AN ORDINANCE PROVIDING, FOR THE McNEAR PARK
BASEBALL .PARK AND FACILITIES',8Y THE YAKIMA VALLEY
BASEBALL CLUB FOR ITS 1956 SPRING TRAINING SEASON.
BEJT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS:
' Section 1. That the City Manager b6 and he, is hereby authorized to enter
into an agreement on behalf of the City- with the Yakimq-.- VdIFey Club,. Yakima,
0hington, providing for the use by-.said club of. the•Mc-Near Base6a.11'Park and
facilities- during the spring training - season of ApriO. I956 'to. and-including, April 30,
1956, pursuant to the following terms, conditioiis..*'and
I., The City of Petaluma shall be paid amounts equal to:
(a): 40% of the - adm is sion collected at each game,
after deducting. the ex 'pepse s; paid by
club for conducting;-each of said games.
2. The City shall not be under any obligation to prepare or maintain
said park or facilities for said club.
3.. Said club shall agree to be liable for any waste committed on
o-r - aboutsaidpremises, or damages - caused by, said - .tlub
or by the be players or agents or employees thereof partici-
pating.
4. Said club shall agree to save the City of Petaluma harmless
for r or on account of any injury or death caused to any person
while i,said park and facilities are being used by said club or
agents or employees thereof.
Section 2. That all sums received . by the City under said agreement with
.said Yakima Valley Baseball Club shall be deposited in the General Fund for use for
improvements at said*McNear Park.
