1 ADOPTING A NEGATIVE DECLARATION PURSUANT TO
2 THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA)
3 FOR THORA ESTATES, A 5 LOT SUBDIVISION ON 0.57 ACRES
4 LOCATED AT 21, 23, 25, 27, 29 CHERRY STREET, APN 006-092-009

~ WHEREAS, the Planning Commission, at its public hearing of February 11, 1997, considered and
~ recommended adoption of a Negative Declaration pursuant to the California Environmental Quality Act
8 (CEQA) in conjunction with the following application:

l0 1.. Request for a Tentative Subdivision Map to create five (5) lots.

t2 NOW THEREFORE BE IT RESOLVED that the City Council hereby adopts the following findings:

la Findings for Adoption of a Negative Declaration of Environmental Imaact:

16 1. An Initial Study has been prepared and proper notice provided in accordance with CEQA and
17 local guidelines.

l9 2. Based upon the Initial Study and comments received, potential impacts would not occur as the
20 site is fully developed. There is no substantial evidence that the project will have a significant
21 effect onthe environment.

23 3. The project does not have potential to affect wildlife resources, either individually or
za cumulatively, and is exempt from. Fish and Game filing fees because the project site is fully
zs developed, surrounded by urban development, and contains none of the resources defined in
26 Section 7112 of the Fish and Game Code.

28 4. The project is not located on a site listed on any Hazardous Waste Site List complied by the State
z<a pursuant to Section 65962.5 of the Government Code.

31 5, The Planning Commission has reviewed the Negative Declaration and considered any and all
32 comments before making a decision on the project.

34 6. The record of proceedings of the decision on the project is available for public review at the City
35 of Petaluma Planning Department, City Hall, 11 English Street, Petaluma, California.

37 NOW THEREFORE BE IT RESOLVED that as no potential impacts were identified in the Initial Study
38 and. mitigation measures are not needed, the Petaluma City Council hereby adopts the Negative
Declaration for the Thora Estates project, as recommended by the Planning Commission.
