Van Bebber AN ORDINANCE AMENDING CHAPTER II,. ,ARTICLE 11, OF THE PETALUMA CITY CODE OF 1958 AND.REPEAL,ING SECTIONS S. 3SECTION, THROUGH 23 30 ND ENACTING` IN THEIR PLACE AND "THROUGH 2. 40 TO_PROVIDE FOR THE . .' AUTHORITY TO. ESTABLISH THE MNIMUN17 MAXIMUM IN RANGE OF COMPENSATION SALARIES AND WAGES AUTHOR 1ZED AND PROVIDED TO_ BE PAID TO THE EMPLOYEES OF THE CITY OF PETALUMA AND TO SET FORTH CERTAIN ADMINISTRATIVE RULES AND REGULATIONS' IN RELATION TO THE EMPL QYEES OF THE CITY OF PETAL_ UMA . BE IT O 1 RDAlNED BY THE C'O,UNCIL OF THE CITY OF PETALUMA, AS FOLLOWS: 5'ection 1. Chapter II, .Article :II, Sections -2. 30 through 2. 37 of the Petaluma City Code of 1958.a-r`e hereby repealed and in their place and stead the followiii'g are ordained: (a) Section, 2. 30 Overtime. All - -emp`lgyee;s of the 'City whose salaries or wages are monthly, except those hereinafter excluded, who are requested to perform. emergency work or who have been recalled to work on account of y emergency conditions be ond.the normal, working :day,, may be paid for such " additional work at one and, one -half` (1. -l:/2) times the hourly,rate based upon 1�: 3 Hours per month. A 11 overtime, not emergency, shall be .compensated for at the ,r-eg,ular hourly .wage rate equivalent of the employee concerned. E work ovemime mployees whose„ salaries or wages are monthly and are required to may receiv e equivalent compensatory time off. - In all ,instances of overtime,. the Department Head, subject to the approval of the City Manager, shall determine whether overtime shall be with pay or compensatory time off. Such 'compensatory time off shall be taken within thirty (30) days after such overtime was worked, otherwise compensation in .-for overtime will be allowed. A,u,thor-ization for pay- for compensatory time off accrued by reason of overtime shall be submitted to the. City`Manager on, payroll forms an_d counter- signed by the .Department Head. All Department Heads excluded from any provisions concerning employee rights to be ,compensated for overtime. Any employee required to work overtime :shall, in no case, be compensated' to:r less t an o (l) hour for .such overtime. The membe.rs,bf the. Fire Department, when called to duty to work an overtime shift, shall be paid. overtime �at their. regular :shift rate. This rate . shall be (figured on, their regular number of hours worked per week as per the followings formula. 1 I . , 1L , Monthl y salar y times 12 months., equals, annual salary. 2. 72 hours per week times 52 weeks, equals 3, 744 hours worked annually. 3; Hours work heed" annually; divided by annual ;salary; establiss the .hourly rate for a 24 hour 'shift. Overtime pay for.,membef.s of the Fire Department who are, called out to workratv large fires or other emergencies; and who are not on a regularly scheduled working °shift, shall be paid, one and one -half (1 -1/2) times thar regular hourly rate based up9n,l73. hou rs per month. T,he.recor,d shall ' include the name of the mployee, the class, the dates and hours of overtime worked, and the ;dates and hours when compensatory time off is taken, together with any balance of "time off remaining to betaken off or to be paid.. (b) Section 2.'31 Payment for Work During, Holidays, 'Vacations. When it. becomes necessary by an emergency to have employees work dur -it g legal holidays or the period said employees are entitled to vacation leave, said employees working , on such legal holidays aid during periods of vacation shall be entitled to receive additional remuneration at a rate of one and one - half (1 -1%2) times their hourly wage equivalent based upon 173.33 hours per - month, 6r ,equivalent compensatory time off. 'If at employee works overtime on a legal holiday, he may waive pay and -add time and one - ;half off for the overtime worked to, his accumulated vacation upon mutual - agreement between the employee and Department Head and approval by City Manager. For the transaction, of municipal business for the City of Petaluma, holidays for all employees shall'be as determined, by State Law-. Police and Fire De P artmeizt employees shall not be entitled to overtime allowance for holidays worked during their regularly scheduled shifts. (c) Se ction .2 32_ Automobile Allowances. In addition to the salaries and wages, herein provided,. the City Manager is hereby authorized to provide compensation for the use of automo- biles owned by employees �of the City aiid u.sed on City business.. The City Manager's automobile allowance shall- be determined by the 01ty Council at the beginning of the fiscal. year as a part of the budget adopted by the City Council. (d) Section 2..33' Vacations. All regular employee- es bf the City' after serving at least one full year are entitled to the , equivalent of ten (10) working . days of vacation, with pay, in the next succeeding' anniversary yeas of ernployr All regular employees of the -City after ten (10). years% of continuous employment with the City and. commencing with the eleventh (11th) year, shall be entitled to one .(1) additional day's vacation for each year over ten (10) not to exceed a maximum of fifteen (15) working days per year. No.. more than-ten (10) consecutive working days of' vacation may be taken at one time unless the 'Department head' and the City Manager' shall: approve;`_ Vacations shall be taken at such time as the Department Head shall de'signa'te, subject to the'approval of the City . Ma,nage.r. Vacation time accumulated in excess. of two (2) years will be lost.. In the -event employment. shall; terminate the employee shall be:paid for any earned vacation accumulated to date of termination not to exceed two '(2) years' accumulation. Police ,Dffcers shall be entitled to vacations in accordance with the provisions of State Law notwithstanding the provisions .of this Section. Employees shall not be granted compensation in addition to their regular salary - for 'Vacation time not taken, except at termination of employ- ment, and except- in those instance s'where vacation fime was not taken because of emergency conditions existing in the -City. The lost vacation may be compensated for by an additional payment upon. approval and recommendation of the Department Head and the 'City Manager. (e) Section 2.34 Sick ; Leave, Group Health Insurance. Employees are entitled to one '(1) working day sick. leave with pay per calendar month following completion of each month of continuous sery ce.and.'may accumulate up to a total of ninety (9.0) working days for one to 'teil years of service, and one hundred' and twenty, (120) working days thereafter. Each employee shall be entitled to be paid - during, the time he shall be unable to perform the services required of such emproyee on account of illness, an amount equal to one day's pay for each month which said employee, has been employed by the City, but not to exceed one hundred and 'twenty (1'20) working days. Whenever illness exceeds three (3) days' duration, the C ity Manager" may require that a report shall be accompanied by a written statement from the doctor attending such employee. This Section shall not apply in any case where the employee's absence from work has, been occasioned by i'juries suffered during his employment and he receives workmen's coMponsatioil.
