitions or improvements to be made or against changing the boundaries of the district of Parking District No. 1955.1. Section 2. The City Council of the Citv of Petaluma ordains that it now has aconired jurisdiction to proceed to reestablish Parking District No. 19551 of the City of Petaluma as modified by Resolution No. 1575 N. C. S. hereinabove referred to. Section 3. The City Council of the City of Petaluma hereby ordains that the parking district described 'in said Resolution of Intention'No. 1467 N. C. S. of the City Council of the City of Petaluma, passed on the 4th day of April, 1955, is formed as amended by Resolution No. 1575 N. C. S., passed on the 28th day of October, 1955. Section 4. Said district ds hereby described and named i"Parking Dis- trict No. 1955-1 of the City of Peta- luma". The district, which is hereby found to be the district benefited by the acquisitions and improvements to be made in said Parking District No. 1955 -1, is as shown on that certain map on file in the office of the City Clerk of the City of Petaluma and designated, "Amended Map Showing Boundaries of Parking District No. 1955 -1 of the City of Petaluma ", which said map is hereby referred to and by this reference made a part hereof and which said map shall govern for all of its details with re- lation to - said amended, boundaries. Section 5. The acquisitions which are to be- made consist of the acqui- sition of those certain lots, pieces or parcels of land locate,. situate and being in the City of Petaluma, County of Sonoma, State of California, and particularly described as follows: Lot "A": Being Lots 317, 318.and 319 as shown on the Official Map of the City of Petaluma as made by Jas. T. Stratton, Deputy U. S. Sur- veyor, and more particularly de- scribed as follows: Beginning at the 'southwesterly corner of said Lot 317 which point bears N 22° 40' W a distance of 150.3 feet from the most northerly corner of the Western Avenue & Keller Street intersection; thence N 22° 40' W a distance of 207:6 feet to a point; thence N 67° 40' E a distance of 100 feet to a point; thence S 22° 40' E a ' distance of 207.6 feet to a point; thence S 67° 40' W a distance of 100 feet to the point of begin- ning, saving and excepting there- from the southerly and rear measurement, of said 317. Lot "B°': Beginning at the south - easterly,corner of Lot 357, as shown on the Official'Map of the City of Petaluma "as made by Jas T. Strat- ton, Deputy U. S` Surveyor; thence- S 67 W a distance of 107:4 - feet .to a point; N 22° 21' W a "distance 'of 55.65 feet to a,' poirit thence N 67 40' E a distance of 113.2 feet to a point; thence S 16­:22 E a distance of 55.96 feet to the:pofnt of beginning. Lot " "C ". Beginning at the inter - section the southwesterly proper - tv line of Water Street and the southeasterly property line of Washington Street, as shown upon Stratton's Map of the City of Peta- luma; thence N 68° Ol' 30" E a distance of 48.67 feet to a point; thence S 28° 17' 20" E a distance of 153.72 feet to a point; thence S 22" 04' 30" E a distance of 481.32 feet to a point; thence S 28° 11' 00" W a distance of 26.85 feet to a point; thence N 25° 59" 50" W a distance of 652.92 feet to the point of beginning. Above bearings refer to the California Coordinate System, Zone 2, as determined from data - published by the U. S. C. & G. S. Section 6. The improvements which are to be made consist of the fol- lowing: On Lot A hereinabove described: Said lot is already paved, striped and metered. New concrete wheel bumpers will be constructed, the me- ters relocated and the lot restriped. On Lot B hereinabove described`. This site is occupied by a 2 -story frame building in fair to poor con- dition. The work will consist of de- inolition, clearing, grading, paving and construction of concrete wheel bumpers to prepare the site for park- ing. On Lot C hereinabove described: This is a water front improvement adjacent to Lot B and will necesa- tate the construction of a concrete bulkhead approximately 540' long and the placing of approximately 4,000 yards of imported fill, as well as grading, .surfacing, construction -ef concrete wheel bumpers and a 3-or 4 -foot chain link fence on top of the bulkhead. Work on all lots will also include the installation of meters and any- thing else necessary for the prepara- tion'therefor as motor vehicle park- ing sites. Reference is hereby made to the report of the City Engineer of the City of Petaluma, dated the 2nd day of September, 1955, for com- plete details as to all improvements to be made and the estimated costs thereof. Section 7. Acceptance of the op- tions heretofore accepted by the City Council. of the City of Petaluma on the 30th day of September, 1955 is hereby ratified and confirmed. Section 8 The City Clerk of the City of Petaluma is-hereby directed to publish this ordinance twice in the PETALUMA ARGUS - COURIER which is the newspaper designated in said Resolution of Intention No. 1467 N. C. S. Ordered published this 6th day of: February, 1956. AYES: Councilmen Brown, Gustaf- son. Norwood and Mayor Schoeningh. NOES: Councilman King. ABSENT: Councilmen Adams and- - Bigelow. VINCENT J.
