HomeMy WebLinkAboutResolution 2007-154 N.C.S. 09/10/2007 Resolution No. 2007-154 N.C.S. of the City of Petaluma, California AUTHORIZING GRADING FOR QUARRY HEIGHTS SUBDIVISION PRIOR TO FINAL MAP APPROVAL WHEREAS, the developer, KB Homes, has requested permission to grade the southern parcel of the Quarry Heights Subdivision, as shown on the Vesting Tentative Map approved by the City Council on June 6, 2005 by Resolution No. 2005-086 N.C.S., prior to final map approval; and, WHEREAS, the developer agrees to comply with the City Grading and Erosion Control Ordinance No. 1576 NCS; and, WHEREAS, the developer agrees to comply with the Regional Water Quality Control Board's policies, file a Notice of Intent and prepare a Storm Water Pollution Prevention Plan;. and, WHEREAS, the developer agrees to enter into a grading agreement .and provide surety to sufficient to secure the performance of the grading work, including restoration if required by City to the property's condition prior to the commencement of grading, should developer's final map not be approved, or should developer abandon the project following final map approval; and, WHEREAS, the developer shall obtain reclamation plan written approval from the County of Sonoma and the State Office of Mine Reclamation indicating that the southern parcel has been removed from the State's mine list and provide such documentation to the City prior to the City issuing a grading permit; and, WHEREAS, the developer shall obtain a grading permit from the Community Development Department. Page ~ NOW, TIIEREFORE, BE IT RESOLVED by the Council of the City of Petaluma that the above recitals are true and correct and hereby declared to be findings of the City Council of the City of Petaluma. BE IT FURTIIER RESOLVED that authorization to grade Quarry Heights Subdivision prior to final map approval is hereby granted, conditioned upon developer's compliance with each requirement and/or agreement stated in the adopted findings prior to the commencement of grading. Under the power and authority conferred upon this Cowlcil by the Charter of said City.
