HomeMy WebLinkAboutResolution 97-038 02/03/1997 Resolution No. 97-38 N.C.S. .1 of the City of 1'etalurna, California 2 3 4 5 6 RESOLUTION ESTABLISHING 7 CHARGES AND FINES FOR TAE OPERATION 8 AND MAINTENANCE OF THE 9 WASTEWATER DISPOSAL SYSTEM 10 11 12 13 WHEREAS, the City of Petaluma operates a wastewater treatment and disposal system, and 14 15 WHEREAS, the City Council adopted the FY 96-97 budget which included a sewer user rate 16 increase of 5%, and 17 18 WHEREAS, the City Council review the recommended rate increase and heard public comments, 19 and; 20 21 WHEREAS, the rate increase is necessary to continue the maintenance of the existing treatment 22 plant and collection systems, and; 23 24 WIIEREAS, the City has established a revenue program which equitably distributes the costs of 25 the system to the users, and 26 27 WHEREAS, the City Council requested that an upgraded utility billing system, funded in the FY 28 96-97 budget and which can process variable types of rate structures, be implemented within 12 to 1 B 29 months, and: 30 31 WIIEREAS, the City Council adopted Resolution 96.65 N.C.S. and previous resolutions which 32 established various charges and fees in accordance with the revenue program and certain charges need to 33 be amended; 34 35 NOW, THEREFORE BE IT RESOLVED that in accordance with Chapters 15.44 36 through 15.76 of the Petaluma Municipal Code, the following charges, fees and the fine schedule is 37 adopted and Resolution 96-65 N.C.S. is amended as follows; 38 39 Section 1-Amended sections to Resolution 96-65 40 41 Section 1, subsections A, B and C of Resolution.96-65 are amended as follows: 42 43 Section I- Sewer Charees 44 45 A) Residential Rate of $15.75 per month for each resident unit 46 47 B) Non-Residential Rate (Minor User) of. i:~,..,,,..._..._9.7-.3.8._... ncs. Page 1 of 6 1 2 i) the greater of $15.75 per month for each account or 3 4 ii) $1.66 for each 100 cubic feet (CCF), of water use or discharge as 5 determined by the Director of Engineering, multiplied by the. following strength 6 factors by user classification for Minor Users, as defined in Section 15.64.020. 7 8 Strength Factors 9 Eating Places 2.7 10 Equipment Service Facilities 1. l I1 Food and Kindred Products Processing 2.7 12 Laundries and Dry Cleaners 1.4 13 Mortuaries 2.7 14 Theaters and Bowling Alleys 1.1 15 All Other Minor Users 1 A 16 17 18 C) Permitted Industrial User (Major User), shall pay a rate of. 19 20 i) the greater of $15.75 per month for each account or 21 22 ii) $1.66 for each 100 cubic feet (CCF) of water use or discharge as determined by 23 the Director of Engineering. 24 25 Section 2 -Unaffected sections of Resolution 96-65 26 27 All other sections of Resolutions 96-65 remain unchanged and are hereby incorporated into this 28 resolution. 29 30 Section 3 -Effective Date 31 32 This resolution shall be effective and the rates applied to all utility bills issued after April 1, 1997. Under the power and authority conferred upon this Council by the Charter of said City.
