SUBJECT: Resolution Authorizing Award of Contract to FEDCO Construction, Inc. for the
East Washington Street Reconstruction Project to Repair Damage Caused by
Water Main Failure
RECOMMENDATION
It is-recommended that the City Council adopt the attached resolution authorizing award of
contract to FEDCO Construction, Inc. for the East Washington Street Reconstruction Project to
repair damage caused by water main failure.
BACKGROUND
On November 8, 2011, the existing 1.0 -inch water main in East Washington Street failed near the
Golden Eagle Shopping Center. The damaged water main was subsequently repaired by the
Water Resources and Conservation Department. As a result of the water main failure,
approximately 2,400 square Meet of the eastbound lanes on East Washington Street were variably
displaced up to three inches.
DISCUSSION
A reconstruction plan for the damaged. areas of East Washington Street has been prepared by the
Public Works Department. The damaged roadway section will be removed and replaced in
accordance with the reconstruction plan, as well as City of Petaluma and industry standards. The
plan also ' restriping East Washington Street lane lines.and the crosswalk within the
damaged area. Additionally, a geotechnical engineer was consulted to assess the damaged
roadway, 1prepare and analyze core samples of the damaged street section, and provide
recommendations to reconstruct the affected street section. It is possible that once the contractor
excavates the roadway section, additional damaged areas may be discovered that are not
currentlyknown. In that event, the City will remove and replace all such additional areas. For
this reason, a conservative construction contingency of thirty percent, rather than the typical
fifteen percent of bid' amount, has been applied to the project.

A notice;inviting bids was, issued on March 10, 2011, and the project bid opening occurred on
March 23, 2011. A total of 5 bids were received. The results of the bids are as follows:

The engineer's estimate is $28,995.
With a bid of $23,171, the low bidder is FEDCO Construction, Inc., who has satisfactorily
performed similar projects for the City of Petaluma and for other' municipal agencies. Staff
verified that FEDCO Construction possesses a valid. Class A California Contractor's License,
No. 479227, which qualifies it to perform the work. Staff recommends that the City enter into
contract 'With the low bidder, FEDCO Construction, Inc., to reconstruct the damaged portions of
East Washington Street. Once the construction agreement package is executed by all parties,
construction would begin immediately and is expected to take approximately one week, weather
permitting.
FINANCIAL IMPACTS

Project costs will be paid by the City''s Water Utility Fund as a maintenance project. The fund .
number is 6700.67700 and the project number is E6701201 I.
The following is a breakdown'of 'the construction budget:

Any.unused project budget, including contingency, will be returned to the funding source upon
final completion of the project.

RESOLUTION AUTHORIZING AWARD OF CONTRACT TO FEDCO
CONSTRUC'T'ION, INC. FOR THE EAST WASHINGTON STREET
RECONSTRUCTION PROJECT TO REPAIR DAMAGE CAUSED BY WATER MAIN
FAILURE
WHEREAS, City staff has prepared construction bid documents and advertised for
construction of this Project; and
WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code,
California Public Contract Code Section 20162 and other applicable law, City staff solicited bids
for the Project; and
WHEREAS, the Project was bid on March 23, 2011, and five (5) bids were received and
opened in accordance with applicable law; and
WHEREAS, the lowest bid for the Project was from FEDCO Construction, Inc. for
$23,171;

WHEREAS, staff has determined that FEDCO Construction's bid satisfies the bidding
requirements for the Project; and
WHEREAS, staff has verified that FEDCO Construction possesses a valid California
Contractor's License; Class A, number 479227 that qualifies FEDCO Construction to perform
the Project; and

WHEREAS, the Project is exempt pursuant to California Environmental Quality Act
( "CEQA' and Title 14, the California Code of Regulations ( "CEQA Guidelines "), Section
15301.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City hereby:
Approves the Project Budget in.the amount of $34,971.
2. In accordance with the City of Petaluma Charter and Municipal Code, California Public
Contract Code Section 20162 and other applicable law, waives any and all non-
conformance in° the bid of FEDCO Construction, Inc. for the East Washington Street
Reconstruction Project, finds the bid of $23,171, to be the lowest, responsive bid and
further finds that' FEDCO Construction, Inc. is 'the lowest responsible bidder.
3. Awards the, contract for the East Washington Street Reconstruction Project to FEDCO
Construction, 'Inc., in the amount of $23',171, the amount of the lowest responsive bid,

conditioned on FEDC.O Construction, Inc. timely executing the project contract and
submitting all required documents, including but not limited to, executed bonds,
certificates of insurance and endorsements, in accordance with the project bid documents.
4. Directs staff to issue a notice of award to FEDCO Construction, Inc.
Authorizes and directs the City Manager to execute the project contract on behalf of the
City of Petaluma upon timely submission by FEDCO Construction, Inc. of the signed
p "roject contract and all other required documents,' including but not limited to executed
bonds, certificates of insurance and endorsements, in accordance with the project bid
documents.
