Commissioner Glass read article in favor of contemporary 22 Petaluma. 23 CORRESPONDENCE:. Letter regarding Nextel proposal. 24 APPEAL STATEMENT: Was read. y 25 LEGAL RECOURSE STATEMENT: Was noted on the agenda. 26 27 28 NEW BUSINESS: 29 PUBLIC HEARING: 30 31 I. NEXTEL COMMUNICATIONS — ROOF - MOUNTED PANEL ANTENNAS Ga). 32 33 Consideration of a request by Nextel Communications for a Conditional Use 34 Permit to replace three existing roof - mounted whip antennas located at 35 Dairymen's Feed at 323 E. Washington Street with twelve (12) roof - mounted 36 panel antennas. - The proposal calls for four panel antennas to be mounted on the 1 Planning Commission Minutes - April 25, 2000 1 north, east and south sides of the roof. Each panel measures 26.7 inches by 0 2 inches and extends four feet above the roof of the building which is 168 feet 3 above grade. 4 5 Jayni Allsep presented the staff report. 6 7 The public hearing was opened. 8 9 SPEAKERS: 10 11 Commissioner Bennett — What is the nature of letter — do the noise issues raised 12 have anything to do with the proposed antennas? Answer — No. Second part of 13 letter suggested steam emissions location to reduce noise. 14 15 Janice Cader - Thompson — What is City's benefit from this type of use? 16 Staff answer — the City, as an agency, has not been offered equipment and/or 17 financial credit as a part of this application. Applicant - presented proposed 18 project. 19 20 Commissioner Glass — Do you have any other sites in the area? Answer - 21 several in County. Will you expect to expand the number of antennas. (Answer - 22 Twelve is maximum number needed by Nextel.) 23 24 Commissioner Barrett — Confirmed from Nextel that 12 is the ultimate number 25 of antennas required. 26 27 Janice Cader- Thompson — What are color options? Staff suggested if the 28 Commission would like to specify color, silver or galvanized would blend with 29 the existing structure. 30 31 Commissioner Broad — Was not enamored with the Sprint proposal. Requested 32 staff to investigate Petaluma Hotel compliance with conditions of their CUP for 33 Sprint antennas. Was never aware of existing antennas at the site and supports 34 revised proposed antennas given distance from relative views. Color needs to 35 blend. 36 37 Commissioner Barrett — Supports the color suggested. 38 39 Commissioner Feibusch — Is satisfied with the proposal as modified and 40 appreciates efforts to reduce visual impacts given the historical nature of the 41 proposed site. 42 43 Commissioner Bennett - City needs to be proactive with future technologies and 44 wireless facilities; acknowledged the Schram's letter, but also acknowledged that 45 the concerns raised are not related to the proposed use. 46 Oj Planning Commission Minutes - April 25, 2000 1 The public hearing was closed. 2 3 A motion was made by Commissioner Glass and seconded by Commissioner 4 Barrett to approve a Use Permit to authorize the installation of twelve (12) roof - 5 mounted panel antennas on the Dairymen's Feed Building based on the findings 6 and subject to the amended conditions listed in the staff report. 7 8 Commissioner Barrett: Yes 9 Commissioner Broad: Yes 10 Commissioner Cader- Thompson: Yes 11 Commissioner Feibusch: Yes 12 Commissioner Glass: Yes 13 Commissioner Vieler: Absent 14 Chairperson Bennett: Yes 15 16 Findings: 17 18 1. That the proposed panel antennas are consistent with the provisions of Chapter 19 14.44, Telecommunications Facilities of the Petaluma Municipal Code. 20 21 2. That the proposed panel antennas and related telecommunications equipment 22 building, as conditioned, will conform to the requirements and intent of the C -C 23 Central Commercial Zoning District of the Petaluma Zoning Ordinance where 24 such equipment is allowed with a Conditional Use Permit, and is consistent with 25 development standards for the district, including setbacks from property lines, 26 easements, height limitations, and design. 27 28 3. That the proposed panel antennas, as conditioned, will conform to the 29 requirements and intent, goals and policies of the Mixed Use land use designation 30 of the Petaluma General Plan and ensure visual compatibility of the project with 31 the surrounding area. 32 33 4. That the proposed panel antennas will not constitute a nuisance or be detrimental 34 to the public welfare of the community, inasmuch as conditions have been 35 imposed regulating access, use and maintenance of the site. 36 37 5. That the proposed roof - mounted panel antennas, at 168 ft. above grade, are 38 consistent with Zoning Ordinance Section 24 -105, which exempts 39 telecommunication facilities from height restrictions. 40 41 CONDITIONS OF APPROVAL, 42 43 1. This Conditional Use Permit shall be issued exclusively to Nextel 44 Communications for the installation of twelve (12) roof - mounted panel antennas 45 (26.7 inches x 13 inches) to be pipe - mounted on the roof of the Dairymen's Feed 46 Building. Future co- locators shall be responsible for procuring approval from the 47 City of Petaluma prior to their use of the monopole. Planning Commission Minutes - April 25, 2000 1 2 2. The location of the facilities shall be as shown on the plans approved by the . 3 Planning Commission, as conditioned or modified. 4 5 3. A building permit shall be required from the Building Division prior to 6 commencement of construction/installation of panel antennas. 7 8 4. The three existing omni- directional whip antennas shall be removed upon 9 installation of the panel antennas. 10 11 5. Prior to the issuance of a building permit for installation of the panel antennas, the 12 applicant shall submit a sample of the proposed antenna color for review and 13 approval by the Community Development Director. 14 6. Prior to the issuance of a building permit for installation of the panel antennas, the 15 applicant shall obtain a Base Flood Elevation Certificate from the Federal 16 Emergency Management Agency (FEMA) for the existing 200 square foot 17 telecommunications equipment structure on the subject property. 18 19. 7. Outdoor noise producing construction activities shall only take place on weekdays 20 (Monday through Friday, non - holiday) between the hours of 7:30am and 5:30pm. 21 Construction activities shall comply with applicable Zoning Ordinance and 22 Municipal Code Performance Standards (noise, dust, odor, etc.). 23 24 8. At no time shall future business activities exceed Performance Standards specified 25 in the Uniform Building Code, Section 22 -301, of the Petaluma Zoning 26 Ordinance, and the 1987 General Plan. 27 28 9. The telecommunication facility and antennae shall comply at all times with all 29 FCC rules, regulations, and standards. 30 31 10. This Conditional Use Permit may be recalled to the Planning Commission for 32 review at any time due to complaints regarding lack of compliance with the 33 conditions of approval. At such time the Commission may initiate proceedings to 34 revoke_ the Conditional Use Permit or add/modify conditions of approval. 35 36 11. The applicants /developers shall defend, indemnify, and hold harmless the City or 37 any of its boards, commissions, agents, officers, and employees from any claim, 38 action or proceeding against the City, its boards, commissions, agents, officers, or 39 employees to attack, set aside, void, or annul, the approval of the project when 40 such claim or action is brought within the time period provided for in applicable 41 State and/or local statutes. The City shall promptly notify the 42 applicants /developers of any such claim, action, or proceeding. The City shall 43 coordinate in the defense. Nothing contained in this condition shall prohibit the 44 City from participating in a defense of any claim, action, or proceeding if the City 45 bears its own attorney's fees and costs, and the City defends the action in good 46 faith. 4 Planning Commission Minutes - April 25, 2000 1 2 12. The twelve (12) roof mounted panel antennas (26.7 x 13 inches) . to be pipe - 3 mounted on the roof of the Dairymen's Feed Building shall be of a finish color 4 (silver /gray) that matches the color of the existing building and surrounding roof 5 features, subject to staff review and approval prior to issuance of a Building 6 Permit. Said color scheme shall be submitted with the Building Permit 7 application. 8 9 10 11.
