Mike Moore, Community Development Director George White, Planning Manager Jane Thomson, Senior Planning Technician ROLL CALL PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES: Minutes of June 13, 2000 were approved as corrected. PUBLIC COMMENT: None DIRECTOR'S REPORT: Mike Moore introduced George White to the Commission COMMISSIONERS' REPORT: Chairman Bennett welcomed Mr. White to the City. CORRESPONDENCE: Letter of withdrawal for Public Convenience or Necessity to Vargas Market located at 946 Caulfield Lane. APPEAL STATEMENT: Within fourteen (14) calendar days following the date of a decision of the Planning Commission, the decision may be appealed to the City Council by the applicant or by any other interested party. If no appeal is made within that time, the decision shall be final. An appeal shall be addressed to the Council in writing and shall be filed with the City Clerk. Said appeal shall be accompanied by the appeal fee as specified by Resolution 92- 251- N.C.S. as adopted by the City Council. The appeal shall state specifically the grounds for the appeal and the relief sought by the appellant. MORRIS DISTRIBUTING: 454 Payran Street, APN 005- 020 -056; file # PCN 00003 Consideration of a request that a determination be made and findings forwarded to the State of California Alcoholic Beverage Control (ABC) that public convenience or necessity would be served by the issuance of an ABC license (Type 20 — off sale beer and wine) to Morris Distributing Company, Inc., to allow the retail sales of alcohol at 454 Payran Street. Jane Thomson presented the staff report. The public hearing was opened. Commissioner Vieler: Does this business already posess a type 20 license? Jane Thomson: Yes. The public hearing was closed. A motion was made by Commissioner Glass and seconded by Commissioner Cader- Thompson to approve the Public Convenience or Necessity based on the findings, and subject to the conditions of approval listed in the Staff Report. Commissioner Barrett: Absent Commissioner Broad: Yes Commissioner Cader- Thompson: Yes Commissioner Feibusch: Absent Commissioner Glass: Yes Commissioner Vieler: Yes Chairperson Bennett: Yes Findings for the Determination of Public Convenience or Necessity: 1. The proposed use is within a census tract which, pursuant to State Assembly Bill 2897 which amended Section 23958 of the Business and Professions Code, is considered to have an undue concentration of retail liquor licenses. The Planning Commission finds that, pursuant to Section 23958.4(b)(2), this license should be issued to Morris Distributing Co. Inc. because: a. The sale of beer, wine and liquor by mail, phone, e -mail and fax will provide a convenience to the general public; s\ pIanningcommission \minutes062700 2 9/19/00 Planning Commission Minutes - June 27, 2000 b. The sale of beer and wine by mail, phone, e -mail and fax increases the economic viability of the business; C. Although Morris Distributing Co. Inc. will be located within a census tract which experiences an undue concentration of retail liquor licenses, the sale of alcohol will not create a nuisance or be detrimental to the public health or welfare as there will be no on -site sales or consumption, and the hours of the retail operation are limited to those of the office, which are 8AM to 5PM Monday through Saturday, which will limit the potential for nuisances. CONDITIONS OF APPROVAL 1. Hours of operation for the sales of alcohol shall be limited to 8:OOAM to5:00PM Monday through Saturday. Retail sales shall be conducted only by mail, phone, e -mail and fax. An expansion of hours for alcohol sales shall require additional review and approval by the Planning Director. 2. No on -site retail sales or tasting to consumers shall be permitted at any time. II. VARGAS PRODUCE AND MARKET: 946 Caulfield Lane, Suite. C, APN 005- 020 -019; File #PCN 00002 Consideration of a request that a determination be made and findings forwarded to the State of California Alcoholic Beverage Control (ABC) that public convenience or necessity would be served by the issuance of an ABC license (Type 20 — off sale beer and wine) to Vargas Produce and Market to allow the retail sales of alcohol at the market at 946 Caulfield Lane, Ste. C. Due to the rescission of the property owner's consent to the application, this item was deemed withdrawn. 11.
