Norwood M ilton Gustafson ORDINANCE OF THE CITY OF PETALUMA PROVIDING FOR THE CONSTRUCTION OF LEVEES,: INSTALLATION °OF SPILL - WAY STRUCTURES AND THE REPAIR OF EXISTING LEVEES TO RECEIVE SPOILS FROM THE PROPOSED DREDGING OF PETALUMA CREEK, "BY THE UNITED STATES ARMY, CORPS OF ENGINEERS; PROVIDING THAT THE COST SHALL BE PAID FROM THE CONTINGENCY FUND; AND DETERMINING THAT THE WORK UNDER 'THIS ORDINANCE. CONSTITUTES AN EMERGENCY. ' BE ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA, AS.FOLLOWS Section 1 . That the City of Petaluma cause the following improvement to be completed, to wit: The construction of levees, installation of structures , and the repair of. :existing "levees to' receive spoils 'from ,the proposed dredging bf- Tetaluma Creek by the 'United States , Army, Corps of 'Engineers. - Section 2. That said work shall'be done along the courses and in accordance with the plans and specifications therefor entitled: "1956 Dredging - Spoils Area Improvement Unit #1 ", dated April 1956, and prepared by Russell W. Ingram, City Engineer, which said plans and specifications were filed with the City Clerk on the 16th day of April, 1956, and are hereby approved and adopted as the plans and specifications for said improvement work: Section 3 . Said work provided for herein shall be done by contract awarded pursuant to procedure . provided for in the City Charter to the lowest responsible bidder, after advertising for bids in the manner and for the period required by said Charter. Section 4. Said work shall be done and performed under the supervision of -the City Engineer, who shall approve the satisfactory completion thereof by filing. a :certificate of completion with the City Clerk when said work is finished. S ection 5. The costs for said work shall be taken from the Contingency Fund of the City of Petaluma. Section 6. This ordinance is urgently required for the immediate . preservation of the public peace, health and satty for the reason that the United' States Government will be prepared to commence immediatley the dredging work required on said Petaluma Creek, and for said reason this ordinance shall become effective upon its passage and adoption by an unanimous vote of the members present at the time of such adoption.
