4 APPROVINGTHE TENTATIVE SUBDIVISION MAP FOR THE HERITAGE
5 SUBDIVISION - A PROPOSED 18.04 ACRE RESIDENTIAL DEVELOPMENT
6 LOCATED EAST OF RIESLING ROAD, AP NO. 137-070-070

S WHEREAS, Ryder Homes/Dover Corporation, as owners, have filed with the City
9 Council a Tentative Subdivision Map to subdivide land to be known as Heritage
to Subdivision and have paid all required filing fees; and
11
12 WHEREAS, the Planning Commission has examined and reviewed the same as required
13 by law, and all reports, recommendations, and comments therein have been forwarded to
1a and considered by this Council at meetings held on Apri16, 1998 and May 18, 1998;

t5 NOW> THEREFORE, BE IT RESOLVED that this Council hereby finds for the Tentative
17 Subdivision Map reviewed by the Planning Commission on December 9, 1997 and January
1s 27, 1998 is hereby approved as follows:

20 Findings for Tentative Subdivision Mau

22 1. The proposed Heritage Tentative Subdivision Map, as conditioned, is in general
z3 conformity with the Petaluma Generai Plan/Corona/Ely Specific Plan because it
2a integrates .important design features specified, including: appropriate design of
25 streets and pathways for public use, and a broad range of admirable house designs
26 contributing to attractive streetscapes.

2s 2. The proposed Heritage Subdivision, as conditioned, is in general conformity with
z9 the standards and intent of the PUD District, and other applicable provisions of
3o the Petaluma Zoning Ordinance.

32 3. The proposed Heritage Subdivision Map, as conditioned, is in general
33 conformance with the Petaluma Subdivision Ordinance and other applicable
34 provisions of the Petaluma Municipal Code.
35
36 4. The requirements of the California Environmental Quality Act have been met
37 through preparation of an Initial Study and adoption of a Mitigated Negative
38 Declaration, to avoid or reduce to a level of insignificance, potential environmental
39 impacts of the Heritage Subdivision.

41 5. The Heritage Subdivision has met all requirements of the City of Petaluma
42 Residential Growth Management System, as specified under Chapter 17.26 of the
43 Municipal Code.

I Tentative Subdivision Map Conditions

3 1. All mitigation measures adopted in conjunction with approval of the Mitigated
4 Negative Declaration for the Heritage Subdivision are incorporated herein by
5 reference as conditions of project approval.

7 2. All conditions of the PUD Development Plan approved for the Heritage
8 Subdivision are incorporated herein by reference, and shall be enforced, as
9 applicable. with the Tentative Subdivision Map.

11 3. Frontage improvements and off-site improvements shall be constructed according
12 to the Tentative Parcel Map conditions for Parcel Map No. 303.

i4 4. The right-of-way for Riesling Road and a portion of "A" Street shall be dedicated
15 with the final map application as indicated on Parcel Map No. 303.

17 5. The lot ]ine adjustment as shown on the Tentative Subdivision Map shall be
~ 8 completed prior to final map application.

20 6. The typical 60' right-of-way street section with the 36' curb to curb dimension
3 ~ shall be used on "A" Street from Riesling Road to "D" Street, on "B" Street from
22 "A" Street to "C" Street and on "D" Street.

24 7. Provide adequate utilities to adjacent "remaining lands" for future development.

26 8. Provide an adequate storm drain system to collect and direct surface t'unoff from
27 Parcel `A" (Urban Separator) and Mustang Court to an adequate existing storm
28 drain system.

30 9. All hydrologic, hydraulic and storm drain design shall be subject to the review
31 and approval of the Sonoma County Water Agency.

33 10. The proposed water main system shall be capable of delivering a continuous fire
34 flow as determined by the Fire Marshal.

36 11. Grading shall eonfonn to the soils investigation report for this subdivision. An
37 erosion control plan shall be prepared as part of the improvement plans.

39 12. Any existing overhead utilities along the frontage of or traversing this site shall be
40 placed underground.

42 13. The minimum asphalt concrete thickness for all streets is 3".
43
44 14. The improvements plans and Fnal map shall be prepared per the ]atest City
45 policies, standards, codes, resolutions and ordinances.

i 1~. Each individual phase shall be designed to provide the required utility services
2 and street system independent of any other phase.

4 l6. Install a City standard barricade at the end of "D° Street with a sign stating:
5 "Future through street and development".

7 17. All conditions of the Planning Department shall be met, including:

9 a. A reproducible copy of the Tentative Map, submitted to the Planning
to Department on September 4, 1997,. shall be submitted to the Planning
t] Department, prior to Final Map approval (first phase).

i3 18. The applicant shall provide for right-of--way dedication purposes the land
14 underlying the proposed Mustang Court free of all encumbrances, prior to
15 approval of the Fina] Map (first phase). Should the City be required to obtain,
16 through eminent domain proceedings the existing easements, the subdivider shall
17 bear all costs incurred by the City. The developer shall continue fo work with
IS neighbors along Mustang Court to resolve the easement issue before the
19 scheduling the Heritage Subdivision item before the City Council.

21 19. The applicant shall submit anotice informing buyers of ongoing agricultural
22 uses on adjacent lots consisting of an existing nursery site, a proposed retail site.
23 high density housing, and a junior high school. which may impact their property
z4 with the Final Map application to be recorded wit the Final Map for the project.

26 20. Review of the improvement drawings will not. preclude the ability to create a
2~ detention basin on the Urban Separator. Per the direction of the Council, a stoim
28 water detention area is to be created within the Urban Separator. The detention
29 pond will be designed so that off-site stormwater Mows are equal. or less, than
3o pre-development flow volumes. The creation of the detention pond would
3t preclude any possibility of impacting homes in the Heritage Subdivision. The
32 developer would construct the detention pond as well as provide financing for
33 maintenance of this improvement.

35 To insure that off-site stonnwater flows are equal, or less, .than pre-development
36 flow volumes, plans for the detention pond shall be submitted with the Public
37 Improvement Plans and Final Map that are submitted to the Engineering
38 Department. "The detention pond must be established prior to receiving a
39 Certificate of Occuipancy for the first residence of the last phase of the
40 subdivision.

42 Language addressing the financing mechanism of the detention pond must be
43 submitted for the review and approval of the Planning Department prior to the
44 submittal of Public Lnprovement Plans and the Final Map to the Engineering
45 Department.

1 21. All conditions of the Fire Marshal. shall be met, including:

3 a. Minimum fire flow required for this project is 1,500 gallons per minute at
4 20 pounds per square inch (pi).
5
6 b. Fire hydrants. shall be spaced at a maximum of 300' apart. Location and
7 type of fire hydrants are to be approved by the Fire Marshal's office.
8
9 c. Provide access, a minimum twenty (20) feet, exclusive of on street parking,
to all asphalt surface with thirteen feet-six inches (13'6") vertical height
11 clearance.

13 d. Post address at or near main entry door, a minimum of 4 inch letters on
14 contrasting background.
15
16 e. Address locator required to be posted at or near the driveway entrance.
17 Reflectorized numbers are acceptable. Location and desigrrto be approved
18 by the Fire Marshal's office.

20 f. All required fire lanes in which no parking is allowed, shall be designated
21 by painting curbs red. Where no curbs exist, signs approved by the Fire
22 Marshal shall be installed

24 g. Add as a general note to plans:

26 No combustible construction is permitted above the foundation unless an
27 approved all weather hard surface road is provided to within one hundred-
28 fifty (150') of the farthest point of a building or structure.

3o All fire hydrants for the project must be tested, flushed, and in service prior
31 to the commencement of combustible construction on site.

33 22. This subdivision shall participate in the CoronafEly Benefit District (pursuant to
34 Resolution No. 92-302N.C.S.).

36 23. The applicants/developers shall defend, indemnify, and hold harmless the City or
37 any of its boards, commission, agents, officers, and employees from any claim,
3s action or proceeding against the City, its boards, commission, agents, officers, or

z employees to attack, set aside, void, or annul, the approval of the project when
3 such claim or action is brought within the time period provided for in applicable
a State and/or local statutes. The City shall promptly notify the applicants/developers
5 of any such claim, action, or proceeding. The City shall coordinate in the defense.
6 Nothing contained in this condition shall prohibit the City from participating in a
7 defense of any claim, action, or proceeding if the City bears its own attorney's fees
