FOR THE DISMANTLING AND REMOVAL OF THE' BUILDING LOCATED AT 122 -130 MAIN STREET,* SITUATE ON LOT 357, AS SHOWN ON THE OFFICIAL MAP OF THE CITY OF PETALUMA AS MADE BY JAMES T. STRATTON, AND PROVIDING FOR THE REMOVAL OF ALL DEBRIS THEREFROM. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: Section 1. That the City Council finds that it is necessary for the best interest of the City that the building, including the fixtures thereof, located at 122 -130 Main Street be dismantled and removed in order that the land ofi which said building is located may be used for other purposes. Se ction 2. That the dismantling and removing from the premises will consist of the removing anddismantling of all buildings, fences, vegetation, foundations, plumbing and other debris in accordance with plans. and specifi- cations prepared by the Director . of Public Works, who is hereby directed to file plans and specifications, for said dismantling and removing, with the City Clerk. Section 3. That the area shall be left clean and free of any debris and obstruction; the successful. bidder shall become the owner of all material removed and he shall dispose of same at his own expense. Se ction 4 . That the bid for dismantling and removing of said building shall be approved by the Council, by resolution, at a regular meeting to be held at the time fixed by the City for receiving said bids and set forth in the published notice for the bid for dismantling and removing said building. Section 5. That said bidders for the dismantling and removing of said building shall be required to accompany their written bids with a certified or cashiers check in an amount equal to ten percent (10%) of the total amount of said bid, which said deposit shall be forfeited on the failure of the successful bidder to remove and dismantle said building and to clear the lot upon which the sa -me is situated within 30 calendar days after the acceptance of said bid. Section 6. That the City Clerk be and she is hereby authorized and directed, to cause a notice of said offer to dismantle and remove said buildings to be published for five (5) consecutive days in the Petaluma Argus - Courier, the official newspaper of said City, such publication of notice to be completed at least ten (10) days before the date for receiving said bids and awarding a contract ;or contracts for the sale of said building. Said notice shall set forth all of the terms, conditions and requirements for the dismantling and removing of said building provided for in this ordinance. Section 7. That the cost of dismantling and removing said building be made from the Off- Street Parking Acquisition Fund of 1955 -1. Ordered Posted this 19th day of March, 1956.
