HomeMy WebLinkAboutResolutions 2011-048 N.C.S. 04/04/2011Resolution No. 2011 -048 N.C.S. of the City of Petaluma, California AUTHORIZING PROGRAM ADMINISTRATION FEES FOR THE MOBILE HOME PARK SPACE RENT STABILIZATION PROGRAM FOR 2011 WHEREAS, pursuant to Ordinance No. 1949 N.C.S., the City of Petaluma adopted a Mobile Home Park Space Rent Stabilization Program; and, WHEREAS, pursuant to Petaluma Municipal Code Section 6.50.160, a part of said ordinance, the City Council is authorized to adopt a Mobile Home Park Space Rent Stabilization Program administration fee by resolution or ordinance; and, WHEREAS, the City Council desires to set the administration fee for Fiscal Year 2011- 2012. NOW, THEREFORE, BE IT RESOLVED that: The administration fee for Fiscal Year 2011 -2012 is set at $65.00 per mobile home space as defined herein. 2. On or before April 30, 2011 each mobile home park owner shall receive an invoice from the City of Petaluma for a mobile home park rent stabilization program administration fee in the sum of sixty -five dollars ($65.00) for each mobile home space as defined herein, including both occupied and unoccupied mobile home spaces in the owner's mobile home park except for those spaces subject to a rental agreement in full compliance with the requirements of Civil Code Sections 798.1 (a) and (b). The City Clerk of the City of Petaluma shall use these funds to administer the mobile home park rent stabilization ordinance, in compliance with Petaluma Municipal Code Chapter 6.50. 3. The City Clerk of the City of Petaluma shall issue to each mobile home park owner a receipt for payment of the fees required to be paid herein. Any person owing money to the City under the provisions of this ordinance shall be liable to an action brought in the Resolution No. 2011 -048 N.C.S. Page 1 name of the City for the recovery of such amount. A service fee equal to one and one- half percent (1' /2 %) per month will be charged on all late payments of registration fees under this ordinance. Under the power and authority conferred upon this Council by the Charter of said City.
