a APPROVING THE PLANNED UNIT DEVELOPMENT PLAN
5 FOR HERITAGE SUBDIVISION LOCATED ON 18:04 ACRES,
6 EAST OF RIESLING ROAD, APN 137-070-070

S WHEREAS, by Ordinance No. 2068, Assessor Parcel Number 137-070-070 comprising
9 18.04 acres, have been rezoned to PUD (Planned Unit Development); and
10
. 11 WHEREAS, by action taken on December 9, 1997 and January 27, 1998, the Planning
12 Commission considered and forwarded a recommendation to the City Council on the unit
t3 development plan for Heritage Subdivision, to allow development of a 97 lot subdivision
14 for detached single-family homes; and
15
16 WHEREAS, the City Council finds that the requirements of the California Environmental
17 Quality Act (CEQA) have been satisfied through the preparation of an Initial Study and
18 adoption of Resolution No. 98-52 N.C.S., approving a Mitigated Negative Declaration to
19 address the specific impacts of the Heritage Subdivision development;

2t NOW THEREFORE, BE IT RESOLVED that the City Council hereby adopts the
22 following findings:
23
24 Findines for Approval of the PUD Development Plan and Standards
25
z6 1. The proposed Heritage Subdivision is .proposed on property which has a suitable
z7 relationship to one or more thoroughfares, and that said thoroughfares, with the
2s improvements herein required including a signalized intersection at Sonoma
29 Mountain Parkway, improvements to the Riesling Road collector street including
3o the traffic circle, and a bike path on the Riesling Road extension, aze adequate to
3t carry any additional traffic generated by the development.

33 2. The plan for the Heritage Subdivision presents a unified and organized
34 arrangement of buildings and service facilities including: the extension of Riesling
35 Road, and Urban Separator improvements, which are appropriate in relation to
36 adjacent or nearby properties, and adequate site design, landscaping and screening
37 is included to ensure compatibility with surrounding uses.

39 3. The natural and scenic qualities of the site and its surroundings are protected
ao through conditions of approval including; landscaping, and an attractive mix of
41 house designs and associated Development Standards regulating
42 appropriate/attractive future modifications, if any.

as 4. Adequate public spaces have been designated on the Heritage Subdivision PUD
45 Development Flan, through the proposed and required dedication of land for

i public right-of--way purposes and through the improvement of the Urban
2 Sepazator.

a 5. The development of the subject Heritage Subdivision property in the manner
5 proposed by the applicants, and as conditioned to control storm drainage, and
6 provide appropriate circulation for both vehicles and pedestrians, will not be
7 detrimental to the public welfaze, will be in the best interest of the City and will be
8 in keeping with the general intent and spirit of the zoning regulations of the City of
9 Petaluma, with the Petaluma General Plan and Corona/Ely Specific Plan, and with
to other applicable plans adopted by the City.

12 6. The proposed Heritage Subdivision, which incorporates the use of Transfer of
13 Development Rights (TDR) to increase the overall density of}his proposal, would
14 nothave been approved without the TDR.

16 Notice of Estimated Fees. Dedications. and other Exactions
17
is Pursuant to .Section 66020 of the California Government Code, the applicant/developer
19 has the statutory right to protest development fees, dedication and reservation
20 requirements, and other exactions included in this project approval as follows:

22 1. The following fees must be collected prior to issuance of building permits:
23
2a Pazk and Recreation Land ImptovemenYFee $3,894.00 per unit

z6 2. The following fees must be collected prior to Final Building Inspection or
27 Certificate of Occupancy:

29 Water Connection Fee (Zone # 4) $ 3,110.00 per unit
3o Storm Drainage Impact $ 196.88 per unit
31 Community Facilities Development Fee $ 805.00 per unit
32 Traffrc Mitigation Fee $ 3,007.00 per unit
33 Sewer Connection Fee $ 2,550.00 per unit

35 3. The following fee must be paid directly to the School District prior to
36 issuance of Building Permit:

38 School Facilities Fee (Amount Determined by School District)

ao 4. In-Lieu Housing Fee of $2,400 per unit (typically collected through escrow).

4z 5. Corona Ely Benefit District (Assessment to be determined pursuant to
43 Resolution No. 92-302 N.C.S.).

1 BE IT FURTHER RESOLVED that the Heritage Subdivision PUD Development Plan as
z referred by the Planning Commission and presented at the April 6, 1998, May 4, 1998, and
3 May 18, 1998 meetings of this Council is hereby approved pursuant to Section 19A-504
4 of Zoning Ordinance No. 1072 N.C.S., as amended subject to the following notice and
5 conditions:

7 Conditions of PUD Development Plan and Standards
8
9 1. All mitigation measures adopted in conjunction with approval of the Mitigated
to Negative Declaration for the Heritage Subdivision are incorporated herein by
11 reference as conditions of project approval.

13 2. All conditions of the Tentative Subdivision Map approved for the Heritage
14 Subdivision are incorporated herein by reference, and shall be enforced, as
15 applicable, with the PUD Development Plan.

17 3. All conditions of the Planning Department shall be met, including:

19 a. The final content and composition of the PUD Development Standazds
20 shall be subject to SPARC for review and approval prior to Final Map
21 approval. Two SPARC approved copies of the PUD Development
2z Standards shall be submitted to the Planning Department prior to
23 application for a Final Map.

25 b. The PUD Development Plan including all improvements along the Urban
26 Sepazator, Riesling Road, and Roundabout pursuant to the adopted
27 parkway guidelines, including: landscaping, sidewalk/pathway location,
zs etc., shall be reviewed by SPARC prior to approval of the Final Map and
29 improvement- drawings.

31 c. The PUD Development Plan shall be amended, if necessary, to reflect the
32 correct project mix (lot configuration and numbers, house plan
33 number/type, elevation style/type and color scheme) pursuant to all
34 conditions of approval, prior to .application for SPARC review and staff
35 review of the Final Map and Improvement Drawings.

37 d. A reproducible copy of the final SPARC approved PUD Development Plan
38 and Standazds (book) shall be submitted to the Planning Department prior
39 to Final Map approval (first phase).

41 e. All proposed subdivision landscape plans shall be subject to SPARC
42 approval, including the Urban Separator street frontage treatment (plant
43 palette, pedestrian bicycle path design, etc.). Prior to SPARC approval of
as the landscape plans, comments shall be obtained from the Recreation,
45 Music and Parks Commission in order to facilitate coordination of desired

1 Urban Separator/Open Space uses and improvements (i.e., need. for
2 bollards, irrigation/utility stub-outs, etc.). However, the developer shall
3 not be responsible for the costs of implementation of any Urban Separator
a improvements other than the public landscape strip adjacent to the street,
5 the associated irrigation system and the combined pedestrian bicycle path,
6 unless required by other City agreements.

s £ Proposed "B" Street shall shift 10 feet towards the Urban Sepazator. Lots
9 between "B" Street and Riesling Road are to gradually increase in size. The
to eleven (11) lots adjacent to the Urban Separator shall decrease 10 feet in
11 width to allow for the interior lots to increase in width, thereby creating
12 larger reaz yards.

la 4. All requirements of the Building Division shall be met, including:

16 a. Grading must be certified when completed to indicate compliance with
17 approved plans and will be required for occupancy.

19 b. Where ground slopes greater than 1 on 10, foundation shall be stepped per
20 Uniform Building Code 1803.2.

zz c. Soils with expansion index greater than 20 requires special design
23 foundation per Uniform building Code 1803.2.

z5 d. All retaining walls shall meet the requirements of the 1994 UBC, and shall
26 comply with Petaluma Standards Ordinance No. 1727/1988.
27
28 e. Residential buildings over 3,000 sq. ft. need two required exits.
29
30 f. Show site drainage and grading topography.
31
32 g. Indicate all utilities on site plan.
33
3a h. Driveway gradient shall comply with Ordinance No. 1533/1982.

36 i. Responsible party to sign plans.
37
38 j. Submit soils report to verify foundation design.

ao k. Indicate group occupancy, type of construction, square footage.

4z 1. Plans must show compliance to 1994 UBC, UPC, UMC, and 1993 NEC.
a3 Plans must also show compliance to current Title 24 Energy Conservation
44 and/or Disabled Access Requirements.

1 m. Provide structural calculations for all non-conventional design items.

3 n. Demolition permit required to remove any structure.

5 0. Abandonment of water well or septic system must be done under permit
6 from County of Sonoma Public Health Department.

8 5. The applicants/devt;lopers shall defend, indemnify, and hold harmless the City or
9 any of its boards, commission, agents, officers, and employees from any claim,
to action or proceeding against the City, its boards, commission, agents, officers, or
11 employees to attack, set aside, void, or annul, the approval of the project when
12 such claim or action is brought within the time period provided for in applicable
t3 State and/or local statutes. The City shall promptly notify the applicants/developers
la of any such claim, action, or proceeding. The City shall coordinate in the defense.
15 Nothing contained in this condition shall prohibit the City from participating in a
16 defense of any claim, action, or proceeding if the City bears its own attorney's fees
17 and costs, and the City defends the action in good faith.
