HomeMy WebLinkAboutStaff Report 3.A 10/21/2019a�ALU Agenda Item #3.A I85$ DATE: October 21, 2019 TO: Honorable Mayor and Members of the City Council through City Manager FROM: Dan St. John — Director, Public Works and Utilities Jeff Gittings — Parks and Facilities Manager, Public Works and Utilities SUBJECT: Resolution Approving the Application for Prop 68 Per Capita Grant Funds RECOMMENDATION It is recommended that the City Council adopt the Resolution Approving the Application for Prop 68 Per Capita Grant Funds. BACKGROUND California voters passed the California Drought, Water, Parks, Climate, Coastal Protection, and Outdoor Access for All Act of 2018 (Prop 68) on June 5, 2018. Proposition 68 authorized $4 billion dollars in general obligated bonds for creation and rehabilitation of state and local parks, natural resources protection projects, climate adaptation projects, water quality supply projects, and flood protection projects. The Proposition 68 Per Capita Grant Funds Prograin authorized the Legislature to appropriate $185 million, of the $4 billon, to the California Department of Parks and Recreation (the "State") for non-competitive grants. These grants will provide for local park rehabilitation, creation, and improvements to local governments on a per capita basis. Prop 68's implementation has resulted in a number of competitive and non-competitive grant programs, of which staff is evaluating and recommending application where appropriate. Under the statutory requirements, the City is an eligible applicant of the Per Capita Funds. The total award for the City has not yet been determined by the State but will be at least $200,000. This is not an on-going grant program; Prop 68 Per Capita funds are one-time disbursements. Eligible projects include recreational purposes, either acquisition or development. Multiple projects may be submitted, but each project would need a separate application. If a project does not serve a severely disadvantaged community, which is defined as a community with an annual median household income less than 60% of the statewide average which Petaluma has no severely disadvantaged communities, proposed project would require a 20 percent match. DISCUSSION For the City to be eligible to receive Prop 68 Per Capita Grant Funds an approved resolution must be submitted to the State no later than November 1, 2019. Project specific application packets will be due January 31. 2020. Staff presented the Recreation, Music, and Parks Commission (RMPC) the Prop. 68 Per Capita Grant program project selection criteria at their regular meeting on September 18, 2019, for review and input. The project selection criteria presented to the RMPC is as follows: • Prioritize eligible project that have existing funding identified to fulfill the required 20% match in funds. • Prioritize projects that reach or exceed the $200,000 minimum threshold, acknowledging staff resources are required to submit separate applications with each eligible project. • Prioritize projects that align with City Council Goals or have been identified in the City's adopted master plan. • Proposed projects that include costs associated with reoccurring and long-term maintenance liability. If maintenance costs cannot be met using current funding allocation than alternative funding sources should be identified to mitigate • Proposed project increases recreational opportunities for an intergenerational population with diverse backgrounds and varying degree of abilities. Staff will review RMPC comments on the selection criteria and compile project(s) that fit that criteria along with comments from the commission. These project(s) will be presented to the RMPC at the October meeting for review and input. Staff will then be recommending a project(s) to the Council for their approval by December. PUBLIC OUTREACH This grant program was discussed with the RMPC at a special meeting in August and again at a regular meeting on September 18, 2019. FINANCIAL IMPACTS As no communities in Petaluma meet the definition of severely disadvantaged, or median income of less than 60 percent of the statewide average, a 20 percent snatch will be required from the City of Petaluma. The required match would be at least $40,000, though it is expected to be higher as awards will be made on a per capita basis. It is anticipated that funding for this grant will be available in FY 21. Staff will be presenting matching funds for potential projects in FY 21 annual budget. ATTACHMENTS 1. Resolution I Attachment 1 RESOLUTION APPROVING APPLICATION(S) FOR PER CAPITA GRANT FUNDS WHEREAS, the State Department of Parks and Recreation has been delegated the responsibility by the Legislature of the State of California for the administration of the Per Capita Grant Program under Proposition 68, setting up necessary procedures governing application(s); and WHEREAS, said procedures established by the State Department of Parks and Recreation require the grantee's Governing Body to certify by resolution the approval of project application(s) before submission of said applications to the State; and WHEREAS, the grantee will enter into a contract with the State of California to complete project(s); hereby: NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma 1. Approves the filing of project application(s) for Per Capita program grant project(s); and 2. Certifies that said grantee has or will have available, prior to commencement of project work utilizing Per Capita funding, sufficient funds to complete the project(s); and 3. Certifies that the grantee has or will have sufficient funds to operate and maintain the project(s), and 4. Certifies that all projects proposed will be consistent with the park and recreation element of the city's general or recreation plan (PRC §80063(a)), and 5. Certifies that these funds will be used to supplement, not supplant, local revenues in existence as of June 5, 2018 (PRC §80062(d)), and 6. Certifies that it will comply with the provisions of § 1771.5 of the State Labor Code, and 7. (PRC § 80001 (b)(8)(A-G)) To the extent practicable, as identified in the "Presidential Memorandum --Promoting Diversity and Inclusion in Our National Parks, National Forests, and Other Public Lands and Waters," dated January 12, 2017, the city will consider a range of actions that include, but are not limited to, the following: (A) Conducting active outreach to diverse populations, particularly minority, low-income, disabled populations, and tribal communities, to increase awareness within those communities and the public generally about specific programs and opportunities. (B) Mentoring new environmental, outdoor recreation, and conservation leaders to increase diverse representation across these areas. (C) Creating new partnerships with state, local, tribal, private, and nonprofit organizations to expand access for diverse populations. (D) Identifying and implementing improvements to existing programs to increase visitation and access by diverse populations, particularly minority, low-income, disabled populations, and tribal communities. (E) Expanding the use of multilingual and culturally appropriate materials in public communications and educational strategies, including through social media strategies, as appropriate, that target diverse populations. (F) Developing or expanding coordinated efforts to promote youth engagement and empowerment, including fostering new partnerships with diversity -serving and youth -serving organizations, urban areas, and programs. (G) Identifying possible staff liaisons to diverse populations; and 8. Agrees that to the extent practicable, the project(s) will provide workforce education and training, contractor, and job opportunities for disadvantaged communities (PRC §80001(b)(5)); and 9. Certifies that the grantee shall not reduce the amount of funding otherwise available to be spent on parks or other projects eligible for funds under this division in its jurisdiction. A one-time allocation of other funding that has been expended for parks or other projects, but which is not available on an ongoing basis, shall not be considered when calculating a recipient's annual expenditures. (PRC §80062(d)); and 10. Certifies that the grantee has reviewed, understands, and agrees to the General Provisions contained in the contract shown in the Procedural Guide; and 11. Delegates the authority to the City Manager, or designee to conduct all negotiations, sign and submit all documents, including, but not limited to applications, agreements, amendments, and payment requests, which may be necessary for the completion of the grant scope(s); and 12. Agrees to comply with all applicable federal, state, local laws, ordinances, rules, regulations, and guidelines. 11
